DEFINITIONS.\n\nIn this Act:\n(1) Advanced fraud detection technology.--The term\n``advanced fraud detection technology'' means emerging\ntechnologies used to detect, prevent, or mitigate financial\nfraud and scams, including artificial intelligence, machine\nlearning, predictive analytics, behavioral biometrics, network\nanalytics, data fusion tools, distributed ledger-based\nmonitoring tools, and blockchain tracing tools.\n(2) Artificial intelligence.--The term ``artificial\nintelligence'' has the meaning given that term in section 5002\nof the National Artificial Intelligence Initiative Act of 2020\n(15 U.S.C. 9401).\n(3) Credit union.--The term ``credit union'' has the\nmeaning given the term ``insured credit union'' in section 101\nof the Federal Credit Union Act (12 U.S.C. 1752).\n(4) Federal banking agency.--The term ``Federal banking\nagency''--\n(A) has the meaning given such term in section 3 of\nthe Federal Deposit Insurance Act (12 U.S.C. 1813); and\n(B) means the National Credit Union Administration.\n(5) Insured depository institution.--The term ``insured\ndepository institution'' has the meaning given such term in\nsection 3 of the Federal Deposit Insurance Act (12 U.S.C.\n1813).\n(6) Machine learning.--The term ``machine learning'' has\nthe meaning given that term in section 5002 of the National\nArtificial Intelligence Initiative Act of 2020 (15 U.S.C.\n9401).\n\nSEC. 3. STUDY ON ADVANCED TECHNOLOGIES IN FRAUD AND SCAM DETECTION AND\nPREVENTION.\n\n(a) In General.--The Federal banking agencies, in consultation with\nthe Secretary of the Treasury, the Financial Crimes Enforcement\nNetwork, the Federal Trade Commission, the Bureau of Consumer Financial\nProtection, the Federal Communications Commission, and other\nappropriate Federal and State government agencies, including\nappropriate law enforcement agencies, shall jointly conduct a\ncomprehensive study on the use of advanced fraud detection technology\nby insured depository institutions and credit unions.\n(b) Required Elements.--The study required under subsection (a)\nshall evaluate the following:\n(1) Current use and effectiveness.--The current use and\neffectiveness of advanced fraud detection technologies,\nincluding-\n(A) the extent to which insured depository\ninstitutions and credit unions of varying asset sizes\ndeploy advanced fraud detection technology;\n(B) measurable outcomes relating to fraud\ndetection, prevention, loss reduction, loss mitigation,\nprivacy, and consumer protection;\n(C) barriers to adoption and considerations of\ninteroperability, data access, liability, error rates,\nand regulation; and\n(D) how various fraud detection technologies differ\nin use, effectiveness, costs, benefits, and\nconsiderations under subparagraphs (A) through (C).\n(2) Community financial institution access.--Community\nfinancial institution (that is either an insured depository\ninstitution or credit union) access to advanced fraud detection\ntechnology, including--\n(A) challenges faced by community financial\ninstitutions in accessing or deploying advanced fraud\ndetection tools, including unique challenges faced by\nvarious types of community financial institutions;\n(B) whether economies of scale disadvantage smaller\ncommunity financial institutions in general, or certain\ntypes of smaller financial institutions;\n(C) options to facilitate shared services, utility\nmodels, managed-service providers, or consortium-based\nfraud detection platforms; and\n(D) recommendations to ensure regulatory guidance\nis appropriately tailored to avoid discouraging\nadoption by smaller community financial institutions.\n(3) Artificial intelligence and machine learning.--\nArtificial intelligence and machine learning, including--\n(A) the use by insured depository institutions and\ncredit unions of artificial intelligence and machine\nlearning models, applications, and tools in detecting\nfraud patterns, anomalies, synthetic identity fraud,\nand real-time payment fraud;\n(B) governance frameworks used by insured\ndepository institutions and credit unions to manage\nfraud model risk, explainability, and validation; and\n(C) steps Federal banking agencies can take in\ncoordination with other relevant government agencies\nand the private sector to ensure access by insured\ndepository institutions and credit unions, including\ncommunity financial institutions and their third-party\nvendors, to such models, applications, and tools.\n(4) Information sharing and public-private partnerships.--\nInformation sharing and public-private partnerships,\nincluding--\n(A) the effectiveness of existing information-\nsharing frameworks;\n(B) whether expanded public-private partnerships or\ncentralized fraud utilities would enhance detection\ncapabilities;\n(C) the feasibility of a voluntary fraud analytics\nconsortium accessible to community financial\ninstitutions; and\n(D) privacy, data protection, and cybersecurity\nconsiderations associated with expanded data sharing.\n(5) Payments system risks.--Payments system risk,\nincluding--\n(A) fraud risks associated with electronic funds\ntransfers and checks; and\n(B) whether advanced analytics can reduce fraud\nwhile preserving settlement finality and payment system\nstability.\n(6) Regulatory and supervisory considerations.--Regulatory\nand supervisory considerations, including--\n(A) what benefits and risks arise from existing\nsupervisory expectations with respect to innovations in\nfraud detection and prevention, including whether\nexisting supervisory expectations create barriers to\ninnovation while maintaining relevant safeguards;\n(B) the need for interagency guidance, regulatory\nclarity, or safe harbors to support technology adoption\nin a manner that promotes fraud detection and\nprevention consistent with consumer protection,\nprivacy, safety and soundness, and national security;\n(C) opportunities to harmonize expectations across\nFederal banking agencies; and\n(D) whether additional training for Federal banking\nagencies staff is necessary to promote effective\nregulation and supervision of financial institutions'\nuse of advanced fraud detection technology, especially\nfor community financial institutions.\n(c) Report and Recommendations.--\n(1) Report.--Not later than 18 months after the date of\nenactment of this Act, the Federal banking agencies shall issue\na report to the Committee on Financial Services of the House of\nRepresentatives and the Committee on Banking, Housing, and\nUrban Affairs of the Senate containing all findings and\ndeterminations made in carrying out the study required under\nthis section, and make such report publicly available.\n(2) Classified annex.--A report under paragraph (1) may\ninclude a classified annex, if applicable, provided to the\ncommittees.\n(3) Recommendations.--The report required under paragraph\n(1) shall include legislative, regulatory, or supervisory\nrecommendations that promote fraud detection and prevention\nconsistent with consumer protection, safety and soundness, and\nnational security, which may include--\n(A) proposals to support shared fraud detection\nutilities or consortium-based analytics platforms;\n(B) guidance or safe harbors to encourage\nartificial intelligence use in fraud prevention;\n(C) pilot programs tailored to community financial\ninstitutions; and\n(D) recommendations to strengthen public-private\ninformation sharing consistent with privacy and civil\nliberties protections.\n\nSEC. 4. COMMUNITY FINANCIAL INSTITUTION FRAUD TECHNOLOGY PILOT PROGRAM.\n\n(a) In General.--Not later than 1 year after submission of the\nreport required under section 3(c), the Federal banking agencies may\njointly establish a voluntary pilot program to facilitate community\nfinancial institution access for insured depository institutions and\ncredit unions with less than $10,000,000,000 in total consolidated\nassets to advanced fraud detection tools.\n(b) Program Features.--The pilot program described in subsection\n(a) may include--\n(1) pooled procurement or shared services models;\n(2) model validation assistance or technical support;\n(3) standardized vendor risk management templates;\n(4) regulatory clarity regarding model governance\nexpectations; and\n(5) collaboration with the Department of the Treasury and\nlaw enforcement to provide anonymized fraud typology data\nfeeds.\n(c) Sunset and Report.--\n(1) Sunset.--Any pilot program established under this\nsection shall expire not later than 3 years after submission of\nthe report required under section 3(c).\n(2) Report.--Not later than 6 months after the expiration\nof all pilot programs established under this section, the\nFederal banking agencies shall issue a report to the Committee\non Financial Services of the House of Representatives and the\nCommittee on Banking, Housing, and Urban Affairs of the Senate,\nand make such report available to the public, containing--\n(A) all findings and determinations made by the\nFederal banking agencies in carrying out any pilot\nprogram established under this section; and\n(B) any legislative, regulatory, or other\nrecommendations the Federal banking agencies may have\nbased on such findings and determinations.\n(3) Classified annex.--A report under paragraph (2) may\ninclude a classified annex, if applicable, provided to the\ncommittees.\nUnion Calendar No. 612\n\n119th CONGRESS\n\n2d Session\n\nH.
