SHORT TITLE.\n\nThis Act may be cited as the ``Safe Cloud Storage Act''.\n\nSEC. 2. STORAGE OF CHILD PORNOGRAPHY AND CHILD OBSCENITY.\n\n(a) In General.--Title II of the PROTECT Our Children Act of 2008\n(34 U.S.C. 21101 et seq.) is amended by inserting after section 201 the\nfollowing:\n\n``SEC. 202. MODERNIZING LAW ENFORCEMENT'S ABILITY TO STORE CHILD\nPORNOGRAPHY AND CHILD OBSCENITY AND LIMITED LIABILITY FOR\nAPPROVED VENDORS.\n\n``(a) Definitions.--In this section:\n``(1) Approved vendor.--The term `approved vendor' means an\norganization, corporation, or entity that--\n``(A) offers digital storage services, including\nremote or cloud-based storage, and analytical and\nforensic tool processing support; and\n``(B) has been contractually retained by a covered\nagency to support the duties of such agency by--\n``(i) storing digital child pornography or\nchild obscenity;\n``(ii) making such child pornography or\nchild obscenity available to the contracting\nagency, or any law enforcement or prosecutorial\nagency designated by the contracting agency,\nupon request; and\n``(iii) providing maintenance, technical\nand analytical assistance, and forensic tool\nprocessing support upon request by the\ncontracting agency.\n``(2) Child pornography.--The term `child pornography' has\nthe meaning given that term in section 2256(8) of title 18,\nUnited States Code.\n``(3) Child obscenity.--The term `child obscenity' has the\nmeaning given that term in section 21101(2) of title 34, United\nStates Code.\n``(4) Covered agency.--The term `covered agency' means a\nUnited States Federal, State, or local law enforcement or\nprosecutorial agency.\n``(5) Local.--The term `local' means any political\nsubdivision of a State.\n``(6) State.--The term `State' means any of the 50 States\nof the United States, the District of Columbia, the\nCommonwealth of Puerto Rico, the United States Virgin Islands,\nGuam, American Samoa, or the Commonwealth of the Northern\nMariana Islands.\n``(b) Limited Liability for Approved Vendors.--\n``(1) Limited liability for law enforcement approved\nvendors.--Except as provided in paragraph (2), a civil claim or\ncriminal charge may not be brought in any Federal or State\ncourt against an approved vendor relating to the approved\nvendor's performance of any contractual obligation or service\ndescribed in subsection (a)(1).\n``(2) Intentional, reckless, or other misconduct.--A civil\nclaim or criminal charge may be brought in any Federal or State\ncourt against an approved vendor if the approved vendor--\n``(A) engaged in--\n``(i) intentional misconduct; or\n``(ii) negligent conduct; or\n``(B) acted, or failed to act--\n``(i) with actual malice;\n``(ii) with reckless disregard to a\nsubstantial risk of causing injury without\nlegal justification; or\n``(iii) for a purpose unrelated to the\nperformance of any responsibility or function\ndescribed in subsection (a)(1)(B).\n``(c) Vendor Cybersecurity Requirements.--With respect to any child\npornography or child obscenity stored, maintained, or processed by an\napproved vendor, such approved vendor shall--\n``(1) secure such child pornography or child obscenity in a\nmanner that is consistent with the most recent version of the\nCybersecurity Framework developed by the National Institute of\nStandards and Technology, or any successor thereto;\n``(2) only access the child pornography or child obscenity\nupon consent of the law enforcement or prosecutorial agency\ncontracting the service and for the purpose of providing\nmaintenance, technical assistance, and forensic tool processing\nsupport in the cloud;\n``(3) minimize the number of employees that may be able to\nobtain access to such child pornography or child obscenity and\nmaintain a list of employees who have obtained such access;\n``(4) employ end-to-end encryption for data storage and\ntransfer functions, or an equivalent technological standard;\n``(5) undergo an independent annual cybersecurity audit to\ndetermine whether such child pornography or child obscenity is\nsecured as required by paragraph (1), including by assessing\ncompliance with the National Institute of Standards and\nTechnology Special Publication 800-53, Revision 5 (relating to\nsecurity and privacy controls for information systems and\norganizations) or any successor documents or revisions; and\n``(6) promptly address all issues identified by an audit\ndescribed in paragraph (5).\n``(d) Evidence Storage.--Any covered agency that stores child\npornography and child obscenity pursuant to a contract with an approved\nvendor shall ensure that such evidence is retained--\n``(1) in compliance with the security policy of the\nCriminal Justice Information Services Division of the Federal\nBureau of Investigation, or any other similar and appropriate\ndivision within the Federal Bureau of Investigation;\n``(2) for a period consistent with the evidence retention\nrequirements applicable to the investigating or prosecuting\ncovered agency under the relevant Federal, State, or local law,\nrule of criminal procedure, or prosecutorial policy; or\n``(3) in the absence of such law, rule, or policy, for a\nperiod not less than the applicable statute of limitations or\nthe duration of any sentence imposed, including the period of\npost-conviction review.\n``(e) Additional Requirements for Approved Vendors.--\n``(1) Location of data.--\n``(A) In general.--Except as provided in\nsubparagraph (B), each approved vendor shall ensure\nthat child pornography and child obscenity stored\npursuant to this section remains in the United States.\n``(B) Exception.--Child pornography and child\nobscenity under this section may be transferred outside\nthe United States only with the express consent of the\ncontracting covered agency if such agency deems the\ntransfer necessary for investigative purposes.\n``(2) Notification letter.--\n``(A) In general.--Approved vendors shall file a\nnotification letter with the Criminal Division of the\nDepartment of Justice not later than 30 days after\nentering into a contract described in subsection\n(a)(1)(B).\n``(B) Contents.--The notification letter described\nin subparagraph (A) shall include the entity name and\npoint of contact information of the approved vendor,\nthe name of the contracting covered agency, the period\nof performance of the contract, and an acknowledgment\nby the approved vendor that the approved vendor will\nnotify the Child Exploitation and Obscenity Section of\nthe Criminal Division of the Department of Justice of\nany changes to the information in the letter.\n``(3) Breach of contract.--\n``(A) In general.--If a covered agency fails to\nmake required payment under a contract, breaches any\nmaterial term of such contract, or otherwise terminates\nsuch contract without establishing lawful transfer of\nthe evidence, the approved vendor shall, not later than\n30 days after the failure, breach, or termination,\nnotify the Criminal Division of the Department of\nJustice in the case of a breach by a Federal agency, or\nthe appropriate State attorney general in the case of a\nbreach by a State or local agency.\n``(B) Maintenance of evidence.--Upon making a\nnotification under subparagraph (A), the approved\nvendor shall continue to preserve and maintain the\nintegrity of the evidence until a prompt and lawful\ntransfer of custody occurs to the Criminal Division of\nthe Department of Justice or another Federal, State, or\nlocal law enforcement agency with jurisdiction.\n``(f) Rule of Construction.--Nothing in this section shall be\nconstrued to--\n``(1) limit bona fide use by the contracting covered agency\nof child pornography or child obscenity being stored by the\napproved vendor, which includes providing such child\npornography or child obscenity to any other party as necessary\nfor an investigation or prosecution;\n``(2) limit the obligation of the contracting covered\nagency to comply with a constitutional or statutory obligation,\ncourt order, or request from a victim made pursuant to section\n3509(m)(3) of title 18, United States Code; or\n``(3) authorize or require the audit, assessment, or\ncompliance verification of a governmental entity or any system\nadministered by a governmental entity.''.\n(b) Clerical Amendment.--Section 1(b) of the PROTECT Our Children\nAct of 2008 (Public Law 110-401; 122 Stat. 4229) is amended by\ninserting after the item relating to section 201 the following:\n\n``Sec. 202.
