PILOT PROGRAM FOR EXPEDITING EXAMINATION OF CERTAIN CRITICAL\nAND EMERGING TECHNOLOGY PATENT APPLICATIONS.\n\n(a) Definitions.--In this section:\n(1) Covered application.--The term ``covered application''\nmeans an application for patent that contains at least 1\nclaimed invention directed to an eligible critical or emerging\ntechnology.\n(2) Director.--The term ``Director'' means the Under\nSecretary of Commerce for Intellectual Property and Director of\nthe Office.\n(3) Eligible critical or emerging technology.--The term\n``eligible critical or emerging technology'' means--\n(A) an artificial intelligence capability relating\nto--\n(i) machine learning;\n(ii) deep learning;\n(iii) reinforcement learning;\n(iv) sensory perception or recognition;\n(v) an artificial intelligence assurance or\nassessment technique;\n(vi) a foundation model;\n(vii) a generative artificial intelligence\nsystem or multimodal or large language model;\n(viii) a synthetic data approach for\ntraining, tuning, or testing;\n(ix) planning, reasoning, or decision\nmaking; or\n(x) the improvement of artificial\nintelligence safety, trust, security, or\nresponsible use;\n(B) semiconductor design or an electronic design\nautomation tool; or\n(C) a quantum information science capability\nrelating to--\n(i) quantum computing;\n(ii) materials, isotopes, or fabrication\ntechniques for quantum devices;\n(iii) quantum sensing; or\n(iv) quantum communications or networking.\n(4) Expedite.--The term ``expedite'' means, with respect to\na covered application, to advance that covered application out\nof turn through the use of a petition to make special.\n(5) Office.--The term ``Office'' means the United States\nPatent and Trademark Office.\n(6) Pilot program.--The term ``pilot program'' means the\npilot program established under subsection (b).\n(b) Establishment.--Not later than 1 year after the date of\nenactment of this Act, the Director shall establish a pilot program to\nexpedite the examination, under section 131 of title 35, United States\nCode, of covered applications.\n(c) Purpose.--The purpose of the pilot program shall be to\nencourage innovation by, and the leadership of, the United States with\nrespect to critical or emerging technologies by ensuring that covered\napplications receive prompt consideration.\n(d) Implementation.--In carrying out the pilot program, the\nDirector may--\n(1) by regulation, and in addition to the requirements\nunder subsection (e), prescribe the conditions under which a\ncovered application shall be accepted and examined under the\npilot program, including--\n(A) the requirements to participate in the pilot\nprogram;\n(B) internal processing by the Office of covered\napplications under the pilot program;\n(C) requirements for restriction or unity of\ninventions identified in covered applications;\n(D) the period during which the applicant\nsubmitting the covered application may reply with\nrespect to an action taken by the Office with respect\nto the covered application;\n(E) standards relating to a reply described in\nsubparagraph (D);\n(F) standards or procedures governing--\n(i) any amendment, affidavit, or other\nevidence filed after a final action taken by\nthe Office with respect to the covered\napplication; and\n(ii) any process for appeal with respect to\na final action described in clause (i); and\n(G) the withdrawal, by an applicant, of a covered\napplication submitted under the pilot program;\n(2) waive--\n(A) the petition fee described in section 1.102(d)\nof title 37, Code of Federal Regulations, or any\nsuccessor regulation; or\n(B) any other requirement of the Office relating to\nthe accelerated examination program or the prioritized\nexamination program; and\n(3) consult with the Attorney General, the Secretary of\nDefense, the Secretary of State, the Secretary of the Treasury,\nthe Director of National Intelligence, or the head of any other\nFederal agency, as may be appropriate to carry out the pilot\nprogram.\n(e) Qualifying Applications.--To best achieve the purpose of the\npilot program, the Director shall ensure that a covered application\nsatisfies the following requirements to qualify for the pilot program:\n(1) The applicant submitting the covered application--\n(A) is not a foreign entity of concern, as defined\nin section 9901 of the William M. (Mac) Thornberry\nNational Defense Authorization Act for Fiscal Year 2021\n(15 U.S.C. 4651); and\n(B) certifies in the covered application that the\ninventor or any joint inventor with respect to any\nclaimed invention in the covered application has not\nbeen named as the inventor or joint inventor with\nrespect to more than 4 other covered applications\nsubmitted under the pilot program.\n(2) The covered application is a noncontinuing,\nnonprovisional application for an original utility patent filed\nunder section 111(a) of title 35, United States Code, that does\nnot claim any domestic benefit under section 120, 121, 365(c),\nor 386(c) of that title.\n(f) Termination.--\n(1) In general.--The pilot program shall terminate on the\nearlier of the following:\n(A) The date that is 5 years after the date on\nwhich the Director first accepts a covered application\nfor participation in the pilot program.\n(B) The date on which the Director has accepted\n15,000 covered applications for participation in the\npilot program, without regard to whether those covered\napplications have been expedited under the pilot\nprogram.\n(2) Renewal.--If the pilot program terminates under\nparagraph (1)(B), the Director may renew the pilot program for\nthe shorter of the following:\n(A) An additional 5-year period, beginning on the\ndate on which the pilot program terminates under\nparagraph (1)(B).\n(B) An additional period--\n(i) beginning on the date on which the\npilot program terminates under paragraph\n(1)(B); and\n(ii) ending on the date on which the\nDirector has accepted an additional 15,000\ncovered applications for participation in the\npilot program, without regard to whether those\ncovered applications have been expedited under\nthe pilot program.\n(3) Notice of renewal.--The Director shall notify the\nCommittee on the Judiciary of the Senate and the Committee on\nthe Judiciary of the House of Representatives of the intent of\nthe Director to renew the pilot program under paragraph (2) not\nlater than the date that is the earlier of the following:\n(A) The date that is 60 days before the date\ndescribed in paragraph (1)(A).\n(B) The date that is 30 days after the date on\nwhich the Director has accepted 12,000 covered\napplications for participation in the pilot program,\nwithout regard to whether those covered applications\nhave been expedited under the pilot program.\n(g) Public Availability of Information.--The Director shall make\npublicly available in an easily accessible location on the website of\nthe Office information about the pilot program, including--\n(1) the number of covered applications submitted under the\npilot program;\n(2) the number of covered applications described in\nparagraph (1) that the Director has accepted for participation\nin the pilot program; and\n(3) the number of patents that have been issued for\ninventions claimed in covered applications expedited under the\npilot program.\n(h) Report to Congress.--\n(1) In general.--Not later than 180 days after the date on\nwhich the pilot program terminates (including any renewal of\nthe pilot program under subsection (f)(2)), the Director shall\nsubmit to the Committee on the Judiciary of the Senate and the\nCommittee on the Judiciary of the House of Representatives a\nreport that assesses the impact and effectiveness of the pilot\nprogram based on all available data.\n(2) Applicability.--The collection of any data for the\npurposes of carrying out paragraph (1) shall be exempt from\nsubchapter I of chapter 35 of title 44, United States Code\n(commonly referred to as the ``Paperwork Reduction Act'').\n<all>","changes":[{"id":577,"doc_id":322,"v_from":171,"v_to":13660,"detected_at":"2026-09-11 02:50:44","added":218,"removed":11,"summary":"--- \n+++ \n-Error occurred.
