U.S. Immigration and Customs Enforcement.\nSec. 203. Additional Department of Homeland Security appropriations.\n\nTITLE I--COMMITTEE ON HOMELAND SECURITY AND GOVERNMENTAL AFFAIRS\n\nSEC. 101. U.S. CUSTOMS AND BORDER PROTECTION PERSONNEL.\n(a) Personnel.--In addition to amounts otherwise available, there\nis appropriated to the Commissioner of U.S. Customs and Border\nProtection for fiscal year 2026, out of any money in the Treasury not\notherwise appropriated, $9,550,000,000, to remain available until\nSeptember 30, 2029, to hire, pay, train, and equip Border Patrol agents\nand Border Patrol support personnel to conduct functions other than\nimmigration enforcement and customs functions.\n(b) Restriction.--None of the funds made available by subsection\n(a) may be used to recruit, hire, or train personnel for the duties of\nprocessing coordinators after October 31, 2028.\nSEC. 102. U.S. IMMIGRATION AND CUSTOMS ENFORCEMENT.\nIn addition to amounts otherwise available, there is appropriated\nto the Director of U.S. Immigration and Customs Enforcement for fiscal\nyear 2026, out of any money in the Treasury not otherwise appropriated,\n$7,450,000,000, to remain available until September 30, 2029, to hire,\npay, train, and equip Homeland Security Investigations agents and\nsupport personnel and to provide other necessary expenses for Homeland\nSecurity Investigations' mission support and operations and\nmaintenance, of which $108,500,000 shall be used to hire, pay, and\nequip additional child exploitation investigators and forensics\nanalysts at the Victim Identification Laboratory of the Child\nExploitation Investigations Unit of Homeland Security Investigations\nand at the Homeland Security Investigations offices of the Special\nAgent in Charge to support the identification and rescue of victims of\nchild sexual exploitation and abuse, and to train such personnel and\nState and local law enforcement regarding identifying victims of child\nsexual exploitation and abuse within the Homeland Security\nInvestigations Cyber Crimes Center, except that funds provided in this\nsection shall be used for functions other than those related to\nHomeland Security Investigations' immigration enforcement and customs\nenforcement missions.\nSEC. 103. BORDER SECURITY, TECHNOLOGY, AND SCREENING.\n(a) In General.--In addition to amounts otherwise available, there\nis appropriated to the Commissioner of U.S. Customs and Border\nProtection for fiscal year 2026, out of any money in the Treasury not\notherwise appropriated, to remain available until September 30, 2029,\n$3,450,000,000 for the following:\n(1) Procurement and integration of new nonintrusive inspection\nequipment and associated civil works, including artificial\nintelligence, machine learning, and other innovative technologies,\nas well as other mission support, to combat the entry or exit of\nillicit narcotics at ports of entry and along the southwest,\nnorthern, and maritime borders.\n(2) Air and Marine operations' upgrading and procurement of new\nplatforms for rapid air and marine response capabilities.\n(3) Upgrades and procurement of border surveillance\ntechnologies along the southwest, northern, and maritime borders.\n(4) Necessary expenses, including the deployment of technology,\nrelating to the biometric entry and exit system under section 7208\nof the Intelligence Reform and Terrorism Prevention Act of 2004 (8\nU.S.C. 1365b).\n(5) Enhancing border security by combating drug trafficking,\nincluding fentanyl and its precursor chemicals, at the southwest,\nnorthern, and maritime borders.\n(6) Necessary expenses for U.S. Customs and Border Protection's\nmission support and operations and maintenance for functions other\nthan those related to its immigration enforcement and customs\nmissions.\n(b) Restrictions.--None of the funds made available under\nsubsection (a) may be used for the procurement or deployment of\nsurveillance towers along the southwest border and northern border that\nhave not been tested and accepted by U.S. Customs and Border Protection\nto deliver autonomous capabilities.\n(c) Definition of Autonomous.--In this section, with respect to\ncapabilities, the term ``autonomous'' means a system designed to apply\nartificial intelligence, machine learning, computer vision, or other\nalgorithms to accurately detect, identify, classify, and track items of\ninterest in real time such that the system can make operational\nadjustments without the active engagement of personnel or continuous\nhuman command or control.\nSEC. 104. ADDITIONAL DEPARTMENT OF HOMELAND SECURITY\nAPPROPRIATIONS.\nIn addition to amounts otherwise available, there are appropriated\nto the Secretary of Homeland Security for fiscal year 2026, out of any\nmoney in the Treasury not otherwise appropriated, $2,500,000,000, to\nremain available until September 30, 2029, for the purposes provided in\nthis title.\n\nTITLE II--COMMITTEE ON THE JUDICIARY\n\nSEC. 201. U.S. CUSTOMS AND BORDER PROTECTION.\nIn addition to amounts otherwise available, there is appropriated\nto the Commissioner of U.S. Customs and Border Protection for fiscal\nyear 2026, out of any money in the Treasury not otherwise appropriated,\n$13,020,000,000, to remain available until September 30, 2029, for\nhiring, paying, training, and equipping U.S. Customs and Border\nProtection agents, and the necessary support staff, and to provide\nother necessary expenses for U.S. Customs and Border Protection mission\nsupport and operations and maintenance, in order to carry out\nimmigration enforcement activities.\nSEC. 202. U.S. IMMIGRATION AND CUSTOMS ENFORCEMENT.\nIn addition to amounts otherwise available, there is appropriated\nto the Director of U.S. Immigration and Customs Enforcement for fiscal\nyear 2026, out of any money in the Treasury not otherwise appropriated,\n$31,075,000,000, to remain available until September 30, 2029, for the\nfollowing purposes:\n(1) Hiring, paying, and training.--Hiring, paying, training,\nand equipping U.S. Immigration and Customs Enforcement personnel\nand the personnel for all its directorates, including officers,\nagents, investigators, attorneys and support staff, to carry out\nimmigration enforcement activities.\n(2) Transportation.--Funding for transportation costs and\nrelated costs associated with alien departure or removal\noperations.\n(3) Information technology.--Funding for information technology\nmaintenance and sustainment to support enforcement and removal\noperations, including improvements to fee collections and body-worn\ncameras.\n(4) Facility maintenance and sustainment.--Funding for facility\nmaintenance and sustainment to support enforcement and removal\noperations.\n(5) Fleet maintenance and sustainment.--Funding for fleet\nmaintenance and sustainment to support enforcement and removal\noperations.\n(6) 287(g) agreements.--Supporting coordination with state and\nlocal authorities by expanding, facilitating, and implementing\nagreements under section 287(g) of the Immigration and Nationality\nAct (8 U.S.C. 1357(g)).\n(7) Office of the principal legal advisor.--Hiring and paying\nattorneys and the necessary support staff within the Office of the\nPrincipal Legal Advisor to represent the Department in immigration\nenforcement and removal proceedings.\n(8) Operation and maintenance.--Necessary expenses for U.S.\nImmigration and Customs Enforcement's mission support, including\nawards, and operations and maintenance for its immigration\nenforcement functions.\n(9) Operations by u.s. immigration and customs enforcement to\narrest released covered unlawful aliens.--\n(A) In general.--Not less than $350,000,000 for U.S.\nImmigration and Customs Enforcement for necessary expenses, in\naccordance with existing law, of detainer management, detainer\nissuance, custodial transfer, release monitoring,\ntransportation, and arrests of covered unlawful aliens\nencountered in jurisdictions that are not qualified cooperating\njurisdictions, except that no Indian tribal government shall be\ntreated as a jurisdiction that is not a qualified cooperating\njurisdiction for purposes of this subparagraph.\n(B) Qualified cooperating jurisdiction defined.--In this\nparagraph, the term ``qualified cooperating jurisdiction''\nmeans a State or political subdivision of a State that, as of\nthe date of the enactment of this Act--\n(i) is party to a written agreement in effect under\nsection 287(g) of the Immigration and Nationality Act (8\nU.S.C. 1357(g)); or\n(ii) has in effect, and has filed with the Secretary in\nsuch form and manner as the Secretary may prescribe, a\ncertification that such State or political subdivision is\nin compliance with section 642 of the Illegal Immigration\nReform and Immigrant Responsibility Act of 1996 (8 U.S.C.\n1373) and section 434 of the Personal Responsibility and\nWork Opportunity Reconciliation Act of 1996 (8 U.S.C.\n1644).\n(C) Limitation on use of funds.--None of the funds\nappropriated pursuant to this paragraph may be used, except as\nrequired by existing law, to release, parole, place on\nalternatives to detention, transport for purposes of release,\nor otherwise facilitate the release into the community of any\ncovered unlawful alien encountered.\n(D) Covered unlawful alien defined.--In this paragraph, the\nterm ``covered unlawful alien'' means an adult alien who--\n(i) is described in section 236(c)(1) of the\nImmigration and Nationality Act (8 U.S.C. 1226(c)(1));\n(ii) is inadmissible under section 212(a)(2) of such\nAct (8 U.S.C. 1182(a)(2));\n(iii) is deportable under section 237(a)(2) of such Act\n(8 U.S.C. 1227(a)(2));\n(iv) following an arrest, charge, booking, or\nconviction for a criminal offense under Federal, State, or\nlocal law, other than a minor traffic offense, is the\nsubject of an immigration detainer, notice request, or\ncustody-transfer request issued by the Department of\nHomeland Security pursuant to section 236, 241(a), or 287\nof such Act (8 U.S.C. 1226, 1231(a), or 1357); or\n(v) has been charged with or convicted of an offense\ndescribed in section 275 or 276 of such Act (8 U.S.C. 1325\nor 1326).\nSEC. 203.
