SHORT TITLE.\n\nThis Act may be cited as the ``SBA Artificial Intelligence\nUtilization Act of 2026''.\n\nSEC. 2. REPORTS REGARDING ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING\nUSE BY THE SMALL BUSINESS ADMINISTRATION.\n\nSection 10(c) of the Small Business Act is amended to read as\nfollows:\n``(c) Artificial Intelligence and Machine Learning Use Reports.--\n``(1) Reports required.--Not later than 90 days after the\ndate of the enactment of this subsection, and annually\nthereafter, the Administrator shall submit to the Committee on\nSmall Business of the House of Representatives and the\nCommittee on Small Business and Entrepreneurship of the Senate\na report on--\n``(A) the use of artificial intelligence and\nmachine learning by the Administration;\n``(B) the benefits and risks posed by the use of\nartificial intelligence and machine learning in the\nwork of the Administration, including in impeding the\noperations of the Administration; and\n``(C) measures that the Administrator can take to\neffectively identify, evaluate, and manage such\nbenefits and risks, including explanations of how the\nAdministrator can--\n``(i) retain human involvement in important\ndecisions informed by recommendations made by\nartificial intelligence or machine learning;\n``(ii) identify tasks and functions that\nartificial intelligence or machine learning can\nand cannot reliably and effectively perform,\nincluding whether artificial intelligence and\nmachine learning can improve operations,\nproductivity, or customer service;\n``(iii) determine which specific artificial\nintelligence or machine learning tools are\nappropriate for a particular task or function,\nif such task or function is determined to have\nthe potential to be reliably and effectively\nperformed by artificial intelligence or machine\nlearning; and\n``(iv) determine whether an artificial\nintelligence or machine learning tool\nadequately fills a need of the Administration\nand is worth adopting to fulfill such need.\n``(2) Briefing required.--Not later than 30 days after the\ndate on which the Administrator submits each report required\nunder paragraph (1), the Administrator shall provide to the\ncommittees described in such paragraph a briefing on such\nreport.\n``(3) Definitions.--In this subsection, the terms\n`artificial intelligence' and `machine learning' have the\nmeanings given, respectively, in section 5002 of the William M.\n(Mac) Thornberry National Defense Authorization Act for Fiscal\nYear 2021 (15 U.S.C. 9401).''.\n\nPassed the House of Representatives June 23, 2026.\n\nAttest:\n\nKEVIN F.
