SHORT TITLE.\n\nThis Act may be cited as the ``Guarding Unprotected Aging Retirees\nfrom Deception Act'' or the ``GUARD Act''.\n\nSEC. 2. DEFINITIONS.\n\nIn this Act:\n(1) Elder financial fraud.--The term ``elder financial\nfraud'' means the illegal or improper use of the money,\nproperty, or other resources of an elderly individual or adult\nwith a disability for monetary or personal benefit, profit, or\ngain.\n(2) Eligible federal grant funds.--The term ``eligible\nFederal grant funds'' means funds received under any of the\nfollowing:\n(A) Title IV of the Prioritizing Resources and\nOrganization for Intellectual Property Act of 2008 (34\nU.S.C. 30103 et seq.) (commonly known as the\n``Economic, High-Technology, White Collar, and Internet\nCrime Prevention National Training and Technical\nAssistance Program''), including relating to the use of\ntechnology to solve crimes and to facilitate\nprosecutions (commonly known as the ``Internet of\nThings (IoT) National Training and Technical Assistance\nProgram'').\n(B) Title 28, Code of Federal Regulations, part 23\n(commonly known as ``Justice Information Sharing\nTraining and Technical Assistance Program'').\n(C) Section 1401 of the Violence Against Women Act\nReauthorization Act of 2022 (34 U.S.C. 30107) to a\nlocal law enforcement agency for enforcement of\ncybercrimes against individuals.\n(D) Section 1701 title I of the Omnibus Crime\nControl and Safe Streets Act of 1968 (34 U.S.C. 10381),\nrelating to developing and acquiring effective\nequipment, technologies, and interoperable\ncommunications that assist in responding to and\npreventing crime (commonly known as the ``COPS\nTechnology and Equipment Program'').\n(3) General financial fraud.--The term ``general financial\nfraud'' means, in order to obtain money or other things of\nvalue--\n(A) intentional misrepresentation of information or\nidentity to deceive an individual;\n(B) unlawful use of a credit card, debit card, or\nautomated teller machine; or\n(C) use of electronic means to transmit deceptive\ninformation.\n(4) Pig butchering.--The term ``pig butchering'' means a\nconfidence and investment fraud in which the victim is\ngradually lured into making increasing monetary contributions,\ngenerally in the form of cryptocurrency, to a seemingly sound\ninvestment before the scammer disappears with the contributed\nmonies.\n(5) Scam.--The term ``scam'' means a financial crime\nundertaken through the use of social engineering that uses\ndeceptive inducement to acquire--\n(A) authorized access to funds; or\n(B) personal or sensitive information that can\nfacilitate the theft of financial assets.\n(6) State.--The term ``State'' means each of the several\nStates, the District of Columbia, and each territory of the\nUnited States.\n\nSEC. 3. FEDERAL GRANTS USED FOR INVESTIGATING ELDER FINANCIAL FRAUD,\nPIG BUTCHERING, AND GENERAL FINANCIAL FRAUD.\n\n(a) In General.--State, local, and Tribal law enforcement agencies\nand grantees that receive eligible Federal grant funds may use such\nfunds for investigating elder financial fraud, pig butchering, and\ngeneral financial fraud, including by--\n(1) hiring and retaining analysts, agents, experts, and\nother personnel;\n(2) providing training specific to complex financial\ninvestigations, including training on--\n(A) coordination and collaboration between State,\nlocal, Tribal, and Federal law enforcement agencies;\n(B) assisting victims of financial fraud and\nexploitation;\n(C) the use of blockchain intelligence tools and\nrelated capabilities relating to emerging technologies\nidentified in the February 2024 ``Critical and Emerging\nTechnology List Update'' of the Fast Track Action\nSubcommittee on Critical and Emerging Technologies of\nthe National Science and Technology Council (the\n``Critical and Emerging Technology List''); and\n(D) unique aspects of fraud investigations,\nincluding transnational financial investigations and\nemerging technologies identified in the Critical and\nEmerging Technology List;\n(3) obtaining software and technical tools to conduct\nfinancial fraud and exploitation investigations;\n(4) encouraging improved data collection and reporting;\n(5) supporting training and tabletop exercises to enhance\ncoordination and communication between financial institutions\nand State, local, Tribal, and Federal law enforcement agencies\nfor the purpose of stopping fraud and scams; and\n(6) designating a financial sector liaison to serve as a\npoint of contact for financial institutions to share and\nexchange with State, local, Tribal, and Federal law enforcement\nagencies information relevant to the investigation of fraud and\nscams.\n(b) Report to Grant Provider.--Each law enforcement agency and\ngrantee that makes use of eligible Federal grant funds for a purpose\nspecified under subsection (a) shall, not later than 1 year after\nmaking such use of the funds, submit to the Federal agency that\nprovided the eligible Federal grant funds, a report containing--\n(1) an explanation of the amount of funds so used, and the\nspecific purpose for which the funds were used;\n(2) statistics with respect to elder financial fraud, pig\nbutchering, and general financial fraud in the jurisdiction of\nthe law enforcement agency, along with an analysis of how the\nuse of the funds for a purpose specified under subsection (a)\naffected such statistics; and\n(3) an assessment of the ability of the law enforcement\nagency to deter elder financial fraud, pig butchering, and\ngeneral financial fraud.\n\nSEC. 4. REPORT ON GENERAL FINANCIAL FRAUD, PIG BUTCHERING, AND ELDER\nFINANCIAL FRAUD.\n\nNot later than 1 year after the date of enactment of this Act, the\nSecretary of the Treasury and the Director of the Financial Crimes\nEnforcement Network in consultation with the Attorney General, the\nSecretary of Homeland Security, and the appropriate Federal banking\nagencies and Federal functional regulators shall, jointly, submit to\nCongress a report on efforts and recommendations related to general\nfinancial fraud, pig butchering, elder financial fraud, and scams.\n\nSEC. 5. REPORT ON THE STATE OF SCAMS IN THE UNITED STATES.\n\n(a) In General.--Not later than 2 years after the date of enactment\nof this Act, the Secretary of the Treasury and the Director of the\nFinancial Crimes Enforcement Network, in consultation with the Attorney\nGeneral, the Secretary of Homeland Security, and the appropriate\nFederal banking agencies and Federal functional regulators, shall\nsubmit a report to Congress on the state of scams in the United States\nthat--\n(1) estimates--\n(A) the number of financial fraud, pig butchering,\nelder financial fraud, and scams committed against\nAmerican consumers each year, including--\n(i) attempted scams, including through\nsocial media, online dating services, email,\nimpersonation of financial institutions and\nnonbank financial institutions; and\n(ii) successful scams, including through\nsocial media, online dating services, email,\nimpersonation of financial institutions and\nnonbank financial institutions;\n(B) the number of consumers each year that lose\nmoney to 1 or more scams;\n(C) the dollar amount of consumer losses to scams\neach year;\n(D) the percentage of scams each year that can be\nattributed to--\n(i) overseas actors; and\n(ii) organized crime;\n(E) the number of attempted scams each year that\ninvolve the impersonation of phone numbers associated\nwith financial institutions and nonbank financial\ninstitutions; and\n(F) an estimate of the number of synthetic\nidentities impersonating American consumers each year;\n(2) provides an overview of the Federal civil and criminal\nenforcement actions brought against the recipients of the\nproceeds of financial fraud, pig butchering, elder financial\nfraud, and scams during the period covered by the report that\nincludes--\n(A) the number of such enforcement actions;\n(B) an evaluation of the effectiveness of such\nenforcement actions;\n(C) an identification of the types of claims\nbrought against the recipients of the proceeds of\nfinancial fraud, pig butchering, elder financial fraud,\nand scams;\n(D) an identification of the types of penalties\nimposed through such enforcement actions;\n(E) an identification of the types of relief\nobtained through such enforcement actions; and\n(F) the number of such enforcement actions that are\nconnected to a Suspicious Activity Report; and\n(3) identifies amounts made available and amounts expended\nto address financial fraud, pig butchering, elder financial\nfraud, and scams during the period covered by the report by--\n(A) the Bureau of Consumer Financial Protection;\n(B) the Department of Justice;\n(C) the Federal Bureau of Investigation;\n(D) the Federal Communications Commission;\n(E) the Board of Governors of the Federal Reserve\nBoard;\n(F) the Federal Trade Commission;\n(G) the Financial Crimes Enforcement Network;\n(H) the Securities and Exchange Commission; and\n(I) the Social Security Administration.\n(b) Solicitation of Public Comment.--In carrying out the report\nrequired under subsection (a), the Secretary of the Treasury shall\nsolicit comments from consumers, social media companies, email\nproviders, telecommunications companies, financial institutions, and\nnonbank financial institutions.\n\nSEC. 6. REPORT TO CONGRESS.\n\nEach Federal agency that provides eligible Federal grant funds that\nare used for a purpose specified under section 3(a) shall issue an\nannual report to the Committee on Banking, Housing, and Urban Affairs\nof the Senate, the Committee on Financial Services of the House of\nRepresentatives, the Committee on the Judiciary of the Senate, and the\nCommittee on the Judiciary of the House of Representatives containing\nthe information received from law enforcement agencies under section\n3(b).\n\nSEC. 7.
