SHORT TITLE.\n\nThis Act may be cited as the ``Understanding Cybersecurity of\nMobile Networks Act''.\n\nSEC. 2. REPORT ON CYBERSECURITY OF MOBILE SERVICE NETWORKS.\n\n(a) In General.--Not later than 1 year after the date of the\nenactment of this Act, the Assistant Secretary, in consultation with\nthe Department of Homeland Security, shall submit to the Committee on\nEnergy and Commerce of the House of Representatives and the Committee\non Commerce, Science, and Transportation of the Senate a report\nexamining the cybersecurity of mobile service networks and the\nvulnerability of such networks and mobile devices to cyberattacks and\nsurveillance conducted by adversaries.\n(b) Matters To Be Included.--The report required by subsection (a)\nshall include the following:\n(1) An assessment of the degree to which providers of\nmobile service have addressed, are addressing, or have not\naddressed cybersecurity vulnerabilities (including\nvulnerabilities the exploitation of which could lead to\nsurveillance conducted by adversaries) identified by academic\nand independent researchers, multistakeholder standards and\ntechnical organizations, industry experts, and Federal\nagencies, including in relevant reports of--\n(A) the National Telecommunications and Information\nAdministration;\n(B) the National Institute of Standards and\nTechnology; and\n(C) the Department of Homeland Security,\nincluding--\n(i) the Cybersecurity and Infrastructure\nSecurity Agency; and\n(ii) the Science and Technology\nDirectorate.\n(2) A discussion of--\n(A) the degree to which customers (including\nconsumers, companies, and government agencies) consider\ncybersecurity as a factor when considering the purchase\nof mobile service and mobile devices; and\n(B) the commercial availability of tools,\nframeworks, best practices, and other resources for\nenabling such customers to evaluate cybersecurity risk\nand price tradeoffs.\n(3) A discussion of the degree to which providers of mobile\nservice have implemented cybersecurity best practices and risk\nassessment frameworks.\n(4) An estimate and discussion of the prevalence and\nefficacy of encryption and authentication algorithms and\ntechniques used in each of the following:\n(A) Mobile service.\n(B) Mobile communications equipment or services.\n(C) Commonly used mobile phones and other mobile\ndevices.\n(D) Commonly used mobile operating systems and\ncommunications software and applications.\n(5) A discussion of the barriers for providers of mobile\nservice to adopt more efficacious encryption and authentication\nalgorithms and techniques and to prohibit the use of older\nencryption and authentication algorithms and techniques with\nestablished vulnerabilities in mobile service, mobile\ncommunications equipment or services, and mobile phones and\nother mobile devices.\n(6) An estimate and discussion of the prevalence, usage,\nand availability of technologies that authenticate legitimate\nmobile service and mobile communications equipment or services\nto which mobile phones and other mobile devices are connected.\n(7) An estimate and discussion of the prevalence, costs,\ncommercial availability, and usage by adversaries in the United\nStates of cell site simulators (often known as international\nmobile subscriber identity catchers) and other mobile service\nsurveillance and interception technologies.\n(c) Consultation.--In preparing the report required by subsection\n(a), the Assistant Secretary shall, to the degree practicable, consult\nwith--\n(1) the Federal Communications Commission;\n(2) the National Institute of Standards and Technology;\n(3) the intelligence community;\n(4) the Cybersecurity and Infrastructure Security Agency of\nthe Department of Homeland Security;\n(5) the Science and Technology Directorate of the\nDepartment of Homeland Security;\n(6) academic and independent researchers with expertise in\nprivacy, encryption, cybersecurity, and network threats;\n(7) participants in multistakeholder standards and\ntechnical organizations (including the 3rd Generation\nPartnership Project and the Internet Engineering Task Force);\n(8) international stakeholders, in coordination with the\nDepartment of State as appropriate;\n(9) providers of mobile service, including small providers\n(or the representatives of such providers) and rural providers\n(or the representatives of such providers);\n(10) manufacturers, operators, and providers of mobile\ncommunications equipment or services and mobile phones and\nother mobile devices;\n(11) developers of mobile operating systems and\ncommunications software and applications; and\n(12) other experts that the Assistant Secretary considers\nappropriate.\n(d) Scope of Report.--The Assistant Secretary shall--\n(1) limit the report required by subsection (a) to mobile\nservice networks;\n(2) exclude consideration of 5G protocols and networks in\nthe report required by subsection (a);\n(3) limit the assessment required by subsection (b)(1) to\nvulnerabilities that have been shown to be--\n(A) exploited in non-laboratory settings; or\n(B) feasibly and practicably exploitable in real-\nworld conditions; and\n(4) consider in the report required by subsection (a)\nvulnerabilities that have been effectively mitigated by\nmanufacturers of mobile phones and other mobile devices.\n(e) Form of Report.--\n(1) Classified information.--The report required by\nsubsection (a) shall be produced in unclassified form but may\ncontain a classified annex.\n(2) Potentially exploitable unclassified information.--The\nAssistant Secretary shall redact potentially exploitable\nunclassified information from the report required by subsection\n(a) but shall provide an unredacted form of the report to the\ncommittees described in such subsection.\n(f) Definitions.--In this section:\n(1) Adversary.--The term ``adversary'' includes--\n(A) any unauthorized hacker or other intruder into\na mobile service network; and\n(B) any foreign government or foreign nongovernment\nperson engaged in a long-term pattern or serious\ninstances of conduct significantly adverse to the\nnational security of the United States or security and\nsafety of United States persons.\n(2) Assistant secretary.--The term ``Assistant Secretary''\nmeans the Assistant Secretary of Commerce for Communications\nand Information.\n(3) Entity.--The term ``entity'' means a partnership,\nassociation, trust, joint venture, corporation, group,\nsubgroup, or other organization.\n(4) Intelligence community.--The term ``intelligence\ncommunity'' has the meaning given that term in section 3 of the\nNational Security Act of 1947 (50 U.S.C. 3003).\n(5) Mobile communications equipment or service.--The term\n``mobile communications equipment or service'' means any\nequipment or service that is essential to the provision of\nmobile service.\n(6) Mobile service.--The term ``mobile service'' means, to\nthe extent provided to United States customers, either or both\nof the following services:\n(A) Commercial mobile service (as defined in\nsection 332(d) of the Communications Act of 1934 (47\nU.S.C. 332(d))).\n(B) Commercial mobile data service (as defined in\nsection 6001 of the Middle Class Tax Relief and Job\nCreation Act of 2012 (47 U.S.C. 1401)).\n(7) Person.--The term ``person'' means an individual or\nentity.\n(8) United states person.--The term ``United States\nperson'' means--\n(A) an individual who is a United States citizen or\nan alien lawfully admitted for permanent residence to\nthe United States;\n(B) an entity organized under the laws of the\nUnited States or any jurisdiction within the United\nStates, including a foreign branch of such an entity;\nor\n(C) any person in the United States.\n\nPassed the House of Representatives July 14, 2025.\n\nAttest:\n\nKEVIN F.
