SHORT TITLE.\n\nThis Act may be cited as the ``Childhood Diabetes Reduction Act of\n2025''.\n\nTITLE I--DEPARTMENT OF HEALTH AND HUMAN SERVICES\n\nSEC. 101. HEALTH WARNING LABELING OF FOODS; RESTRICTION ON CERTAIN\nADVERTISEMENTS DIRECTED AT CHILDREN.\n\n(a) Health Warning Labeling.--Section 403 of the Federal Food,\nDrug, and Cosmetic Act (21 U.S.C. 343) is amended--\n(1) by adding at the end the following:\n``(z)(1) If it is a sugar-sweetened beverage intended for human\nconsumption and is offered for sale, unless its label includes the\nfollowing statement: `Food and Drug Administration Warning: Drinking\nbeverages with added sugar can contribute to obesity, type 2 diabetes,\nand tooth decay. Not recommended for children.', and such statement\nis--\n``(A) enclosed by a rectangular border in bold type and\nreadily legible under ordinary conditions alongside an icon\ncomprised of an exclamation point contained within a triangle;\nand\n``(B) prominently displayed on the front, or the principal\ndisplay, of the container, using not less than 5 percent of the\narea of the front, or the principal display, of the container,\nand, as applicable, on 2 sides of any multi-pack packaging or\non the exterior of any vending machine or self-service machine\nfrom which the beverage is available.\n``(2) If it is a food, including a beverage, containing any non-\nsugar sweetener intended for human consumption and is offered for sale,\nunless its label includes the following statement: `Food and Drug\nAdministration Warning: Contains non-sugar sweeteners. Not recommended\nfor children.', and such statement is--\n``(A) enclosed by a rectangular border in bold type and\nreadily legible under ordinary conditions alongside an icon\ncomprised of an exclamation point contained within a triangle;\nand\n``(B) prominently displayed on the front, or the principal\ndisplay, of the container, using not less than 5 percent of the\narea of the front, or the principal display, of the container,\nand, as applicable, on 2 sides of any multi-pack packaging or\non the exterior of any vending machine or self-service machine\nfrom which the food is available.\n``(3) If it is an ultra-processed food, including a beverage,\nintended for human consumption and is offered for sale, unless its\nlabel includes the following statement: `Food and Drug Administration\nWarning: Consuming ultra-processed foods and drinks can cause weight\ngain, which increases the risk of obesity and type 2 diabetes.', and\nsuch statement is--\n``(A) enclosed by a rectangular border in bold type and\nreadily legible under ordinary conditions alongside an icon\ncomprised of an exclamation point contained within a triangle;\nand\n``(B) prominently displayed on the front, or the principal\ndisplay, of the container, using not less than 5 percent of the\narea of the front, or the principal display, of the container,\nand, as applicable, on 2 sides of any multi-pack packaging or\non the exterior of any vending machine or self-service machine\nfrom which the food is available.\n``(4) If it is a food, including a beverage, intended for human\nconsumption and is offered for sale, and such food contains a nutrient\nof concern, such as added sugar, saturated fat, or sodium, or any other\nnutrient of concern, as the Secretary determines appropriate, at a\nlevel that increases, for individuals in the general population, the\nrisk of disease or a health-related condition, as defined by the\nSecretary, unless its label includes the following statement for each\nnutrient of concern: `High in', followed by the specific nutrient of\nconcern, and such statement is--\n``(A) enclosed by an octagon border in bold type and\nreadily legible under ordinary conditions; and\n``(B) prominently displayed on the front, or the principal\ndisplay, of the container, using not less than 5 percent of the\narea of the front, or the principal display, of the container,\nand, as applicable, on 2 sides of any multi-pack packaging or\non the exterior of any vending machine or self-service machine\nfrom which the food is available.\n``(5) The Secretary shall promulgate regulations to apply the\nlabeling requirements under subparagraphs (1), (2), (3), and (4) with\nrespect to food offered for sale by online retailers.\n``(6) For purposes of this paragraph--\n``(A) the term `non-sugar sweetener'--\n``(i) means any synthetic, naturally-occurring, or\nmodified non-nutritive sweetener that is not classified\nas sugar and is used as an ingredient in manufactured\nfood, or sold on its own to be added to food; and\n``(ii) includes acesulfame K, aspartame, advantame,\ncyclamates, monk fruit, neotame, saccharin, sucralose,\nstevia, and stevia derivatives;\n``(B) the term `sugar-sweetened beverage'--\n``(i) means any beverage intended for human\nconsumption to which one or more caloric sweeteners has\nbeen added and that contains 25 or more calories per 12\nfluid ounces of beverage; and\n``(ii) includes drinks and beverages commonly\nreferred to as `soda', `pop', `cola', `soft drinks',\n`sports drinks', `energy drinks', `slushies',\n`sweetened ice tea', `fruit juice', or any other drinks\nand beverage; and\n``(iii) does not include--\n``(I) infant formula or oral rehydration\nfluids for children;\n``(II) any beverage for medical use;\n``(III) any beverage designed as\nsupplemental, meal replacement, or sole-source\nnutrition that includes proteins,\ncarbohydrates, and multiple vitamins and\nminerals;\n``(IV) any milk product;\n``(V) 100 percent natural fruit or\nvegetable juice with no added caloric or non-\nsugar sweetener; or\n``(VI) any alcoholic beverage; and\n``(C) the term `ultra-processed food'--\n``(i) for the period before the effective date of\nthe regulations under subclause (ii), means a food,\nincluding a beverage, containing one or more industrial\ningredients, including surface-active agents,\nstabilizers and thickeners, propellants, aerating\nagents and gases, color and coloring adjuncts,\nemulsifiers and emulsifier salts, flavoring agents and\nadjuvants, flavor enhancers, surface-finishing, non-\nsugar sweeteners, and other ingredients, as the\nSecretary determines appropriate; and\n``(ii) has the meaning given such term in\nregulations promulgated by the Secretary, not later\nthan 1 year after the National Academies of Science,\nEngineering, and Medicine issues a report pursuant to\nsection 101(c) of the Childhood Diabetes Reduction Act\nof 2025, taking into consideration the recommendations\nincluded in such report, for the period beginning on\nthe effective date of such regulations.''; and\n(2) in paragraph (r)--\n(A) in subparagraph (2)(A)(vi), by inserting ``,\nincluding if the Secretary determines that the food is\nhigh in added sugar, saturated fat, sodium, or any\nother nutrient of concern (as determined by the\nSecretary pursuant to paragraph (z)(4)), or if the food\ncontains non-sugar sweetener or is an ultra-processed\nfood (as defined in paragraph (z)(6)(C))'' before the\nperiod at the end; and\n(B) in subparagraph (3)(A)--\n(i) in subclause (i), by striking ``, and''\nand inserting a semicolon;\n(ii) in subclause (ii), by striking the\nperiod and inserting ``; and''; and\n(iii) by adding at the end the following:\n``(iii) if the food is not required to include a nutrition\nwarning label under subparagraph (1), (2), (3), or (4) of\nparagraph (z).''.\n(b) Advertising.--Section 301 of the Federal Food, Drug, and\nCosmetic Act (21 U.S.C. 331) is amended by adding at the end the\nfollowing:\n``(jjj)(1) Marketing or advertising a food for which labeling is\nrequired under section 403(z), in a manner that reasonably appears to\nbe directed at children.\n``(2) In determining whether any marketing or advertising\nreasonably appears to be directed to children for purposes of\nsubparagraph (1), the Secretary shall consider the totality of the\ncircumstances, including whether such marketing or advertising uses\nthemes or promotional strategies for food described in section 403(z)\nthat appeal to children, such as the use of fun or fantasy themes,\nathletes and celebrities, cross-promotions using fictional characters,\ncartoon characters, social media influencers, animation, children's\nmusic, actors, or situations representing children's daily life, or\nfree gifts or toys, contests, interactive games, or mobile or computer\napplications.''.\n(c) NASEM Review.--The Secretary of Health and Human Services\n(referred to in this subsection as the ``Secretary'') shall seek to\nenter into a contract with the National Academies of Science,\nEngineering, and Medicine (referred to in this subsection as the\n``National Academies'') under which the National Academies--\n(1) convenes a committee of experts in the field of\nnutrition science to review the science of ultra-processed food\n(as defined in paragraph (z)(6)(C) of section 403 of the\nFederal Food, Drug, and Cosmetic Act (21 U.S.C. 343)), as added\nby subsection (a);\n(2) develops recommendations for defining the term ``ultra-\nprocessed food'' for purposes of paragraph (z)(6)(C)(ii) of\nsection 403 of the Federal Food, Drug, and Cosmetic Act, as\nadded by subsection (a); and\n(3) not later than 1 year after the date of enactment of\nthis Act, submits to the Secretary a report that includes the\nrecommendations developed under paragraph (2).\n(d) Authorization of Appropriations.--There is authorized to be\nappropriated to the Secretary of Health and Human Services $5,000,000\nfor each of fiscal years 2026 through 2030 for purposes of promulgating\nregulations and carrying out enforcement activities with respect to the\nlabeling requirements under the amendments made by subsections (a) and\n(b).\n\nSEC. 102. NATIONAL INSTITUTES OF HEALTH RESEARCH ON NUTRITION SCIENCE.\n\nPart A of title IV of the Public Health Service Act (42 U.S.C. 281\net seq.) is amended by adding at the end the following:\n\n``SEC. 404P. RESEARCH AND COLLABORATION ON NUTRITION SCIENCE.\n\n``(a) In General.--The Director of NIH shall expand, intensify, and\ncoordinate programs for the conduct and support of research with\nrespect to nutrition science, including research on--\n``(1) the health effects of ultra-processed foods on\nconsumers;\n``(2) the specific food and beverage ingredients,\nadditives, sweeteners, and chemicals within ultra-processed\nfoods that may be harmful to health;\n``(3) the safety profile of food and beverage ingredients,\nadditives, sweeteners, and chemicals that have been self-\naffirmed by food and beverage manufacturers as generally\nrecognized as safe without review of such status by the Food\nand Drug Administration; and\n``(4) the formulation of ultra-processed foods to have\nhyper-palatable qualities and association with addiction.\n``(b) Meetings on Nutrition.--\n``(1) In general.--Not later than 1 year after the date of\nenactment of the Childhood Diabetes Reduction Act of 2025, and\nevery 5 years thereafter, the Director of NIH, in coordination\nwith the Commissioner of Food and Drugs and the heads of other\nagencies, as appropriate, shall convene a public meeting for\nthe purpose of discussing research efforts aimed at improving\nnutrition and reducing the incidence of diet-related chronic\ndisease, with the goal of informing Federal policy.\n``(2) Participants.--\n``(A) In general.--Each meeting under paragraph (1)\nshall involve a diverse group of stakeholders,\nincluding food scientists and researchers, registered\ndietitians and nutritionists, clinicians specializing\nin nutrition-related diseases, Federal stakeholders,\nand nongovernmental organizations focused on nutrition\nand health.\n``(B) Consideration.--In selecting stakeholders\ndescribed in subparagraph (A) for participation for\neach meeting under paragraph (1), the Director of NIH\nshall ensure that stakeholders who have no financial\naffiliation with manufacturers of ultra-processed food\nmake up the majority of participants.\n``(3) Topics.--Each meeting under paragraph (1) shall\ninclude discussion of--\n``(A) current research findings related to\nnutrition and chronic disease, including the impact of\nfood labeling requirements under section 403(z) of the\nFederal Food, Drug, and Cosmetic Act;\n``(B) any gaps in such research and priorities for\nfuture research;\n``(C) evidence-based practices for improving\nnutrition and innovative approaches to prevent and\nmanage chronic conditions through dietary innovations;\nand\n``(D) such other topics as the Director of NIH\ndetermines appropriate.\n``(4) Report to congress.--The Director NIH, in\ncoordination with the Commissioner of Food and Drugs, shall\nsubmit a report on each meeting under paragraph (1) to the\nCommittee on Health, Education, Labor, and Pensions of the\nSenate and the Committee on Energy and Commerce of the House of\nRepresentatives, and shall make each such report publicly\navailable on the website of the National Institutes of Health.\n``(c) Definition.--In this section, the term `ultra-processed food'\nhas the meaning given such term in section 403(z)(6) of the Federal\nFood, Drug, and Cosmetic Act.\n``(d) Authorization of Appropriations.--For the purpose of carrying\nout this section, there are authorized to be appropriated $60,000,000\nfor each fiscal years 2026 through 2030.''.\n\nSEC. 103. NUTRITION AND PHYSICAL ACTIVITY PUBLIC EDUCATION CAMPAIGN.\n\nTitle III of the Public Health Service Act (42 U.S.C. 241 et seq.)\nis amended by striking section 399Y and inserting the following:\n\n``SEC. 399Y. NUTRITION AND PHYSICAL ACTIVITY PUBLIC EDUCATION CAMPAIGN.\n\n``(a) In General.--The Secretary, acting through the Director of\nthe Centers for Disease Control and Prevention, and in collaboration\nwith national, State, Tribal, and local partners, physical activity\norganizations, nutrition experts, physical activity experts, health\nprofessional organizations, and other organizations, as appropriate,\nshall develop a national public campaign to educate the public,\nincluding adults, children, and caregivers, concerning--\n``(1) how to read and understand the nutrient warning\nlabels required under subparagraphs (1) through (4) of section\n403(z) of the Federal Food, Drug, and Cosmetic Act;\n``(2) the health risks associated with obesity, inactivity,\nand poor nutrition, including consumption of foods described in\nsubparagraphs (1) through (4) of section 403(z) of the Federal\nFood, Drug, and Cosmetic Act;\n``(3) ways to incorporate physical activity into daily\nliving;\n``(4) ways to support a healthy lifestyle and reduce the\nrisk of chronic illness, including obesity;\n``(5) the benefits of good nutrition; and\n``(6) strategies to improve eating and drinking habits,\nsuch as identifying and selecting healthier food choices and\nreducing consumption of added sugars, saturated fat, and\nsodium.\n``(b) Authorization of Appropriations.--There are authorized to be\nappropriated to carry out this section $10,000,000 for each of the\nfiscal years 2026 through 2030.''.\n\nTITLE II--FEDERAL TRADE COMMISSION\n\nSEC. 201. DEFINITIONS.\n\nIn this title:\n(1) Child.--The term ``child'' means an individual who is\nunder the age of 13.\n(2) Child-directed advertising.--The term ``child-directed\nadvertising'' means any advertisement--\n(A) that uses themes or promotional strategies that\nappeal to children, which may include the use of--\n(i) fun or fantasy themes, cartoon\ncharacters, social media influencers,\nanimation, endorsements by celebrities and\nathletes, cross-promotions using fictional\ncharacters, children's music, actors, or\nsituations representing children's daily life;\nor\n(ii) free gifts or toys, contests,\ninteractive games, or mobile or computer\napplications; or\n(B) in media for which children comprise at least\n30 percent of the audience, as determined by the\nCommission, that is displayed using--\n(i) traditional measured media, such as\ntelevision, radio, and printed media; or\n(ii) electronic media, content created by\ninfluencers, online videos, company-sponsored\nwebsites, social media, movies, and video\ngames.\n(3) Commission.--The term ``Commission'' means the Federal\nTrade Commission.\n(4) Junk food.--The term ``junk food'' means products with\nlabeling requirements described in subparagraph (1), (2), (3),\nor (4) of paragraph (z) of section 403 of the Federal Food,\nDrug, and Cosmetic Act (21 U.S.C. 343), as added by section\n101(a) of this Act.\n\nSEC. 202. RESTRICTIONS ON ADVERTISEMENTS FOR JUNK FOOD DIRECTED AT\nCHILDREN; REQUIRED DISCLOSURE OF ANY HEALTH AND NUTRIENT\nWARNING LABEL IN ADVERTISEMENTS.\n\n(a) Marketing or Advertising Junk Food to Children.--\n(1) In general.--It shall be unlawful for any person to\nmarket or advertise, or produce or distribute any advertisement\nor marketing material for, junk food by using child-directed\nadvertising.\n(2) Considerations.--In determining whether any marketing\nor advertising uses child-directed advertising for purposes of\nsubparagraph (A), the Commission shall consider the totality of\nthe circumstances.\n(b) Required Disclosure.--It shall be unlawful for any person to\nmarket or advertise, or produce or distribute any advertisement or\nmarketing material for, junk food without including in such\nadvertisement or marketing material the relevant mandatory health or\nnutrient warning label or notice described in section 403(z) of the\nFederal Food, Drug, and Cosmetic Act (21 U.S.C. 343(z)).\n(c) Effective Date.--The prohibitions established in this section\nshall take effect on the date that is 1 year after the date of\nenactment of this Act.\n(d) Enforcement by the Commission.--\n(1) Unfair or deceptive act or practice.--A violation of\nthis section or a regulation promulgated under this section\nshall be treated as a violation of a rule defining an unfair or\ndeceptive act or practice under section 18(a)(1)(B) of the\nFederal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)).\n(2) Powers of the commission.--\n(A) In general.--Except as provided in subparagraph\n(C), the Commission shall enforce this section in the\nsame manner, by the same means, and with the same\njurisdiction, powers, and duties as though all\napplicable terms and provisions of the Federal Trade\nCommission Act (15 U.S.C. 41 et seq.) were incorporated\ninto and made a part of this section.\n(B) Privileges and immunities.--Except as provided\nin subparagraph (C), any person who violates this\nsection or a regulation promulgated under this section\nshall be subject to the penalties and entitled to the\nprivileges and immunities provided in the Federal Trade\nCommission Act (15 U.S.C. 41 et seq.).\n(C) Common carriers.--Notwithstanding section 4,\n5(a)(2), or 6 of the Federal Trade Commission Act (15\nU.S.C. 44, 45(a)(2), 46) or any jurisdictional\nlimitation of the Commission, the Commission shall also\nenforce this Act, in the same manner provided in\nsubparagraphs (A) and (B), with respect to common\ncarriers subject to the Communications Act of 1934 (47\nU.S.C. 151 et seq.) and Acts amendatory thereof and\nsupplementary thereto.\n(D) Authority preserved.--Nothing in this section\nshall be construed to limit the authority of the\nCommission under any other provision of law.\n(E) Rulemaking.--The Commission shall promulgate in\naccordance with section 553 of title 5, United States\nCode, such rules as may be necessary to carry out this\nsection.\n\nSEC. 203.
