SHORT TITLE.\n\nThis Act may be cited as the ``Farm and Food Cybersecurity Act of\n2025''.\n\nSEC. 2. DEFINITIONS.\n\nIn this Act:\n(1) Agriculture and food critical infrastructure sector.--\nThe term ``agriculture and food critical infrastructure\nsector'' means--\n(A) any activity relating to the production,\nprocessing, distribution, storage, transportation,\nconsumption, or disposal of agricultural or food\nproducts; and\n(B) any entity involved in an activity described in\nsubparagraph (A), including a farmer, rancher,\nprocessor, manufacturer, distributor, retailer,\nconsumer, and regulator.\n(2) Cybersecurity threat; defensive measure; incident;\nsecurity vulnerability.--The terms ``cybersecurity threat'',\n``defensive measure'', ``incident'', and ``security\nvulnerability'' have the meanings given those terms in section\n2200 of the Homeland Security Act of 2002 (6 U.S.C. 650).\n(3) Secretary.--The term ``Secretary'' means the Secretary\nof Agriculture.\n(4) Sector-specific isac.--The term ``sector-specific\nISAC'' means the Food and Agriculture-Information Sharing and\nAnalysis Center.\n\nSEC. 3. ASSESSMENT OF CYBERSECURITY THREATS AND SECURITY\nVULNERABILITIES IN THE AGRICULTURE AND FOOD CRITICAL\nINFRASTRUCTURE SECTOR.\n\n(a) Risk Assessment.--The Secretary shall conduct a risk\nassessment, on a biennial basis, on the cybersecurity threats to, and\nsecurity vulnerabilities in, the agriculture and food critical\ninfrastructure sector, including--\n(1) the nature and extent of cyberattacks and incidents\nthat affect the agriculture and food critical infrastructure\nsector;\n(2) the potential impacts of a cyberattack or incident on\nthe safety, security, and availability of food products, as\nwell as on the economy, public health, and national security of\nthe United States;\n(3) the current capability and readiness of the Federal\nGovernment, State and local governments, and private sector\nentities to prevent, detect, mitigate, respond to, and recover\nfrom cyberattacks and incidents described in paragraph (2);\n(4) the existing policies, standards, guidelines, best\npractices, and initiatives applicable to the agriculture and\nfood critical infrastructure sector to enhance defensive\nmeasures in that sector;\n(5) the gaps, challenges, barriers, or opportunities for\nimproving defensive measures in the agriculture and food\ncritical infrastructure sector; and\n(6) any recommendations for Federal legislative or\nadministrative actions to address the cybersecurity threats to,\nand security vulnerabilities in, the agriculture and food\ncritical infrastructure sector, including intrusive,\nduplicative, or conflicting regulatory requirements that may\ndivert attention and resources from operational risk management\nto a compliance regime that impedes actual security efforts.\n(b) Private Sector Participation.--In conducting a risk assessment\nunder subsection (a), the Secretary shall consult with appropriate\nentities in the private sector, including--\n(1) the sector-specific ISAC; and\n(2) the appropriate sector coordinating council.\n(c) Biennial Report.--Not later than 1 year after the date of\nenactment of this Act, and every 2 years thereafter, the Secretary\nshall submit a report on each risk assessment conducted under\nsubsection (a) to--\n(1) the Committee on Agriculture, Nutrition, and Forestry\nof the Senate;\n(2) the Committee on Homeland Security and Governmental\nAffairs of the Senate;\n(3) the Committee on Agriculture of the House of\nRepresentatives; and\n(4) the Committee on Homeland Security of the House of\nRepresentatives.\n\nSEC. 4. FOOD SECURITY AND CYBER RESILIENCE SIMULATION EXERCISE.\n\n(a) Establishment.--The Secretary, in coordination with the\nSecretary of Homeland Security, the Secretary of Health and Human\nServices, the Director of National Intelligence, and the heads of other\nrelevant Federal agencies, shall conduct, over a 5-year period, an\nannual cross-sector crisis simulation exercise relating to a food-\nrelated emergency or disruption (referred to in this section as an\n``exercise'').\n(b) Purposes.--The purposes of each exercise are--\n(1) to assess the preparedness and response capabilities of\nFederal, State, Tribal, local, and territorial governments and\nprivate sector entities in the event of a food-related\nemergency or disruption;\n(2) to identify and address gaps and vulnerabilities in the\nfood supply chain and critical infrastructure;\n(3) to enhance coordination and information sharing among\nstakeholders involved in food production, processing,\ndistribution, and consumption;\n(4) to evaluate the effectiveness and efficiency of\nexisting policies, programs, and resources relating to food\nsecurity and resilience;\n(5) to develop and disseminate best practices and\nrecommendations for improving food security and resilience; and\n(6) to identify key stakeholders and categories that were\nmissing from the exercise to ensure the inclusion of those\nstakeholders and categories in future exercises.\n(c) Design.--Each exercise shall--\n(1) involve a realistic and plausible scenario that\nsimulates a food-related emergency or disruption affecting\nmultiple sectors and jurisdictions;\n(2) incorporate input from experts and stakeholders from\nvarious disciplines and sectors, including agriculture, public\nhealth, nutrition, emergency management, transportation,\nenergy, water, communications, related equipment suppliers and\nmanufacturers, and cybersecurity, including related academia\nand private sector information security researchers and\npractitioners, including the sector-specific ISAC;\n(3) use a variety of methods and tools, such as tabletop\nexercises, workshops, seminars, games, drills, or full-scale\nexercises; and\n(4) include participants from Federal, State, Tribal,\nlocal, and territorial governments and private sector entities\n(including the sector-specific ISAC and appropriate sector\ncoordinating councils) that have roles and responsibilities\nrelating to food security and resilience.\n(d) Private Sector Participation.--In conducting an exercise under\nsubsection (a), the Secretary shall consult with appropriate entities\nin the private sector, including--\n(1) the sector-specific ISAC; and\n(2) the appropriate sector coordinating councils.\n(e) Feedback; Report.--After each exercise, the Secretary, in\nconsultation with the heads of the Federal agencies described in\nsubsection (a), shall--\n(1) provide feedback to, and an evaluation of, the\nparticipants in that exercise on their performance and\noutcomes;
