SHORT TITLE.\n\nThis Act may be cited as the ``Legislative Branch Agencies\nClarification Act''.\n\nSEC. 2. LIBRARIAN OF CONGRESS.\n\n(a) In General.--The Librarian of Congress Succession Modernization\nAct of 2015 (Public Law 114-86; 129 Stat. 675), is amended--\n(1) by redesignating section 3 as section 5;\n(2) by redesignating section 2 as section 3;\n(3) by inserting after section 1 the following:\n\n``SEC. 2. DEFINITIONS.\n\n``In this Act:\n``(1) Commission.--The term `commission' means a\ncongressional commission consisting of the oversight committee\nleadership and the House and Senate leadership.\n``(2) Deputy librarian.--The term `Deputy Librarian' means\nthe Deputy Librarian of Congress.\n``(3) House and senate leadership.--The term `House and\nSenate leadership' means the Speaker of the House of\nRepresentatives, the majority leader of the Senate, the\nminority leader of the House of Representatives, and the\nminority leader of the Senate.\n``(4) Librarian.--The term `Librarian' means the Librarian\nof Congress.\n``(5) Oversight committee leadership.--The term `oversight\ncommittee leadership' means the chair and ranking minority\nmember of the Committee on House Administration of the House of\nRepresentatives and the chairman and ranking minority member of\nthe Committee on Rules and Administration of the Senate.''; and\n(4) in section 3, as so redesignated--\n(A) by striking subsection (a) and inserting the\nfollowing:\n``(a) Appointment.--\n``(1) Commission.--The Librarian shall be appointed by the\ncommission in accordance with the procedures specified in\nparagraph (2), without regard to political affiliation, and\nsolely on the basis of fitness to perform the duties of the\noffice.\n``(2) Appointment procedures.--\n``(A) Recommendation of 3 individuals.--If there is\na vacancy in the position of Librarian, the oversight\ncommittee leadership shall jointly recommend 3\nindividuals for appointment to the vacant office.\n``(B) Selection by leaders.--The Librarian shall be\nappointed from among the 3 individuals recommended\nunder subparagraph (A) upon a majority vote of the\nHouse and Senate leadership.'';\n(B) in subsection (b), by striking ``of Congress'';\n(C) in subsection (c), by striking ``of Congress,\nby and with the advice and consent of the Senate,'';\nand\n(D) by striking subsection (d) and inserting the\nfollowing:\n``(d) Removal.--The Librarian may be removed from office at any\ntime upon a majority vote of the House and Senate leadership.''.\n(b) Pay.--Section 904 of the Supplemental Appropriations Act, 1983\n(2 U.S.C. 136a-2) is amended--\n(1) by inserting ``(a)'' before ``Notwithstanding''; and\n(2) by adding at the end the following:\n``(b) The Librarian of Congress shall not be considered to serve\nunder a political appointment for purposes of section 747 of the\nFinancial Services and General Government Appropriations Act, 2024\n(division B of Public Law 118-47; 138 Stat. 585), or any other\nsubsequently enacted similar provision of law.''.\n\nSEC. 3. DEPUTY LIBRARIAN OF CONGRESS.\n\nThe Librarian of Congress Succession Modernization Act of 2015\n(Public Law 114-86; 129 Stat. 675), is amended by inserting after\nsection 3, as so redesignated, the following:\n\n``SEC. 4. DEPUTY LIBRARIAN OF CONGRESS.\n\n``(a) Establishment of Deputy Librarian.--\n``(1) In general.--The Librarian shall appoint a suitable\nindividual to be the Deputy Librarian of Congress.\n``(2) Duties.--The Librarian may delegate to the Deputy\nLibrarian such duties as the Librarian determines are necessary\nor appropriate.\n``(b) Deadline.--The Librarian shall appoint a Deputy Librarian\nunder subsection (a)(1) not later than 120 days after--\n``(1) the date on which the Librarian is appointed under\nsection 3, if there is no Deputy Librarian on the date of the\nappointment; or\n``(2) the date on which a vacancy arises in the office of\nthe Deputy Librarian.\n``(c) Failure to Appoint.--If the Librarian does not appoint a\nDeputy Librarian on or before the applicable date specified in\nsubsection (b)--\n``(1) the oversight committee leadership shall jointly\nrecommend an individual for appointment to the vacant office;\nand\n``(2) upon a majority vote of the House and Senate\nleadership, the individual recommended under paragraph (1)\nshall be appointed as the Deputy Librarian.\n``(d) Notification.--If the position of Deputy Librarian becomes\nvacant, the Librarian shall immediately notify the members of the\ncommission.\n``(e) Service as Acting Librarian.--\n``(1) In general.--The Deputy Librarian shall act as\nLibrarian if the Librarian is absent or disabled or there is no\nLibrarian.\n``(2) Absence, disability, or vacancy in office of deputy\nlibrarian.--\n``(A) In general.--For purposes of paragraph (1),\nif the Deputy Librarian is also absent or disabled or\nthere is no Deputy Librarian--\n``(i) the oversight committee leadership\nshall jointly recommend an individual to be\ndesignated to serve as acting Librarian; and\n``(ii) upon a majority vote of the members\nof the House and Senate leadership, the\nindividual recommended under clause (i) shall\nbe designated to serve as acting Librarian.\n``(B) Period of appointment.--An individual\ndesignated as acting Librarian under subparagraph (A)\nmay serve until--\n``(i) the end of the absence or disability\nof the Librarian or the Deputy Librarian; or\n``(ii) in the case of vacancies in both\npositions, a Librarian has been appointed under\nsection 3.\n``(3) Authority.--An officer serving as acting Librarian\nunder paragraph (1) or (2) shall perform all the duties and\nexercise all the authorities of the Librarian, including the\nauthority to delegate the duties and authorities of the\nLibrarian.''.\n\nSEC. 4. DIRECTOR OF THE GOVERNMENT PUBLISHING OFFICE.\n\n(a) In General.--Chapter 3 of title 44, United States Code, is\namended--\n(1) by inserting before section 301 the following:\n``Sec. 300. Definitions\n``In this chapter--\n``(1) the term `commission' means a congressional\ncommission consisting of the oversight committee leadership and\nthe House and Senate leadership;\n``(2) the term `House and Senate leadership' means the\nSpeaker of the House of Representatives, the majority leader of\nthe Senate, the minority leader of the House of\nRepresentatives, and the minority leader of the Senate; and\n``(3) the term `oversight committee leadership' means the\nchair and ranking minority member of the Committee on House\nAdministration of the House of Representatives and the chairman\nand ranking minority member of the Committee on Rules and\nAdministration of the Senate.''; and\n(2) in section 301--\n(A) by striking subsection (a) and inserting the\nfollowing:\n``(a)(1) The Government Publishing Office shall be headed by a\nDirector.\n``(2)(A) The Director shall be appointed by the commission in\naccordance with the procedures specified in subparagraph (B), without\nregard to political affiliation, and solely on the basis of fitness to\nperform the duties of the office.\n``(B)(i) If there is a vacancy in the position of Director, the\noversight committee leadership shall jointly recommend 3 individuals\nfor appointment to the vacant office.\n``(ii) The Director shall be appointed from among the 3 individuals\nrecommended under clause (i), upon a majority vote of the House and\nSenate leadership.'';\n(B) in subsection (c), by striking ``, by and with\nthe advice and consent of the Senate,''; and\n(C) by adding at the end the following:\n``(d) The Director may be removed from office at any time upon a\nmajority vote of the members of the House and Senate leadership.''.\n(b) Pay.--Section 303 of title 44, United States Code, is amended--\n(1) by inserting ``(a)'' before ``The annual rate of pay\nfor the Director of the Government Publishing Office''; and\n(2) by adding at the end the following:\n``(b) The Director of the Government Publishing Office shall not be\nconsidered to serve under a political appointment for purposes of\nsection 747 of the Financial Services and General Government\nAppropriations Act, 2024 (division B of Public Law 118-47; 138 Stat.\n585), or any other subsequently enacted similar provision of law.''.\n(c) Conforming Amendment.--The table of sections for chapter 3 of\ntitle 44, United States Code, is amended by inserting before the item\nrelating to section 301 the following:\n\n``300. Definitions.''.\n\nSEC. 5. DEPUTY DIRECTOR OF THE GOVERNMENT PUBLISHING OFFICE.\n\n(a) In General.--Section 302 of title 44, United States Code, is\namended to read as follows:\n``Sec. 302. Deputy Director of the Government Publishing Office:\nappointment; duties\n``(a) In this section--\n``(1) the term `Deputy Director' means the Deputy Director\nof the Government Publishing Office; and\n``(2) the term `Director' means the Director of the\nGovernment Publishing Office.\n``(b)(1) The Director shall appoint a suitable person to be the\nDeputy Director.\n``(2) The Deputy Director shall supervise the buildings occupied by\nthe Government Publishing Office and perform any other duties required\nby the Director.\n``(c) The Director shall appoint a Deputy Director under subsection\n(b)(1) not later than 120 days after--\n``(1) the date on which the Director is appointed under\nsection 301, if there is no Deputy Director on the date of the\nappointment; or\n``(2) the date on which a vacancy arises in the office of\nthe Deputy Director.\n``(d) If the Director does not appoint a Deputy Director on or\nbefore the applicable date specified in subsection (c)--\n``(1) the oversight committee leadership shall jointly\nrecommend an individual for appointment to the vacant office;\nand\n``(2) upon a majority vote of the House and Senate\nleadership, the individual recommended under paragraph (1)\nshall be appointed as the Deputy Director.\n``(e) If the position of Deputy Director becomes vacant, the\nDirector shall immediately notify the members of the commission.''.\n(b) Service as Acting Director.--Section 304 of title 44, United\nStates Code, is amended to read as follows:\n``Sec. 304. Director of the Government Publishing Office: vacancy in\noffice\n``(a) In this section, the terms `Deputy Director' and `Director'\nhave the meanings given such terms in section 302(a).\n``(b) The Deputy Director shall act as Director if the Director is\nabsent or disabled or there is no Director.\n``(c)(1) For purposes of subsection (b), if the Deputy Director is\nalso absent or disabled or there is no Deputy Director--\n``(A) the oversight committee leadership shall jointly\nrecommend an individual to be designated to serve as acting\nDirector; and\n``(B) upon a majority vote of the House and Senate\nleadership, the individual recommended under subparagraph (A)\nshall be designated as the acting Director.\n``(2) An individual designated as acting Director under paragraph\n(1) may serve until--\n``(A) the end of the absence or disability of the Director\nor the Deputy Director; or\n``(B) in the case of vacancies in both positions, a\nDirector has been appointed under section 301.\n``(d) An officer serving as acting Director under subsection (b) or\n(c) shall perform all the duties and exercise all the authorities of\nthe Director, including the authority to delegate the duties and\nauthorities of the Director.''.\n\nSEC. 6. COPYRIGHT OFFICE.\n\n(a) Removing Supervisory Authority of Library of Congress Over\nCopyright Office.--\n(1) In general.--Title 17, United States Code, is amended--\n(A) in chapter 1--\n(i) in section 111(d)--\n(I) in paragraph (2), in the second\nsentence, by striking ``Librarian of\nCongress'' and inserting ``Register of\nCopyrights''; and\n(II) in paragraph (4)--\n(aa) in subparagraph (B),\nin the second sentence, by\nstriking ``Librarian of\nCongress'' and inserting\n``Register of Copyrights''; and\n(bb) in subparagraph (C),\nby striking ``Librarian of\nCongress'' and inserting\n``Register of Copyrights'';\n(ii) in section 112(e)(5), by striking\n``Librarian of Congress'' and inserting\n``Register of Copyrights'';\n(iii) in section 114(f)(2), by striking\n``Librarian of Congress'' and inserting\n``Register of Copyrights'';\n(iv) in section 115(d)--\n(I) in paragraph (3)(A)(iv), by\nstriking ``, with the approval of the\nLibrarian of Congress pursuant to\nsection 702,''; and\n(II) in paragraph (5)(A)(iv), by\nstriking ``, with the approval of the\nLibrarian of Congress pursuant to\nsection 702,'';\n(v) in section 118(b)(2), by striking\n``Librarian of Congress'' and inserting\n``Register of Copyrights''; and\n(vi) in section 119(b)--\n(I) in paragraph (3), in the second\nsentence, by striking ``Librarian of\nCongress'' and inserting ``Register of\nCopyrights''; and\n(II) in paragraph (5)--\n(aa) in subparagraph (B),\nin the second sentence, by\nstriking ``Librarian of\nCongress'' and inserting\n``Register of Copyrights''; and\n(bb) in subparagraph (C),\nby striking ``Librarian of\nCongress'' and inserting\n``Register of Copyrights'';\n(B) in chapter 7--\n(i) in section 701--\n(I) in subsection (a)--\n(aa) in the first sentence,\nby striking ``of the Library of\nCongress''; and\n(bb) by striking the second\nsentence and inserting the\nfollowing: ``The Register of\nCopyrights shall be appointed\nby the President, by and with\nthe advice and consent of the\nSenate, but before the\nPresident makes such an\nappointment, the chair and\nranking minority member of each\nof the Committee on House\nAdministration of the House of\nRepresentatives, the Committee\non the Judiciary of the House\nof Representatives, the\nCommittee on Rules and\nAdministration of the Senate,\nand the Committee on the\nJudiciary of the Senate shall\njointly recommend 3 individuals\nwhom the President may consider\nin making the appointment. The\nsubordinate officers and\nemployees of the Copyright\nOffice shall be appointed by\nthe Register of Copyrights.'';\n(II) in subsection (d)--\n(aa) in the first sentence,\nby striking ``the Librarian\nof''; and\n(ii) in subparagraph (D), by striking\n``Librarian'' each place that term appears and\ninserting ``Register of Copyrights'';\n(F) in section 1331, by striking ``of the Library\nof Congress''; and\n(G) in chapter 15--\n(i) in section 1502(b)--\n(I) in paragraph (1)--\n(aa) in the first sentence,\nby striking ``recommend'' and\ninserting ``appoint''; and\n(bb) by striking the second\nsentence;\n(II) in paragraph (6)--\n(aa) in subparagraph\n(A)(i), by striking ``the\nLibrarian of Congress shall,\nupon the recommendation of, and\nin consultation with, the\nRegister of Copyrights,'' and\ninserting ``the Register of\nCopyrights shall''; and\n(bb) in subparagraph (B),\nby striking ``the Librarian of\nCongress shall, upon\nrecommendation of, and in\nconsultation with, the Register\nof Copyrights,'' and inserting\n``the Register of Copyrights\nshall''; and\n(III) in paragraph (7), by striking\n``Librarian of Congress'' and inserting\n``Register of Copyrights''; and\n(ii) in section 1503(b)(3), by striking\n``Library of Congress or''.\n(2) Amendments to other laws.--\n(A) Computer software rental amendments act of\n1990.--Section 805(d) of the Computer Software Rental\nAmendments Act of 1990 (17 U.S.C. 205 note; Public Law\n101-650) is amended by striking the second sentence.\n(B) Unlocking consumer choice and wireless\ncompetition act.--Section 2 of the Unlocking Consumer\nChoice and Wireless Competition Act (17 U.S.C. 1201\nnote; Public Law 113-144) is amended--\n(i) in the heading, by striking ``by\nlibrarian of congress'';\n(ii) in subsection (a), by inserting after\n``United States Code,'' the following: ``(as in\neffect before the date of enactment of the\nLegislative Branch Agencies Clarification\nAct)'';\n(iii) in subsection (c), by striking\nparagraph (2) and inserting the following:\n``(2) as authorized by an exemption adopted by--\n``(A) the Librarian of Congress pursuant to a\ndetermination made on or after the date of enactment of\nthis Act and before the date of enactment of the\nLegislative Branch Agencies Clarification Act under\nsection 1201(a)(1)(C) of title 17, United States Code;\nor\n``(B) the Register of Copyrights pursuant to a\ndetermination made on or after the date of enactment of\nthe Legislative Branch Agencies Clarification Act under\nsection 1201(a)(1)(C) of title 17, United States\nCode,''; and\n(iv) in subsection (d), by striking\nparagraph (2) and inserting the following:\n``(2) Librarian of congress; register of copyrights.--\nNothing in this Act alters, or shall be construed to alter, the\nauthority of--\n``(A) the Librarian of Congress under section\n1201(a)(1) of title 17, United States Code, as in\neffect before the date of enactment of the Legislative\nBranch Agencies Clarification Act; or\n``(B) the Register of Copyrights under section\n1201(a)(1) of title 17, United States Code, as in\neffect on or after the date of enactment of the\nLegislative Branch Agencies Clarification Act.''.\n(C) Act of june 13, 1957.--The first section of the\nAct entitled ``An Act to fix the responsibilities of\ncertifying officers and disbursing officer of the\nLibrary of Congress'', approved June 13, 1957 (2 U.S.C.\n142b), is amended by striking ``, including the\nCopyright Office,''.\n(b) Register of Copyrights Qualifications; Term of Office.--Section\n701(a) of title 17, United States Code, as amended by this section, is\namended--\n(1) by inserting before ``shall be appointed by the\nPresident'' the following: ``shall be a citizen of the United\nStates with a background and experience in copyright law,\nand''; and\n(2) by inserting before ``The subordinate officers'' the\nfollowing: ``The Register of Copyrights shall be appointed for\na term of 10 years, but if the Register is appointed to fill a\nvacancy occurring prior to the expiration of the term for which\nthe most immediate predecessor was appointed, the Register\nshall be appointed for the remainder of such term. The Register\nmay be reappointed for 1 or more additional terms of 5 years\neach.''.\n(c) Establishment of Inspector General of the Copyright Office.--\nSection 1307 of the Legislative Branch Appropriations Act, 2006 (2\nU.S.C. 185), is amended by adding at the end the following:\n``(i) Establishment of Inspector General of the Copyright Office as\na Separate Office.--\n``(1) Office of inspector general.--There is an Office of\nInspector General within the Copyright Office which is an\nindependent objective office to--\n``(A) conduct and supervise audits and\ninvestigations (excluding incidents involving violence\nand personal property) relating to the Copyright\nOffice, except that nothing in this subparagraph may be\nconstrued to authorize the Inspector General to audit\nor investigate any operations or activities of the\nUnited States Capitol Police;\n``(B) provide leadership and coordination and\nrecommend policies to promote economy, efficiency, and\neffectiveness; and\n``(C) provide a means of keeping the Register of\nCopyrights and the Congress fully and currently\ninformed about problems and deficiencies relating to\nthe administration and operations of the Copyright\nOffice.\n``(2) Appointment of inspector general; supervision;\nremoval; pay; limits on bonuses; counsel.--\n``(A) Appointment and supervision.--\n``(i) In general.--There shall be at the\nhead of the Office of Inspector General, an\nInspector General who shall be appointed by the\nRegister of Copyrights without regard to\npolitical affiliation and solely on the basis\nof integrity and demonstrated ability in\naccounting, auditing, financial analysis, law,\nmanagement analysis, public administration, or\ninvestigations. The Inspector General shall\nreport to, and be under the general supervision\nof, the Register of Copyrights.\n``(ii) Audits, investigations, and\nreports.--The Register of Copyrights shall have\nno authority to prevent or prohibit the\nInspector General from--\n``(I) initiating, carrying out, or\ncompleting any audit or investigation;\n``(II) issuing any subpoena during\nthe course of any audit or\ninvestigation; or\n``(III) issuing any report.\n``(B) Removal or transfer.--\n``(i) In general.--The Inspector General\nmay be removed from office, or transferred to\nanother position within, or another location\nof, the Copyright Office, by the Register of\nCopyrights.\n``(ii) Notice.--Not later than 30 days\nbefore the Register of Copyrights removes or\ntransfers the Inspector General under clause\n(i), the Register of Copyrights shall\ncommunicate in writing the reason for the\nremoval or transfer to--\n``(I) the Committee on House\nAdministration and the Committee on\nAppropriations of the House of\nRepresentatives; and\n``(II) the Committee on Rules and\nAdministration and the Committee on\nAppropriations of the Senate.\n``(iii) Applicability.--Nothing in this\nsubparagraph shall prohibit a personnel action\n(except for removal or transfer) that is\notherwise authorized by law.\n``(C) Pay.--\n``(i) In general.--The position of\nInspector General shall--\n``(I) be classified as a position\nabove GS-15 in accordance with section\n5108 of title 5, United States Code;\nand\n``(II) have a rate of basic pay\nthat is not less than the average rate\nof basic pay of all other employees in\npositions classified as above GS-15 of\nthe Copyright Office calculated on an\nannual basis.\n``(ii) Adjustments.--The Register of\nCopyrights shall establish the amount of the\nannual adjustment in the rate of basic pay for\nthe Inspector General in an amount equal to the\naverage of the annual adjustments in the rate\nof basic pay provided to all other employees in\npositions classified as above GS-15 of the\nCopyright Office, in a manner consistent with\nsection 5376 of title 5, United States Code.\n``(D) No bonuses.--The Inspector General may not\nreceive any cash award or cash bonus, including a cash\naward under chapter 45 of title 5, United States Code.\n``(E) Counsel.--The Inspector General shall, in\naccordance with applicable laws and regulations\ngoverning selections, appointments, and employment at\nthe Copyright Office, obtain legal advice from a\ncounsel reporting directly to the Inspector General or\nanother Inspector General.\n``(3) Duties, responsibilities, authority, and reports.--\n``(A) In general.--Sections 404, 405 (other than\nsubsection (b)(13)), 406(a) (other than paragraphs (7)\nand (8) thereof), and 407 of title 5, United States\nCode, shall apply to the Inspector General of the\nCopyright Office and the Office of such Inspector\nGeneral and such sections shall be applied to the\nCopyright Office and the Register of Copyrights by\nsubstituting--\n``(i) `Copyright Office' for\n`establishment'; and\n``(ii) `Register of Copyrights' for `head\nof the establishment'.\n``(B) Employees.--\n``(i) In general.--The Inspector General,\nin carrying out the provisions of this\nsubsection, is authorized, without the\nsupervision or approval of any other employee,\noffice, or other entity within the Copyright\nOffice, to select, appoint, and employ such\nofficers and employees (including consultants)\nas may be necessary for carrying out the\nfunctions, powers, and duties of the Office of\nInspector General subject to the provisions of\nlaw governing selections, appointments, and\nemployment in the Copyright Office.\n``(ii) Security and suitability.--\nAppointments under the authority under clause\n(i) shall be made consistent with personnel\nsecurity and suitability requirements.\n``(iii) Consultants.--Any appointment of a\nconsultant under the authority under clause (i)\nshall be made consistent with section 406(a)(9)\nof title 5, United States Code.\n``(C) Law enforcement authority.--\n``(i) In general.--Subject to clause (ii),\nany supervisory special agent under the\nInspector General and any special agent\nsupervised by such a supervisory special agent\nis authorized to--\n``(I) make an arrest without a\nwarrant while engaged in official\nduties as authorized under this section\nor any other statute for any offense\nagainst the United States committed in\nthe presence of such supervisory\nspecial agent or special agent, or for\nany felony cognizable under the laws of\nthe United States if such supervisory\nspecial agent or special agent has\nreasonable grounds to believe that the\nperson to be arrested has committed or\nis committing such felony;\n``(II) seek and execute warrants\nfor arrest, search of a premises, or\nseizure of evidence issued under the\nauthority of the United States upon\nprobable cause to believe that a\nviolation has been committed; and\n``(III) carry a firearm while\nengaged in official duties as\nauthorized under this section or any\nother statute.\n``(ii) Requirements to exercise\nauthority.--\n``(I) Required certification.--\n``(aa) In general.--In\norder to exercise the authority\nunder clause (i), a supervisory\nspecial agent or a special\nagent supervised by such a\nsupervisory special agent shall\ncertify that he or she--\n\n``(AA) is a citizen\nof the United States;\n\n``(BB) has\nsuccessfully completed\na basic law enforcement\ntraining program or\nmilitary or other\nequivalent; and\n\n``(CC) is not\nprohibited from\nreceiving a firearm\nunder Federal law,\nincluding under section\n922(g)(9) of title 18,\nUnited States Code,\nbecause of a conviction\nof a misdemeanor crime\nof domestic violence.\n\n``(bb) Additional\nrequirements.--After providing\nnotice to the appropriate\ncommittees of Congress, the\nInspector General may add\nrequirements to the\ncertification required under\nitem (aa), as determined\nappropriate by the Inspector\nGeneral.\n``(II) Maintenance of\nrequirements.--The Inspector General\nshall maintain firearms-related\nrequirements (including quarterly\nfirearms qualifications) and use of\nforce training requirements that,\nexcept to the extent the Inspector\nGeneral determines necessary to\neffectively carry out the duties of the\nOffice of the Inspector General, are in\naccordance with the Council of the\nInspectors General on Integrity and\nEfficiency use of force policies, which\nincorporate Department of Justice\nguidelines.\n``(III) Eligibility\ndetermination.--\n``(aa) In general.--The\nInspector General shall--\n\n``(AA) determine\nwhether an individual\nmeets the requirements\nunder this\nsubparagraph; and\n\n``(BB) revoke any\nauthority granted to an\nindividual under clause\n(i) if the individual\nis not in compliance\nwith the requirements\nof this subparagraph.\n\n``(bb) Reauthorization.--\nThe Inspector General may\nreauthorize an individual to\nexercise the authority granted\nunder clause (i) if the\nInspector General determines\nthe individual has achieved\ncompliance with the\nrequirements under this\nsubparagraph.\n``(cc) Limitation on\nappeal.--A revocation of the\nauthority granted under clause\n(i) shall not be subject to\nadministrative, judicial, or\nother review, unless the\nrevocation results in an\nadverse action. Such an adverse\naction may, at the election of\nthe applicable individual, be\nreviewed in accordance with the\notherwise applicable\nprocedures.\n``(iii) Semiannual certification of\nprogram.--\n``(I) In general.--Before the first\ngrant of authority under clause (i),\nand semiannually thereafter as part of\nthe report under section 405 of title\n5, United States Code, the Inspector\nGeneral shall submit to the appropriate\ncommittees of Congress a written\ncertification that adequate internal\nsafeguards and management procedures\nexist that, except to the extent the\nInspector General determines necessary\nto effectively carry out the duties of\nthe Office of the Inspector General,\nare in compliance with standards\nestablished by the Council of the\nInspectors General on Integrity and\nEfficiency, which incorporate\nDepartment of Justice guidelines, to\nensure proper exercise of the powers\nauthorized under this subparagraph.\n``(II) Suspension of authority.--\nThe authority granted under this\nsubparagraph (including any grant of\nauthority to an individual under clause\n(i), without regard to whether the\nindividual is in compliance with clause\n(ii)) may be suspended by the Inspector\nGeneral if the Office of Inspector\nGeneral fails to comply with the\nreporting and review requirements under\nsubclause (I) of this clause or clause\n(iv). Any suspension of authority under\nthis subclause shall be reported to the\nappropriate committees of Congress.\n``(iv) Peer review.--To ensure the proper\nexercise of the law enforcement powers\nauthorized under this subparagraph, the Office\nof Inspector General shall submit to and\nparticipate in the external review process\nestablished by the Council of the Inspectors\nGeneral on Integrity and Efficiency for\nensuring that adequate internal safeguards and\nmanagement procedures continue to exist. Under\nthe review process, the exercise of the law\nenforcement powers by the Office of Inspector\nGeneral shall be reviewed periodically by\nanother Office of Inspector General or by a\ncommittee of Inspectors General. The results of\neach review shall be communicated in writing to\nthe Inspector General, the Council of the\nInspectors General on Integrity and Efficiency,\nand the appropriate committees of Congress.\n``(v) Alleged misconduct.--Any allegation\nof misconduct by an individual granted\nauthority under clause (i) may be reviewed by\nthe Integrity Committee of the Council of the\nInspectors General on Integrity and Efficiency.\n``(vi) Appropriate committees of\ncongress.--In this paragraph, the term\n`appropriate committees of Congress' means--\n``(I) the Committee on Rules and\nAdministration and the Committee on\nAppropriations of the Senate; and\n``(II) the Committee on House\nAdministration and the Committee on\nAppropriations of the House of\nRepresentatives.\n``(D) Budget independence.--The Register of\nCopyrights shall include the annual budget request of\nthe Inspector General in the budget of the Copyright\nOffice without change.''.\n(d) Appointment of Acting Officers by Acting Register.--Section\n701(a) of title 17, United States Code, as amended by this section, is\namended by adding at the end the following: ``Any officer appointed by\nan acting Register of Copyrights, including a Copyright Royalty Judge,\nshall be an acting officer, and may be removed from office at any time\nby an individual serving in the office of Register of Copyrights\npursuant to an appointment by the President, by and with the advice and\nconsent of the Senate.''.\n(e) Ratification of Actions Taken by Copyright Entities Prior to\nEnactment.--Each action taken under title 17, United States Code, by\nthe Copyright Office, the Register of Copyrights, the Copyright Royalty\nJudges, or the Copyright Claims Board during the period beginning on\nMay 8, 2025, and ending on the date of enactment of this Act is\nratified and shall be given full force and effect.\n(f) Support Agreements; Reimbursement.--Section 701 of title 17,\nUnited States Code, is amended by adding at the end the following:\n``(g) Support Agreements; Reimbursement.--The Library of Congress\nand any other agency or office in the legislative branch of the Federal\nGovernment may provide administrative, facilities, financial\nmanagement, information technology, legal, security, and other\nappropriate support to the Copyright Office as provided under an\nagreement for services entered into by the applicable agency or office\nand the Copyright Office.''.\n(g) Transition Provisions.--During the period specified in\nparagraph (1):\n(1) Period.--The period specified in this paragraph is the\nperiod that begins on the date of the enactment of this Act and\nends on September 30, 2029.\n(2) Transfers of appropriations.--The Register of\nCopyrights and the Librarian of Congress may enter into such\nagreements as necessary to transfer appropriated amounts from\none to the other if such amounts are necessary to carry out\nthis Act and effectuate the separation of the Copyright Office\nand the Library of Congress.\n(3) Personnel.--The laws with respect to the personnel of\nthe Federal Government shall apply to the personnel of the\nCopyright Office to the same extent as such laws apply to the\nLibrary of Congress. Each officer or employee of the Copyright\nOffice shall be appointed solely with reference to the fitness\nof the officer or employee to carry out the particular duties\nof the officer or employee.\n\nSEC. 7. GOVERNMENT PUBLISHING OFFICE PERSONNEL REFORMS.\n\n(a) Application of the Congressional Accountability Act to the\nGovernment Publishing Office.--Section 101(a) of the Congressional\nAccountability Act of 1995 (2 U.S.C. 1301(a)) is amended--\n(1) in paragraph (3)--\n(A) in subparagraph (J), by striking ``or'';\n(B) in subparagraph (K), by striking the period at\nthe end and inserting ``; or''; and\n(C) by adding at the end the following:\n``(L) the Government Publishing Office.'';\n(2) in paragraph (7), by striking ``through (K)'' and\ninserting ``through (L)'';\n(3) in paragraph (8), by striking ``through (K)'' and\ninserting ``through (L)''; and\n(4) in paragraph (9)(D)--\n(A) by striking ``and the John'' and inserting\n``the John''; and\n(B) by inserting ``, and the Government Publishing\nOffice'' before ``; or''.\n(b) Conforming Amendments.--\n(1) Section 2301(a) of title 5, United States Code, is\namended to read as follows:\n``(a) This section shall apply to an Executive agency.''.\n(2) Section 2302(a)(2)(C) of title 5, United States Code,\nis amended by striking ``and the Government Publishing\nOffice''.\n(3) Section 4301(1) of title 5, United States Code, is\namended--\n(A) by striking ``(1) `agency' means--'' and all\nthat follows through ``but does not include--'' and\ninserting the following:\n``(1) `agency' means an Executive agency, but does not\ninclude--''; and\n(B) by redesignating clauses (i), (ii), and (iii)\nas subparagraphs (A), (B), and (C).\n(4) Section 4701(a)(1) of title 5, United States Code, is\namended by striking ``and the Government Publishing Office''.\n(5) Section 5102(a)(1) of title 5, United States Code, is\namended--\n(A) by striking subparagraph (D); and\n(B) redesignating subparagraphs (E) and (F) as\nsubparagraphs (D) and (E), respectively.\n\nSEC. 8. HUMAN CAPITAL MANAGEMENT SYSTEM FOR THE GOVERNMENT PUBLISHING\nOFFICE.\n\n(a) In General.--Section 305(a) of title 44, United States Code, is\namended--\n(1) in the first sentence--\n(A) by striking ``other persons'' and inserting\n``other people''; and\n(B) by striking ``the persons employed'' and\ninserting ``those employed'';\n(2) in the second sentence, by striking ``persons'' and\ninserting ``people'';\n(3) by striking the third sentence; and\n(4) by striking ``oftener than once a year.'' and inserting\n``more often than once a year.''.\n(b) Human Capital Management System.--\n(1) In general.--Chapter 3 of title 44, United States Code,\nis amended by inserting after section 306 the following:\n``Sec. 306A. Director of the Government Publishing Office; human\ncapital management system\n``(a) The Director of the Government Publishing Office shall\nestablish and maintain a human capital management system (in this\nsection referred to as the `system').\n``(b) The system shall--\n``(1) include the merit system principles set forth under\nsection 2301(b) of title 5;\n``(2) prohibit any personnel practice prohibited under\nsection 2302(b) of title 5;\n``(3) prohibit any political activity prohibited under\nsubchapter III of chapter 73 of title 5;\n``(4) ensure that officers and employees of the Government\nPublishing Office are appointed, promoted, and assigned only on\nthe basis of merit and fitness;\n``(5) be established without regard to the provisions of\ntitle 5 governing appointments and other personnel actions in\nthe competitive service; and\n``(6) give a preference to an individual eligible for a\nhiring preference in the executive branch of the United States\nGovernment in a way and to an extent consistent with the\npreference given the individual for a position in the executive\nbranch.\n``(c)(1) The Director may prescribe regulations about the system\nonly--\n``(A) after notice and opportunity for public comment; and\n``(B) with the approval of the Joint Committee on Printing.\n``(2) An officer or employee of the Government Publishing Office\nmay not make a reprisal or threat of reprisal against another officer\nor employee of the Government Publishing Office because of comments on\na proposed regulation about the system.''.\n(2) Conforming amendment.--The table of sections for\nchapter 3 of title 44, United States Code, is amended by\ninserting after the item relating to section 306 the following:\n\n``306A. Director of the Government Publishing Office; human capital\nmanagement system.''.\n(c) Savings Clause.--Nothing in this section or the amendments made\nby this section shall be construed to affect any proceeding or payment\nof an award or settlement relating to a claim which is pending on the\neffective date of this section under--\n(1) title VII of the Civil Rights Act of 1964 (42 U.S.C.\nSec. 2000e et seq.);\n(2) chapter 71 of title 5, United States Code (relating to\nFederal service labor-management relations);\n(3) an appeal to the Merit Systems Protection Board; or\n(4) subchapter II, chapter 12, of title 5, United States\nCode.\n\nSEC. 9. UPDATE TO PRINT REQUIREMENTS.\n\n(a) In General.--Section 501 of title 44, United States Code, is\namended to read as follows:\n``Sec. 501. Government printing, binding, blank-book work, and\npublishing services by the Government Publishing Office\n``The Government Publishing Office may perform printing, binding,\nblank-book work, and publishing services for Congress, the Executive\nOffice of the President, the Judiciary, and every executive department,\nindependent office, and establishment of the Government.''.\n(b) Conforming Amendments.--\n(1) Section 207(a) of the Legislative Branch Appropriations\nAct, 1993 (44 U.S.C. 501 note) is repealed.\n(2) The table of sections for chapter 5 of title 44, United\nStates Code, is amended by striking the item relating to\nsection 501 and inserting the following:\n\n``501. Government printing, binding, blank-book work, and publishing\nservices by the Government Publishing\nOffice.''.\n\nSEC. 10. APPLICABILITY.\n\n(a) In General.--Except as provided in subsection (b), this Act and\nthe amendments made by this Act shall apply on and after the date of\nenactment of this Act.\n(b) Exceptions.--\n(1) Librarian.--\n(A) Appointment.--Subsection (a) of section 3 of\nthe Librarian of Congress Succession Modernization Act\nof 2015, as redesignated and amended by this Act, shall\napply to any appointment to the position of Librarian\nof Congress made on or after the date of enactment of\nthis Act.\n(B) Removal.--Subsection (d) of section 3 of the\nLibrarian of Congress Succession Modernization Act of\n2015, as redesignated and amended by this Act, shall\napply with respect to an individual appointed to the\nposition of Librarian of Congress before, on, or after\nthe date of enactment of this Act.\n(C) Pay.--Subsection (b) of section 904 of the\nSupplemental Appropriations Act, 1983 (2 U.S.C. 136a-\n2), as added by this Act, shall apply on and after the\nfirst day of the first applicable pay period beginning\non or after the date of enactment of this Act.\n(2) Deputy librarian appointment.--Subsections (a)(1), (b),\nand (c) of section 4 of the Librarian of Congress Succession\nModernization Act of 2015, as added by this Act, shall apply to\nany appointment to the position of Deputy Librarian of Congress\nmade on or after the date of enactment of this Act.\n(3) Director of gpo.--\n(A) Appointment.--Subsection (a)(2) of section 301\nof title 44, United States Code, as amended by this\nAct, shall apply to any appointment to the position of\nDirector of the Government Publishing Office made on or\nafter the date of enactment of this Act.\n(B) Removal.--Subsection (d) of section 301 of\ntitle 44, United States Code, as added by this Act,\nshall apply with respect to an individual appointed to\nthe position of Director of the Government Publishing\nOffice before, on, or after the date of enactment of\nthis Act.\n(C) Pay.--Subsection (b) of section 303 of title\n44, United States Code, as added by this Act, shall\napply on and after the first day of the first\napplicable pay period beginning on or after the date of\nenactment of this Act.\n(4) Deputy director of gpo appointment.--Subsections\n(b)(1), (c), and (d) of section 302 of title 44, United States\nCode, as added by this Act, shall apply to any appointment to\nthe position of Deputy Director of the Government Publishing\nOffice made on or after the date of enactment of this Act.\n(5) Register of copyrights; subordinate officers and\nemployees generally.--Section 701(a) of title 17, United States\nCode, as amended by this Act, shall apply to any appointment to\nthe position of Register of Copyrights or to the position of a\nsubordinate officer or employee of the Copyright Office made on\nor after the date of enactment of this Act.\n(6) Associate registers of copyrights.--Section 701(f) of\ntitle 17, United States Code, as amended by this Act, shall\napply to any appointment to the position of Associate Register\nof Copyrights made on or after the date of enactment of this\nAct.\n(7) Copyright royalty judges.--Sections 801(a) and\n802(d)(1) of title 17, United States Code, as amended by this\nAct, shall apply to any appointment to the position of\nCopyright Royalty Judge (including the Chief Copyright Royalty\nJudge or an interim Copyright Royalty Judge) made on or after\nthe date of enactment of this Act.\n(8) Copyright claims officers.--Section 1502(b)(1) of title\n17, United States Code, as amended by this Act, shall apply to\nany appointment to the position of Copyright Claims Officer\nmade on or after the date of enactment of this Act.\n(9) Human capital management system for the government\npublishing office.--Section 8 and the amendments made by\nsection 8 shall take effect on the date that is 180 days after\nthe date of enactment of this Act.\n\nSEC. 11.
