Any other statement in column 2 has effect according to its terms.\n\nCommencement information\n\nColumn 1\nColumn 2\nColumn 3\n\nProvisions\nCommencement\nDate/Details\n\n1. The whole of this Act\nThe day after this Act receives the Royal Assent.\n12 September 2026\n\nNote: This table relates only to the provisions of this Act as originally enacted. It will not be amended to deal with any later amendments of this Act.\n(2) Any information in column 3 of the table is not part of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act.\n3 Schedules\nLegislation that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.\nSchedule 1 — Amendments\n\nOnline Safety Act 2021\n1 Section 63D (penalty)\nOmit “30,000”, substitute “60,000”.\n2 Subsection 63DA(1) (penalty)\nOmit “30,000”, substitute “60,000”.\n3 Subsection 63DB(1) (penalty)\nOmit “30,000”, substitute “60,000”.\n4 Section 63G\nRepeal the section, substitute:\n63G Commissioner may obtain information and documents about compliance\nScope\n(1) This section applies to a person if the Commissioner believes on reasonable grounds that the person has information or documents relevant to compliance by a provider of an electronic service that is or may be an age ‑ restricted social media platform with section 63D or subsection 63DA(1) or 63DB(1).\n(2) This section also applies to a person if the Commissioner believes on reasonable grounds that the person has information or documents relevant to whether an electronic service is a service specified in the legislative rules for the purposes of paragraph 63C(1)(b) or (6)(b).\nRequirement\n(3) The Commissioner may, by written notice given to a person to whom this section applies, require the person to do either or both of the following:\n(a) give to the Commissioner any information mentioned in subsection (1) or (2) (as applicable), within the period and in the manner specified in the notice;\n(b) produce to the Commissioner any documents mentioned in subsection (1) or (2) (as applicable), within the period and in the manner specified in the notice.\n(4) However, the notice must not require the person to give information or produce documents by summoning the person to attend before the Commissioner or other person.\nNote: See Division 4A for the power to require a person to give information or evidence, produce documents or answer questions relevant to a matter mentioned in subsection (1) by summoning the person to attend before the Commissioner or other person.\n5 Section 63H (penalty)\nOmit “500”, substitute “1,000”.\n6 Application of amendments\n(1) The amendments of Division 2 of Part 4A of the Online Safety Act 2021 made by this Schedule apply in relation to conduct engaged in on or after the day the amendments commence.\n(2) The amendments of sections 63G and 63H of the Online Safety Act 2021 made by this Schedule apply in relation to notices given on or after the day the amendments commence.\nSchedule 2 — Amendments relating to examinations etc.\n\nOnline Safety Act 2021\n1 After Division 4 of Part 4A\nInsert:\nDivision 4A — Examination powers\n63HA Notice requiring appearance for examination\n(1) This Division applies if the Commissioner has reason to believe that a person is capable of giving information or evidence, producing documents or answering questions relevant to compliance by a provider of an electronic service that is or may be an age ‑ restricted social media platform with section 63D or subsection 63DA(1) or 63DB(1).\n(2) The Commissioner may, by written notice given to the person, summon the person to attend before the Commissioner, or a delegate of the Commissioner named in the notice, at a time and place specified in the notice, to do any one or more of the following:\n(a) give to the Commissioner the information or evidence;\n(b) produce to the Commissioner the documents;\n(c) answer the questions.\n(3) Without limiting subsection (2), the notice may also require the person to:\n(a) make relevant documents available for inspection by the Commissioner or a delegate of the Commissioner; or\n(b) permit the Commissioner or the delegate to make copies of, or take extracts from, those documents.\n63HB Examination on oath or affirmation\n(1) If the person is summoned to attend before the Commissioner or a delegate of the Commissioner, the Commissioner or delegate may examine the person on oath or affirmation and, for that purpose:\n(a) may require the person to take an oath or make an affirmation; and\n(b) may administer the oath or affirmation.\n(2) The oath or affirmation is to be an oath or affirmation that the statements the person will make will be true to the best of the person’s knowledge or belief.\n(3) The Commissioner or delegate may require the person to answer any relevant question put to the person at the examination.\n63HC Examination to take place in private\nThe examination of the person must be conducted in private, but the person is entitled to have an adviser present at the examination.\n63HD Record to be made of examination\n(1) If the person is examined by the Commissioner or a delegate of the Commissioner, a record must be made of the examination and the person is entitled to be given a written copy of the record on request.\n(2) If the record of the examination of the person is made in electronic form, the person is, if the person so requests, to be given a copy of the record in that form.\n(3) If the person requests a copy of the record, the record must be given to the person at a time that the Commissioner or delegate considers appropriate.\n63HE Protection of persons attending before Commissioner\nA person summoned to attend before the Commissioner, or a delegate of the Commissioner, to give information or evidence, produce documents or answer questions under this Division has the same protection as a witness in a proceeding in the High Court.\n63HF Non ‑ compliance with requirements\nCompliance with notice requirements\n(1) A person contravenes this subsection if the person:\n(a) fails to comply with a notice under section 63HA; or\n(b) refuses or fails to answer a question that the person is required to answer under subsection 63HB(3).\nCompliance with requirement to take oath or make affirmation\n(2) A person contravenes this subsection if the person refuses to take an oath or make an affirmation in accordance with paragraph 63HB(1)(a).\nOffence\n(3) A person commits an offence if the person contravenes subsection (1) or (2).\nPenalty: Imprisonment for 12 months.\nCivil penalty\n(4) A person is liable to a civil penalty if the person contravenes subsection (1) or (2).\nCivil penalty: 1,000 penalty units.\nNote: For continuing contraventions of civil penalty provisions, see section 93 of the Regulatory Powers (Standard Provisions) Act 2014 .\nException\n(5) Subsection (1) does not apply if:\n(a) the person is a journalist; and\n(b) complying with the requirement of the notice would tend to disclose the identity of a person who supplied information in confidence to the journalist.\nNote: A defendant bears an evidential burden in relation to the matters mentioned in this subsection: see subsection 13.3(3) of the Criminal Code and section 96 of the Regulatory Powers (Standard Provisions) Act 2014 .\n63HG Self ‑ incrimination\n(1) A person is not excused from giving information or evidence, producing a document or answering a question under this Division on the ground that doing so might tend to incriminate the person.\n(2) However, in the case of an individual:\n(a) any information, evidence or answer given or document produced; or\n(b) the giving of the information or evidence, the production of the document or the answering of the question; or\n(c) any information, document or thing obtained as a direct or indirect consequence of the giving of the information or evidence, the production of the document or the answering of the question;\nis not admissible in evidence against the individual:\n(d) in civil proceedings for the recovery of a penalty, other than proceedings for the recovery of a penalty under section 63HF;
