SHORT TITLE.\n\nThis Act may be cited as the ``Next Generation 9-1-1 Act''.\n\nSEC. 2. FURTHER DEPLOYMENT AND COORDINATION OF NEXT GENERATION 9-1-1.\n\nPart C of the National Telecommunications and Information\nAdministration Organization Act is amended by adding at the end the\nfollowing:\n\n``SEC. 159. COORDINATION OF NEXT GENERATION 9-1-1 IMPLEMENTATION.\n\n``(a) Duties of Assistant Secretary With Respect to Next Generation\n9-1-1.--\n``(1) In general.--The Assistant Secretary, after\nconsulting with the Administrator, shall--\n``(A) take actions, in coordination with State\npoints of contact described under subsection\n(c)(3)(A)(ii) as applicable, to improve coordination\nand communication with respect to the implementation of\nNext Generation 9-1-1;\n``(B) develop, collect, and disseminate information\nconcerning the practices, procedures, and technology\nused in the implementation of Next Generation 9-1-1;\n``(C) advise and assist eligible entities in the\npreparation of implementation plans required under\nsubsection (c)(3)(A)(iii);\n``(D) provide technical assistance to eligible\nentities provided a grant under subsection (c) in\nsupport of efforts to explore efficiencies related to\nNext Generation 9-1-1;\n``(E) review and approve or disapprove applications\nfor grants under subsection (c); and\n``(F) oversee the use of funds provided by such\ngrants in fulfilling such implementation plans.\n``(2) Annual reports.--Not later than October 1, 2026, and\neach year thereafter until funds made available to make grants\nunder subsection (c) are no longer available to be expended,\nthe Assistant Secretary shall submit to Congress a report on\nthe activities conducted by the Assistant Secretary under\nparagraph (1) in the year preceding the submission of the\nreport.\n``(3) Assistance.--The Assistant Secretary may seek the\nassistance of the Administrator in carrying out the duties\ndescribed in subparagraphs (A) through (D) of paragraph (1) as\nthe Assistant Secretary determines necessary.\n``(b) Additional Duties.--\n``(1) Management plan.--\n``(A) Development.--The Assistant Secretary, after\nconsulting with the Administrator, shall develop a\nmanagement plan for the grant program established under\nthis section, including by developing--\n``(i) plans related to the organizational\nstructure of such program; and\n``(ii) funding profiles for each fiscal\nyear of the duration of such program.\n``(B) Submission to congress.--Not later than 180\ndays after the date of the enactment of this section,\nthe Assistant Secretary shall--\n``(i) submit the management plan developed\nunder subparagraph (A) to--\n``(I) the Committees on Energy and\nCommerce and Appropriations of the\nHouse of Representatives; and\n``(II) the Committees on Commerce,\nScience, and Transportation and\nAppropriations of the Senate;\n``(ii) publish the management plan on the\nwebsite of the National Telecommunications and\nInformation Administration; and\n``(iii) provide the management plan to the\nAdministrator for the purpose of publishing the\nmanagement plan on the website of the National\nHighway Traffic Safety Administration.\n``(2) Modification of plan.--\n``(A) Modification.--The Assistant Secretary, after\nconsulting with the Administrator, may modify the\nmanagement plan developed under paragraph (1)(A).\n``(B) Submission.--Not later than 90 days after the\nplan is modified under subparagraph (A), the Assistant\nSecretary shall--\n``(i) submit the modified plan to--\n``(I) the Committees on Energy and\nCommerce and Appropriations of the\nHouse of Representatives; and\n``(II) the Committees on Commerce,\nScience, and Transportation and\nAppropriations of the Senate;\n``(ii) publish the modified plan on the\nwebsite of the National Telecommunications and\nInformation Administration; and\n``(iii) provide the modified plan to the\nAdministrator for the purpose of publishing the\nmodified plan on the website of the National\nHighway Traffic Safety Administration.\n``(c) Next Generation 9-1-1 Implementation Grants.--\n``(1) Grants.--The Assistant Secretary shall provide grants\nto eligible entities for--\n``(A) implementing Next Generation 9-1-1;\n``(B) maintaining Next Generation 9-1-1;\n``(C) training directly related to implementing,\nmaintaining, and operating Next Generation 9-1-1 if the\ncost related to the training does not exceed--\n``(i) 3 percent of the total grant award\nfor eligible entities that are not Tribes; and\n``(ii) 5 percent of the total grant award\nfor eligible entities that are Tribes;\n``(D) public outreach and education on how the\npublic can best use Next Generation 9-1-1 and the\ncapabilities and usefulness of Next Generation 9-1-1;\n``(E) administrative costs associated with planning\nof Next Generation 9-1-1, including any cost related to\nplanning for and preparing an application and related\nmaterials as required by this subsection, if--\n``(i) the cost is fully documented in\nmaterials submitted to the Assistant Secretary;\nand\n``(ii) the cost is reasonable, necessary,\nand does not exceed--\n``(I) 1 percent of the total grant\naward for eligible entities that are\nnot Tribes; and\n``(II) 2 percent of the total grant\naward for eligible entities that are\nTribes; and\n``(F) costs associated with implementing\ncybersecurity measures at emergency communications\ncenters or with respect to Next Generation 9-1-1.\n``(2) Application.--In providing grants under paragraph\n(1), the Assistant Secretary, after consulting with the\nAdministrator, shall require an eligible entity to submit to\nthe Assistant Secretary an application, at the time and in the\nmanner determined by the Assistant Secretary, and containing\nthe certification required by paragraph (3).\n``(3) Coordination required.--Each eligible entity shall\ninclude in the application required by paragraph (2) a\ncertification that--\n``(A) in the case of an eligible entity that is a\nState, the entity--\n``(i) has coordinated the application with\nthe emergency communications centers located\nwithin the jurisdiction of the entity;\n``(ii) has designated a single officer or\ngovernmental body to serve as the State point\nof contact to coordinate the implementation of\nNext Generation 9-1-1 for that State, except\nthat such designation need not vest such\nofficer or governmental body with direct legal\nauthority to implement Next Generation 9-1-1 or\nto manage emergency communications operations;\nand\n``(iii) has developed and submitted a plan\nfor the coordination and implementation of Next\nGeneration 9-1-1 that--\n``(I) ensures interoperability by\nrequiring the use of commonly accepted\nstandards;\n``(II) ensures reliability;\n``(III) enables emergency\ncommunications centers to process,\nanalyze, and store multimedia, data,\nand other information;\n``(IV) incorporates cybersecurity\ntools, including intrusion detection\nand prevention measures;\n``(V) includes strategies for\ncoordinating cybersecurity information\nsharing between Federal, State, Tribal,\nand local government partners;\n``(VI) uses open and competitive\nrequest for proposal processes,\nincluding through shared government\nprocurement vehicles, for deployment of\nNext Generation 9-1-1;\n``(VII) documents how input was\nreceived and accounted for from\nrelevant rural and urban emergency\ncommunications centers, regional\nauthorities, local authorities, and\nTribal authorities;\n``(VIII) includes a governance body\nor bodies, either by creation of new,\nor use of existing, body or bodies, for\nthe development and deployment of Next\nGeneration 9-1-1 that--\n``(aa) ensures full notice\nand opportunity for\nparticipation by relevant\nstakeholders; and\n``(bb) consults and\ncoordinates with the State\npoint of contact required by\nclause (ii);\n``(IX) creates efficiencies related\nto Next Generation 9-1-1 functions,\nincluding cybersecurity and the\nvirtualization and sharing of\ninfrastructure, equipment, and\nservices; and\n``(X) utilizes an effective,\ncompetitive approach to establishing\nauthentication, credentialing, secure\nconnections, and access in deploying\nNext Generation 9-1-1, including by--\n``(aa) requiring\ncertificate authorities to be\ncapable of cross-certification\nwith other authorities;\n``(bb) avoiding risk of a\nsingle point of failure or\nvulnerability; and\n``(cc) adhering to Federal\nagency best practices such as\nthose promulgated by the\nNational Institute of Standards\nand Technology; and\n``(B) in the case of an eligible entity that is a\nTribe, the Tribe has complied with clauses (i) and\n(iii) of subparagraph (A).\n``(4) Criteria.--\n``(A) In general.--Not later than 1 year after the\ndate of the enactment of this section, the Assistant\nSecretary, after consulting with the Administrator,\nshall issue rules, after providing the public with\nnotice and an opportunity to comment, prescribing the\ncriteria for selecting eligible entities for grants\nunder this subsection.\n``(B) Requirements.--The criteria shall--\n``(i) include performance requirements and\na schedule for completion of any project to be\nfinanced by a grant under this subsection; and\n``(ii) specifically permit regional or\nmulti-State applications for funds.\n``(C) Updates.--The Assistant Secretary shall\nupdate such rules as necessary.\n``(5) Grant certifications.--Each eligible entity shall\ncertify to the Assistant Secretary at the time of application\nfor a grant under this subsection, and each eligible entity\nthat receives such a grant shall certify to the Assistant\nSecretary annually thereafter during any period of time the\nfunds from the grant are available to the eligible entity,\nthat--\n``(A) beginning on the date that is 180 days before\nthe date on which the application is filed, no portion\nof any 9-1-1 fee or charge imposed by the eligible\nentity (or in the case that the eligible entity is not\na State or Tribe, any State or taxing jurisdiction\nwithin which the eligible entity will carry out, or is\ncarrying out, activities using grant funds) are\nobligated or expended for a purpose or function not\ndesignated under the rules issued pursuant to section\n6(f)(3) of the Wireless Communications and Public\nSafety Act of 1999 (47 U.S.C. 615a-1(f)(3)) (as such\nrules are in effect on the date on which the eligible\nentity makes the certification) as acceptable;\n``(B) any funds received by the eligible entity\nwill be used, consistent with paragraph (1), to support\nthe deployment of Next Generation 9-1-1 that ensures\nreliability and interoperability, by requiring the use\nof commonly accepted standards;\n``(C) the eligible entity (or in the case that the\neligible entity is not a State or Tribe, any State or\ntaxing jurisdiction within which the eligible entity\nwill carry out or is carrying out activities using\ngrant funds) has established, or has committed to\nestablish not later than 3 years following the date on\nwhich the grant funds are distributed to the eligible\nentity--\n``(i) a sustainable funding mechanism for\nNext Generation 9-1-1; and\n``(ii) effective cybersecurity resources\nfor Next Generation 9-1-1;\n``(D) the eligible entity will promote\ninteroperability between emergency communications\ncenters deploying Next Generation 9-1-1 and emergency\nresponse providers, including users of the nationwide\npublic safety broadband network;\n``(E) the eligible entity has or will take steps to\ncoordinate with adjoining States and Tribes to\nestablish and maintain Next Generation 9-1-1; and\n``(F) the eligible entity has developed a plan for\npublic outreach and education on how the public can\nbest use Next Generation 9-1-1 and on the capabilities\nand usefulness of Next Generation 9-1-1.\n``(6) Condition of grant.--Each eligible entity shall\nagree, as a condition of receipt of a grant under this\nsubsection, that if any State or taxing jurisdiction within\nwhich the eligible entity will carry out activities using grant\nfunds fails to comply with a certification required under\nparagraph (5), during any period of time during which the funds\nfrom the grant are available to the eligible entity, all of the\nfunds from such grant shall be returned to the Assistant\nSecretary.\n``(7) Penalty for providing false information.--Any\neligible entity that provides a certification under paragraph\n(5) knowing that the information provided in the certification\nwas false shall--\n``(A) not be eligible to receive the grant under\nthis subsection;\n``(B) return any grant awarded under this\nsubsection; and\n``(C) not be eligible to receive any subsequent\ngrants under this subsection.\n``(8) Prohibition.--Grant funds provided under this\nsubsection may not be used--\n``(A) to support any activity of the First\nResponder Network Authority; or\n``(B) to make any payments to a person who has\nbeen, for reasons of national security, prohibited by\nany entity of the Federal Government from bidding on a\ncontract, participating in an auction, or receiving a\ngrant.\n``(d) Definitions.--In this section and sections 160 and 161:\n``(1) 9-1-1 fee or charge.--The term `9-1-1 fee or charge'\nhas the meaning given such term in section 6(f)(3)(D) of the\nWireless Communications and Public Safety Act of 1999 (47\nU.S.C. 615a-1(f)(3)(D)).\n``(2) 9-1-1 request for emergency assistance.--The term `9-\n1-1 request for emergency assistance' means a communication,\nsuch as voice, text, picture, multimedia, or any other type of\ndata that is sent to an emergency communications center for the\npurpose of requesting emergency assistance.\n``(3) Administrator.--The term `Administrator' means the\nAdministrator of the National Highway Traffic Safety\nAdministration.\n``(4) Commonly accepted standards.--The term `commonly\naccepted standards' means the technical standards followed by\nthe communications industry for network, device, and Internet\nProtocol connectivity that--\n``(A) enable interoperability; and\n``(B) are--\n``(i) developed and approved by a standards\ndevelopment organization that is accredited by\nan American standards body (such as the\nAmerican National Standards Institute) or an\nequivalent international standards body in a\nprocess--\n``(I) that is open to the public,\nincluding open for participation by any\nperson; and\n``(II) provides for a conflict\nresolution process;\n``(ii) subject to an open comment and input\nprocess before being finalized by the standards\ndevelopment organization;\n``(iii) consensus-based; and\n``(iv) made publicly available once\napproved.\n``(5) Cost related to the training.--The term `cost related\nto the training' means--\n``(A) actual wages incurred for travel and\nattendance, including any necessary overtime pay and\nbackfill wage;\n``(B) travel expenses;\n``(C) instructor expenses; or\n``(D) facility costs and training materials.\n``(6) Eligible entity.--The term `eligible entity'--\n``(A) means--\n``(i) a State or a Tribe; or\n``(ii) an entity, including a public\nauthority, board, or commission, established by\none or more entities described in clause (i);\nand\n``(B) does not include any entity that has failed\nto submit the certifications required under subsection\n(c)(5).\n``(7) Emergency communications center.--\n``(A) In general.--The term `emergency\ncommunications center' means--\n``(i) a facility that--\n``(I) is designated to receive a 9-\n1-1 request for emergency assistance;\nand\n``(II) performs one or more of the\nfunctions described in subparagraph\n(B); or\n``(ii) a public safety answering point, as\ndefined in section 222 of the Communications\nAct of 1934 (47 U.S.C. 222).\n``(B) Functions described.--The functions described\nin this subparagraph are the following:\n``(i) Processing and analyzing 9-1-1\nrequests for emergency assistance and\ninformation and data related to such requests.\n``(ii) Dispatching appropriate emergency\nresponse providers.\n``(iii) Transferring or exchanging 9-1-1\nrequests for emergency assistance and\ninformation and data related to such requests\nwith one or more other emergency communications\ncenters and emergency response providers.\n``(iv) Analyzing any communications\nreceived from emergency response providers.\n``(v) Supporting incident command\nfunctions.\n``(8) Emergency response provider.--The term `emergency\nresponse provider' has the meaning given that term under\nsection 2 of the Homeland Security Act of 2002 (6 U.S.C. 101).\n``(9) First responder network authority.--The term `First\nResponder Network Authority' means the authority established\nunder section 6204 of the Middle Class Tax Relief and Job\nCreation Act of 2012 (47 U.S.C. 1424).\n``(10) Interoperability.--The term `interoperability' means\nthe capability of emergency communications centers to receive\n9-1-1 requests for emergency assistance and information and\ndata related to such requests, such as location information and\ncallback numbers from a person initiating the request, then\nprocess and share the 9-1-1 requests for emergency assistance\nand information and data related to such requests with other\nemergency communications centers and emergency response\nproviders without the need for proprietary interfaces and\nregardless of jurisdiction, equipment, device, software,\nservice provider, or other relevant factors.\n``(11) Nationwide public safety broadband network.--The\nterm `nationwide public safety broadband network' has the\nmeaning given the term in section 6001 of the Middle Class Tax\nRelief and Job Creation Act of 2012 (47 U.S.C. 1401).\n``(12) Next generation 9-1-1.--The term `Next Generation 9-\n1-1' means an Internet Protocol-based system that--\n``(A) ensures interoperability;\n``(B) is secure;\n``(C) employs commonly accepted standards;\n``(D) enables emergency communications centers to\nreceive, process, and analyze all types of 9-1-1\nrequests for emergency assistance;\n``(E) acquires and integrates additional\ninformation useful to handling 9-1-1 requests for\nemergency assistance; and\n``(F) supports sharing information related to 9-1-1\nrequests for emergency assistance among emergency\ncommunications centers and emergency response\nproviders.\n``(13) Reliability.--The term `reliability' means the\nemployment of sufficient measures to ensure the ongoing\noperation of Next Generation 9-1-1 including through the use of\ngeo-diverse, device- and network-agnostic elements that provide\nmore than one route between end points with no common points\nwhere a single failure at that point would cause all to fail.\n``(14) State.--The term `State' means any State of the\nUnited States, the District of Columbia, Puerto Rico, American\nSamoa, Guam, the United States Virgin Islands, the Northern\nMariana Islands, and any other territory or possession of the\nUnited States.\n``(15) Sustainable funding mechanism.--The term\n`sustainable funding mechanism' means a funding mechanism that\nprovides adequate revenues to cover ongoing expenses, including\noperations, maintenance, and upgrades.\n``(16) Tribe.--The term `Tribe' has the meaning given to\nthe term `Indian Tribe' in section 4(e) of the Indian Self-\nDetermination and Education Assistance Act (25 U.S.C. 5304(e)).\n\n``SEC. 160. ESTABLISHMENT OF NATIONWIDE NEXT GENERATION 9-1-1\nCYBERSECURITY CENTER.\n\n``The Assistant Secretary, after consulting with the Administrator\nand the Director of the Cybersecurity and Infrastructure Security\nAgency of the Department of Homeland Security, shall establish a Next\nGeneration 9-1-1 Cybersecurity Center to coordinate with State, local,\nand regional governments on the sharing of cybersecurity information\nabout, the analysis of cybersecurity threats to, and guidelines for\nstrategies to detect and prevent cybersecurity intrusions relating to\nNext Generation 9-1-1.\n\n``SEC. 161. NEXT GENERATION 9-1-1 ADVISORY BOARD.\n\n``(a) Next Generation 9-1-1 Advisory Board.--\n``(1) Establishment.--The Assistant Secretary shall\nestablish a `Public Safety Next Generation 9-1-1 Advisory\nBoard' (in this section referred to as the `Board') to provide\nrecommendations to the Assistant Secretary--\n``(A) with respect to carrying out the duties and\nresponsibilities of the Assistant Secretary in issuing\nthe regulations required under section 159(c);\n``(B) as required by paragraph (7); and\n``(C) upon request under paragraph (8).\n``(2) Membership.--\n``(A) Voting members.--Not later than 150 days\nafter the date of the enactment of this section, the\nAssistant Secretary shall appoint 16 public safety\nmembers to the Board, of which--\n``(i) 4 members shall represent local law\nenforcement officials;\n``(ii) 4 members shall represent fire and\nrescue officials;\n``(iii) 4 members shall represent emergency\nmedical service officials; and\n``(iv) 4 members shall represent 9-1-1\nprofessionals.\n``(B) Diversity of membership.--Members shall be\nrepresentatives of States or Tribes and local\ngovernments, chosen to reflect geographic and\npopulation density differences as well as public safety\norganizations at the national level across the United\nStates.\n``(C) Expertise.--All members shall have specific\nexpertise necessary for developing technical\nrequirements under this section, such as technical\nexpertise, and expertise related to public safety\ncommunications and 9-1-1 services.\n``(D) Rank and file members.--In making the\nappointments required by subparagraph (A), the\nAssistant Secretary shall appoint a rank and file\nmember from each of the public safety disciplines\nlisted in clauses (i) through (iv) of subparagraph (A)\nas a member of the Board and shall select such member\nfrom an organization that represents its public safety\ndiscipline at the national level.\n``(3) Period of appointment.--\n``(A) In general.--Except as provided in\nsubparagraph (B), members of the Board shall serve for\na 3-year term.\n``(B) Removal for cause.--A member of the Board may\nbe removed for cause upon the determination of the\nAssistant Secretary.\n``(4) Vacancies.--Any vacancy in the Board shall be filled\nin the same manner as the original appointment.\n``(5) Quorum.--A majority of the members of the Board shall\nconstitute a quorum.\n``(6) Chairperson and vice chairperson.--The Board shall\nselect a Chairperson and Vice Chairperson from among the voting\nmembers of the Board.\n``(7) Duty of board to submit recommendations.--Not later\nthan 120 days after all members of the Board are appointed\nunder paragraph (2), the Board shall submit to the Assistant\nSecretary recommendations for--\n``(A) deploying Next Generation 9-1-1 in rural and\nurban areas;\n``(B) ensuring flexibility in guidance, rules, and\ngrant funding to allow for technology improvements;\n``(C) creating efficiencies related to Next\nGeneration 9-1-1, including cybersecurity and the\nvirtualization and sharing of core infrastructure;\n``(D) enabling effective coordination among State,\nlocal, Tribal, and territorial government entities to\nensure that the needs of emergency communications\ncenters in both rural and urban areas are taken into\naccount in each implementation plan required under\nsection 159(c)(3)(A)(iii); and\n``(E) incorporating existing cybersecurity\nresources into Next Generation 9-1-1 procurement and\ndeployment.\n``(8) Authority to provide additional recommendations.--\nExcept as provided in paragraphs (1) and (7), the Board may\nprovide recommendations to the Assistant Secretary only upon\nrequest of the Assistant Secretary.\n``(9) Duration of authority.--The Board shall terminate on\nthe date on which funds made available to make grants under\nsection 159(c) are no longer available to be expended.\n``(b) Rule of Construction.--Nothing in this section may be\nconstrued as limiting the authority of the Assistant Secretary to seek\ncomment from stakeholders and the public.\n\n``SEC. 162.
