Such technologies may incorporate artificial intelligence, machine-learning, automation, fiber-optic sensing technology, nanotechnology, optical and cognitive radar, modeling and simulation technology, hyperspectral and LIDAR sensors, and imaging, identification, and categorization systems.\nThe bill authorizes CBP to establish one or more Innovation Teams to research and adapt commercial technologies that may be used by CBP.\nThe plan must describe how the Innovation Teams have been implemented and also detail\ngoals and timelines for adoption of qualifying technologies,\nmetrics and key performance parameters for determining the plan's effectiveness,\nwhich technologies used by other federal agencies CBP may also utilize,\nwhich existing authorities CBP may use to procure technologies,\nhow CBP legacy border technology programs may be replaced,\nthe expected privacy and security impact of security-related technology on border communities, and\nrecent technological advancements in specified technologies.\nCBP must provide the plan to Congress within 180 days of the bill’s enactment. Commissioner of U.S. Customs and Border Protection (CBP)\nand the Under Secretary for Science and Technology of the Department of\nHomeland Security, shall submit to the Committee on Homeland Security\nof the House of Representatives and the Committee on Homeland Security\nand Governmental Affairs of the Senate a plan to identify, integrate,\nand deploy new, innovative, disruptive, or other emerging or advanced\ntechnologies that may incorporate artificial intelligence, machine-\nlearning, automation, fiber-optic sensing technology, nanotechnology,\noptical and cognitive radar, modeling and simulation technology,\nhyperspectral and LIDAR sensors, imaging, identification, and\ncategorization systems, or other emerging or advanced technologies, to\nenhance, or address capability gaps in, border security operations.\n(b) Contents.--The plan required under subsection (a) shall include\nthe following:\n(1) Information regarding how CBP utilizes CBP Innovation\nTeam authority under subsection (c) and other mechanisms to\ncarry out the purposes specified in subsection (a).\n(2) An assessment of the contributions directly\nattributable to such utilization.\n(3) Information regarding the composition of each CBP\nInnovation Team, and how each such Team coordinates and\nintegrates efforts with the CBP acquisition program office and\nother partners within CBP and the Department of Homeland\nSecurity.\n(4) Identification of technologies used by other Federal\ndepartments or agencies not in use by CBP that could assist in\nenhancing, or addressing capability gaps in, border security\noperations.\n(5) An analysis of authorities available to CBP to procure\ntechnologies referred to subsection (a), and an assessment as\nto whether additional or alternative authorities are needed to\ncarry out the purposes specified in such subsection.\n(6) An explanation of how CBP plans to scale existing\nprograms related to emerging or advanced technologies into\nprograms of record.\n(7) A description of each planned security-related\ntechnology program, including objectives, goals, and timelines\nfor each such program.\n(8) An assessment of the privacy and security impact on\nborder communities of security-related technology.\n(9) An assessment of CBP legacy border technology programs\nthat could be phased out and replaced by technologies referred\nto in subsection (a), and cost estimates relating to such phase\nout and replacement.\n(10) Information relating to how CBP is coordinating with\nthe Department of Homeland Security's Science and Technology\nDirectorate to carry out the following:\n(A) Research and develop new, innovative,\ndisruptive, or other emerging or advanced technologies\nto carry out the purposes specified in subsection (a).\n(B) Identify security-related technologies that are\nin development or deployed by the private and public\nsectors that may satisfy the mission needs of CBP, with\nor without adaptation.\n(C) Incentivize the private sector to develop\ntechnologies that may help CBP meet mission needs to\nenhance, or address capability gaps in, border security\noperations.\n(D) Identify and assess ways to increase\nopportunities for communication and collaboration with\nthe private sector, small and disadvantaged businesses,\nintra-governmental entities, university centers of\nexcellence, and Federal laboratories to leverage\nemerging technology and research within the public and\nprivate sectors.\n(11) Information on metrics and key performance parameters\nfor evaluating the effectiveness of efforts to identify,\nintegrate, and deploy new, innovative, disruptive, or other\nemerging or advanced technologies to carry out the purposes\nspecified in subsection (a).\n(12) An identification of recent technological advancements\nin the following:\n(A) Manned aircraft sensor, communication, and\ncommon operating picture technology.\n(B) Unmanned aerial systems and related technology,\nincluding counter-unmanned aerial system technology.\n(C) Surveillance technology, including the\nfollowing:\n(i) Mobile surveillance vehicles.\n(ii) Associated electronics, including\ncameras, sensor technology, and radar.\n(iii) Tower-based surveillance technology.\n(iv) Advanced unattended surveillance\nsensors.\n(v) Deployable, lighter-than-air, ground\nsurveillance equipment.\n(D) Nonintrusive inspection technology, including\nnon-X-ray devices utilizing muon tomography and other\nadvanced detection technology.\n(E) Tunnel detection technology.\n(F) Communications equipment, including the\nfollowing:\n(i) Radios.\n(ii) Long-term evolution broadband.\n(iii) Miniature satellites.\n(13) Any other information the Secretary determines\nrelevant.\n(c) CBP Innovation Team Authority.--\n(1) In general.--The Commissioner of CBP is authorized to\nmaintain one or more CBP Innovation Teams to research and adapt\ncommercial technologies that are new, innovative, disruptive,\nor otherwise emerging or advanced that may be used by CBP to\nenhance, or address capability gaps in, border security\noperations and urgent mission needs, and assess potential\noutcomes, including any negative consequences, of the\nintroduction of emerging or advanced technologies with respect\nto which documented capability gaps in border security\noperations are yet to be determined.\n(2) Operating procedures, planning, strategic goals.--The\nCommissioner of CBP shall require each team maintained pursuant\nto paragraph (1) to establish the following:\n(A) Operating procedures that include specificity\nregarding roles and responsibilities within each such\nteam and with respect to Department of Homeland\nSecurity and non-Federal partners, and protocols for\nentering into agreements to rapidly transition such\ntechnologies to existing or new programs of record to\ncarry out the purposes specified in subsection (a).\n(B) Planning and strategic goals for each such team\nthat includes projected costs, time frames, metrics,\nand key performance parameters relating to the\nachievement of identified strategic goals, including a\nmetric to measure the rate at which technologies\ndescribed in subsection (a) are transitioned to\nexisting or new programs of record in accordance with\nsubparagraph (A).\n(3) Reporting.--Not later than 180 days after the date of\nthe enactment of this Act and annually thereafter, the\nCommissioner of CBP shall submit to the Committee on Homeland\nSecurity of the House of Representatives and the Committee on\nHomeland Security and Governmental Affairs of the Senate\ninformation relating to the activities of CBP Innovation Teams,\nincluding information regarding the following:\n(A) Copies of operating procedures and protocols\nunder paragraph (2)(A) and planning and strategic goals\nrequired under paragraph (2)(B).\n(B) Descriptions of the technologies piloted by\neach such team over the immediately preceding fiscal\nyear, including information regarding which such\ntechnologies are determined successful and an\nidentification of documented capability gaps that are\naddressed.\n(C) Information on the
