SHORT TITLE.\n\nThis Act may be cited as the ``Federal Improvement in Technology\nProcurement Act'' or the ``FIT Procurement Act''.\n\nSEC. 2. DEFINITIONS.\n\nIn this Act:\n(1) Acquisition workforce.--The term ``acquisition\nworkforce'' means employees of an executive agency who are\nresponsible for procurement, contracting, or program or project\nmanagement that involves the performance of acquisition-related\nfunctions or other employees as designated by the Chief\nAcquisition Officer, senior procurement executive, or head of\nthe contracting activity.\n(2) Administrator.--The term ``Administrator'' means the\nAdministrator for Federal Procurement Policy.\n(3) Chief acquisition officer.--The term ``Chief\nAcquisition Officer'' means a Chief Acquisition Officer\nappointed pursuant to section 1702(a) of title 41, United\nStates Code.\n(4) Cross-functional.--The term ``cross-functional'' means\na structure in which individuals with different functional\nexpertise or from different areas of an organization work\ntogether as a team.\n(5) Executive agency.--The term ``executive agency'' has\nthe meaning given that term in section 133 of title 41, United\nStates Code.\n(6) Experiential learning.--The term ``experiential\nlearning'' means on-the-job experiences or simulations that\nserve to enhance workforce professional skills.\n(7) Information and communications technology.--The term\n``information and communications technology''--\n(A) has the meaning given that term in section\n4713(k) of title 41, United States Code; and\n(B) includes information and communications\ntechnologies covered by any definition contained in the\nFederal Acquisition Regulation, including a definition\nadded after the date of the enactment of this Act by\nthe Federal Acquisition Regulatory Council pursuant to\nnotice and comment.\n(8) Relevant committees of congress.--The term ``relevant\ncommittees of Congress'' means the Committee on Homeland\nSecurity and Governmental Affairs of the Senate and the\nCommittee on Oversight and Government Reform of the House of\nRepresentatives.\n(9) Senior procurement executive.--The term ``senior\nprocurement executive'' means a senior procurement executive\ndesignated pursuant to section 1702(c)(1) of title 41, United\nStates Code.\n(10) Small business.--The term ``small business'' has the\nmeaning given the term ``small business concern'' in section 3\nof the Small Business Act (15 U.S.C. 632).\n\nSEC. 3. ACQUISITION WORKFORCE.\n\n(a) Experiential Learning.--Not later than 18 months after the date\nof the enactment of this Act, the Director of the Federal Acquisition\nInstitute may establish a pilot program to consider the incorporation\nof experiential learning into the Federal Credentials Program, the\nFederal Acquisition Certification for Contracting Officer's\nRepresentatives program, the Federal Acquisition Certification for\nProgram and Project Managers program, or any successor program.\n(b) Training on Information and Communications Technology\nAcquisition.--\n(1) In general.--Not later than 18 months after the date of\nthe enactment of this Act, the Director of the Federal\nAcquisition Institute, in coordination with the Administrator,\nthe Administrator of General Services, and the Administrator of\nthe Office of Electronic Government, and in consultation with\nthe heads of other executive agencies as determined to be\nappropriate by the Director of the Federal Acquisition\nInstitute, may develop and implement or otherwise provide a\ncross-functional information and communications technology\nacquisition training program for members of the acquisition\nworkforce involved in acquiring information and communications\ntechnology that shall do the following:\n(A) Include learning objectives related to the\nfollowing:\n(i) Market research.\n(ii) Communicating with and considering\nindustry perspectives on the procurement\nprocess, including how investment decisions are\nimpacted by Government communication and\nengagement.\n(iii) Developing requirements, acquisition\nplanning, best practices for developing and\nexecuting outcome-based contracts, and source\nselection strategy.\n(iv) Evaluating proposals.\n(v) Awarding and administering contracts\nfor information and communications technology.\n(B) Include learning objectives that provide a\nbasic understanding of key technologies that executive\nagencies need, such as cloud computing, artificial\nintelligence and artificial intelligence-enabled\napplications, and cybersecurity solutions.\n(C) Include learning objectives that encourage the\nuse of commercial or commercially available off-the-\nshelf technologies to the greatest extent practicable.\n(D) Include case studies of lessons learned from\nFederal information and communications technology\nprocurements and contracts, and related matters as\ndetermined to be relevant by the Director of the\nFederal Acquisition Institute.\n(E) Include experiential learning opportunities and\nopportunities to practice collaborative acquisition\nstrategies involving team members with varied relevant\ndomain expertise to complete acquisition-related tasks,\nincluding tasks with accelerated timelines.\n(F) Include continuous learning recommendations and\nresources to keep the skills of members of the\nacquisition workforce current, including tools that\nhelp adopt or adapt the use of innovative acquisition\npractices or other flexible business practices commonly\nused in commercial buys.\n(G) Be made available to members of the acquisition\nworkforce designated by a Chief Acquisition Officer,\nsenior procurement executive, or head of the\ncontracting activity to participate in the training\nprogram.\n(H) Inform executive agencies about streamlined and\nalternative procurement methods for the procurement of\ninformation and communications technology, including\nthe following:\n(i) Simplified procedures for certain\ncommercial products and commercial services in\naccordance with subpart 13.5 of the Federal\nAcquisition Regulation, prize competitions\nunder the America COMPETES Reauthorization Act\nof 2010 (Public Law 111-358), competitive\nprograms that encourage businesses to engage in\nFederal research or research and development\nwith the potential for commercialization, and\njoint venture partnerships.\n(ii) Innovative procurement techniques\ndesigned to streamline the procurement process\nand lower barriers to entry, such as the use of\noral presentations and product demonstrations\ninstead of lengthy written proposals,\nappropriately leveraging performance and\noutcomes-based contracting, and other\ntechniques discussed on the Periodic Table of\nAcquisition Innovations or other similar\nsuccessor knowledge management portals.\n(iii) Information on appropriate use,\nexamples and templates, and any other\ninformation determined relevant by the\nAdministrator to assist contracting officers\nand other members of the acquisition workforce\nin using the procedures and techniques\ndescribed in clauses (i) and (ii).\n(I) Incorporate learning objectives to identify and\nmitigate waste, fraud, and abuse and ensure the\nprotection of established privacy rights, civil rights,\nand civil liberties in the procurement process.\n(2) Report.--Not later than 2 years after the date of the\nenactment of this Act, the Director of the Federal Acquisition\nInstitute shall provide to the relevant committees of Congress,\nthe Chief Acquisition Officers Council, and the Chief\nInformation Officers Council--\n(A) a report on the progress of the Director in\ndeveloping and implementing or otherwise providing the\ntraining program described in paragraph (1); and\n(B) a list of any acquisition training that the\nDirector determines to be outdated or no longer\nnecessary.\n(3) Duration.--The training program described in paragraph\n(1) may be updated as appropriate (but not less frequently than\nonce every 2 years after implementation), and offered not less\nthan 6 years following the date of implementation of the\ntraining program.\n(c) Acquisition Workforce Training Fund.--Section 1703(i)(3) of\ntitle 41, United States Code, is amended by striking ``Five percent''\nand inserting ``Seven and a half percent''.\n(d) Harmonization of Acquisition Workforce Training Requirements.--\nSection 2 of the Artificial Intelligence Training for the Acquisition\nWorkforce Act (Public Law 117-207; 41 U.S.C. 1703 note) is amended--\n(1) in subsection (a)(4), by striking ``Director.--The term\n`Director' means the Director of the Office of Management and\nBudget.'' and inserting ``Administrator.--The term\n`Administrator' means the Administrator of General Services.'';\nand\n(2) in subsection (b)--\n(A) in paragraph (1), by striking ``Director, in\ncoordination with the Administrator of General Services\nand any other person determined relevant by the\nDirector'' and inserting ``Administrator, in\ncoordination with the Director of the Office of\nManagement and Budget'';\n(B) in paragraph (4), by striking ``Director'' and\ninserting ``Administrator'';\n(C) in paragraph (5), by striking ``Director'' and\ninserting ``Administrator''; and\n(D) in paragraph (6), by striking ``Director'' and\ninserting ``Administrator''.\n\nSEC. 4. INNOVATIVE PROCUREMENT METHODS.\n\n(a) Increase in Simplified Acquisition Threshold.--Section 134 of\ntitle 41, United States Code, is amended by striking ``$250,000'' and\ninserting ``$500,000''.\n(b) Simplified Procedures for Small Purchases.--Section 1901(a)(2)\nof title 41, United States Code, is amended by striking ``$5,000,000''\nand inserting ``$10,000,000''.\n(c) Increase in Micro Purchase Threshold.--Section 1902(a)(1) of\ntitle 41, United States Code, is amended by striking ``$10,000'' and\ninserting ``$25,000''.\n(d) Advances for Commercial Technology Subscriptions and Tenancy.--\nSection 3324(d) of title 31, United States Code, is amended--\n(1) in paragraph (1)(C), by striking ``; and'' and\ninserting a semicolon;\n(2) in paragraph (2)--\n(A) by inserting ``or commercially available\ncontent'' after ``publication''; and\n(B) by striking the period at the end and inserting\n``; and''; and\n(3) by adding at the end the following new paragraph:\n``(3) charges for information and communications technology\nsubscriptions, reservations, or tenancy, which means the\nsharing of computing resources in a private or public\nenvironment, including cloud environments, for which the\nordering agency defines appropriate access and security\nstandards.''.\n\nSEC. 5. ADJUSTMENTS TO CERTAIN ACQUISITION THRESHOLDS.\n\n(a) Major Program.--Section 109 of title 41, United States Code, is\namended--\n(1) in subsection (b)(1)--\n(A) by striking ``$75,000,000 (based on fiscal year\n1980 constant dollars)'' and inserting ``$275,000,000\n(based on fiscal year 2024 dollars)''; and\n(B) by striking ``$300,000,000 (based on fiscal\nyear 1980 constant dollars)'' and inserting\n``$1,300,000,000 (based on fiscal year 2024 dollars)'';\nand\n(2) in subsection (b)(2), by striking ``$750,000 (based on\nfiscal year 1980 constant dollars)'' and inserting ``$2,000,000\n(based on fiscal year 2024 dollars)''.\n(b) Modifications to Submissions of Cost or Pricing Data.--Section\n3502(a) of title 41, United States Code, is amended--\n(1) in paragraph (1)--\n(A) by striking ``2018'' each place it appears and\ninserting ``2026'';\n(B) in subparagraph (A), by striking ``$2,000,000''\nand inserting ``$10,000,000''; and\n(C) in subparagraph (B), by striking ``$750,000''\nand inserting ``$2,000,000'';\n(2) in paragraph (2)--\n(A) in subparagraph (A), by striking ``$2,000,000''\nand inserting ``$10,000,000'';\n(B) in subparagraph (B), by striking ``$750,000''\nand inserting ``$2,000,000''; and\n(C) in subparagraph (C), by striking ``$750,000''\nand inserting ``$2,000,000''; and\n(3) in paragraph (3), by striking ``chapter and--'' and all\nthat follows and inserting the following: ``chapter and--\n``(A) in the case of a prime contract entered into\nafter June 30, 2026, the price of the subcontract is\nexpected to exceed $10,000,000; or\n``(B) in the case of a prime contract entered into\non or before June 30, 2026, the price of the\nsubcontract is expected to exceed $2,000,000.''.\n\nSEC. 6. INCREASING COMPETITION IN FEDERAL CONTRACTING.\n\n(a) Use of Past Performance.--\n(1) In general.--Not later than 1 year after the date of\nthe enactment of this Act, the Administrator shall issue\nguidance, including examples and templates where appropriate,\non the following:\n(A) When a wider range of projects, including\ncommercial, non-government, and Government projects,\nshould be accepted as relevant past performance in\norder to have increased competition among eligible\nfirms with capability to perform a requirement, such as\na requirement without much precedent.\n(B) A means by which an agency may validate non-\ngovernment past performance references, such as by\nrequiring an official of an entity that provides past\nperformance references to attest to their authenticity\nand by providing verifiable contact information for the\nreferences.\n(C) Any use of alternative evaluation methods other\nthan past performance that may be appropriate for a\nrequirement without much precedent, such as\ndemonstrations and testing of technologies as part of\nthe proposal process.\n(2) Supplement not supplant.--The guidance required by\nparagraph (1) shall supplement existing Federal and agency\npolicy and procedures for consideration of past performance and\nother evaluation factors and methods.\n(b) Enhancing Competition in Federal Procurement.--\n(1) Council recommendations.--Not later than 90 days after\nthe date of the enactment of this Act, the Administrator shall\nconvene the Chief Acquisition Officers Council (in this\nsubsection referred to as the ``Council'') to make\nrecommendations to identify and eliminate specific, unnecessary\nprocedural barriers that disproportionately affect the ability\nof small businesses to compete for Federal contracts, with a\nfocus on streamlining documentation and qualification\nrequirements unrelated to the protection of privacy rights and\ncivil liberties.\n(2) Consultation.--The Council shall obtain input from the\npublic, including from the APEX Accelerators program (formerly\nknown as Procurement Technical Assistance Center network) and\nother contractor representatives, to identify Federal\nprocurement policies and regulations that are obsolete, overly\nburdensome or restrictive, not adequately harmonized, or\notherwise serve to create barriers to the participation of\nsmall businesses in Federal contracting or unnecessarily\nincrease bid and proposal costs.\n(3) Examination of actions.--The Council shall consider the\ninput obtained under paragraph (2) and any other information\ndetermined relevant by the Council to identify legislative,\nregulatory, and other actions to increase competition and\nremove barriers to the participation of small businesses in\nFederal contracting.\n(4) Implementation.--Not later than 2 years after the date\nof the enactment of this Act, the Administrator, in\nconsultation with the Federal Acquisition Regulatory Council,\nthe Council, and other executive agencies as appropriate, shall\nimplement the regulatory and other non-legislative actions\nidentified under paragraph (3), as determined necessary by the\nAdministrator, to remove barriers to entry for small businesses\nseeking to participate in Federal contracting.\n(5) Briefing.--Not later than 2 years after the date of the\nenactment of this Act, the Administrator shall brief the\nrelevant committees of Congress on the legislative actions\nidentified under paragraph (3) and the actions implemented\nunder paragraph (4).\n(c) Consideration of Cost-efficiency and Quality.--The\nAdministrator shall advocate for and prioritize contracting policies\nthat ensure that cost-efficiency and quality of goods and services are\nkey determining factors in awarding Federal contracts.\n\nSEC. 7. COMPTROLLER GENERAL ASSESSMENT OF SMALL BUSINESS PARTICIPATION\nIN FEDERAL PROCUREMENT.\n\nNot later than 18 months after the date of the enactment of this\nAct, the Comptroller General of the United States shall submit to the\nrelevant committees of Congress and make publicly available a report\nthat does the following:\n(1) Assesses the level of participation by small businesses\nin Federal procurement.\n(2) Identifies barriers and opportunities and the impact of\npolicies on the ability of small businesses to compete in\nFederal procurement.\n(3) Catalogs and evaluates the effectiveness of programs\nintended to support the participation of small businesses in\nFederal procurement.\n(4) Analyzes trends in the involvement of small businesses\nin Federal technology projects, including data on contract\nawards, the diversity of sectors represented, and the\ngeographic distribution of small business contractors.\n\nSEC. 8. CONFLICT OF INTEREST PROCEDURES.\n\nThe Federal Acquisition Regulatory Council and the Administrator\nshall update the Federal Acquisition Regulation as necessary to provide\nadditional guidance to executive agencies to address personal and\norganizational conflicts of interest involving members of the\nacquisition workforce.\n\nSEC. 9.
