SHORT TITLE.\n\nThis Act may be cited as the ``Auto Data Privacy and Autonomy\nAct''.\n\nSEC. 2. DEFINITIONS.\n\nIn this Act:\n(1) Commission.--The term ``Commission'' means the Federal\nTrade Commission.\n(2) Covered data.--The term ``covered data'' means user\ndata and vehicle-generated data.\n(3) Covered vehicle.--The term ``covered vehicle'' means a\nmotor vehicle or a vehicle primarily used for farming or\nconstruction.\n(4) Geolocation data.--The term ``geolocation data'' means\ninformation that reveals the past or present physical location\nof an individual, a covered vehicle, or device.\n(5) Motor vehicle.--The term ``motor vehicle'' has the same\nmeaning given such term in section 30102(a) of title 49, United\nStates Code, and includes a motor vehicle trailer.\n(6) Personally identifiable information.--The term\n``personally identifiable information'' means information\nthat--\n(A) directly identifies an individual such as the\nname, address, social security number or other\nidentifying number or code, telephone number, or email\naddress of an individual;\n(B) indirectly identifies an individual such as the\ngender, race, or date of birth of an individual; or\n(C) reveals the geolocation data or internet\nactivity of an individual.\n(7) User data.--The term ``user data'' means data\ntransferred to a covered vehicle by the owner or user of such\nvehicle.\n(8) User preference.--The term ``user preference'' means\nany choice with respect to a configurable setting of a covered\nvehicle made by or for the benefit of the owner or user of such\ncovered vehicle.\n(9) Vehicle-generated data.--The term ``vehicle-generated\ndata'' means all electronic data generated or processed onboard\na covered vehicle, such as data generated by sensors,\nreceivers, computer processing units, or other vehicle\ncomponents and includes the geolocation data of such covered\nvehicle.\n\nSEC. 3. USER DATA AND VEHICLE-GENERATED DATA PRIVACY AND SECURITY.\n\n(a) Prohibition on Manufacturers.--With respect to a covered\nvehicle, a manufacturer of such vehicle may not--\n(1) access covered data, unless--\n(A) the owner of such covered vehicle or, in the\nevent of the death or incapacity of such owner, the\nnext of kin of such owner affirmatively consents to\nsuch manufacturer accessing such data and such\nconsent--\n(i) is freely given;\n(ii) is informed, specific, and\nunambiguous;\n(iii) is in writing; and\n(iv) may be easily withdrawn; or\n(B) such data is accessed solely to improve covered\nvehicle performance or safety;\n(2) sell, lease, or otherwise share covered data, unless--\n(A) required to do so--\n(i) pursuant to a lawfully executed\nwarrant;\n(ii) pursuant to a court order that\nprovides the covered vehicle owner notice of\nthe order and at least 48 hours to object and\nrequest a hearing; or\n(iii) to facilitate an emergency response;\nor\n(B) the owner of such covered vehicle, or, in the\nevent of the death or incapacity of such owner, the\nnext of kin of such owner, affirmatively consents to\nsuch manufacturer to do so and such consent--\n(i) is freely given;\n(ii) is informed, specific, and\nunambiguous;\n(iii) is in writing; and\n(iv) may be easily withdrawn; or\n(3) sell, license, rent, trade, transfer, release,\ndisclose, provide access to, or otherwise make available\npersonally identifiable information of a United States citizen\nor lawful permanent resident to the following:\n(A) The Democratic People's Republic of Korea.\n(B) The People's Republic of China.\n(C) The Russian Federation.\n(D) The Islamic Republic of Iran.\n(E) The Bolivarian Republic of Venezuela.\n(b) Report.--Not later than 180 days after the date of the\nenactment of this Act, the Commission shall, in consultation with the\nAttorney General, the Secretary of Homeland Security, the Secretary of\nTransportation, and the Federal Communications Commission, submit to\nCongress a report that describes with respect to covered data--\n(1) the types of such data that a manufacturer of a covered\nvehicle accesses;\n(2) the individuals and entities, other than a manufacturer\nof a covered vehicle, that access such data;\n(3) the Federal or State Government entities that access\nsuch data and how such entities use such data;\n(4) the individuals and entities to whom such data may be\nsold or otherwise shared;\n(5) the foreign governments to whom such data may be sold\nor otherwise shared and how such data is used by such foreign\ngovernments;\n(6) the cybersecurity capabilities and risks associated\nwith covered vehicles;\n(7) occurrences of such data being compromised, including\nthe prevalence of such occurrences and any entities with ties\nto foreign governments associated with such occurrences; and\n(8) a description of the feasibility of a technology-\nneutral, standards-based, secure interface to allow an owner of\na covered vehicle access to such data designed without\npreference or prejudice towards any technology or service used\nto access and control such data by such owner, and not\ncontingent on ownership or licensing of proprietary\ntechnologies by such owner or a manufacturer of a covered\nvehicle.\n\nSEC. 4. VEHICLE OWNER'S DATA ACCESS AND CONTROL.\n\n(a) In General.--The manufacturer of a covered vehicle shall\nprovide to an owner of such vehicle access to, and control of, all\ncovered data generated or processed onboard, or transferred to, such\nvehicle--\n(1) at no cost beyond the purchase price of such vehicle;\n(2) in real time;\n(3) without any restriction or limitation on use or\nauthorizing access to third parties;\n(4) without a requirement that the covered vehicle owner\npay a fee or purchase a license to decrypt such data or use a\ndevice provided by such manufacturer to access and use such\ndata;\n(5) through the vehicle's interface port and through\nwireless transmission of such data to the extent such vehicle\nis equipped with technology to wirelessly transmit such data;\nand\n(6) in a manner that enables the operation of an open\napplication programming interface that--\n(A) facilitates deletion of all user data stored in\na covered vehicle; and\n(B) enables the setting of any user preference by\nthe covered vehicle owner or another user of the\ncovered vehicle.\n(b) Relation to Other Laws.--This section supersedes any statute,\nrule, requirement or other legal obligation of a State of political\nsubdivision thereof that relates to the requirements of this section.\n\nSEC. 5. ENFORCEMENT.\n\n(a) Unfair or Deceptive Act or Practice.--A violation of this Act\nshall be treated as a violation of a rule defining an unfair or\ndeceptive act or practice under section 18(a)(1)(B) of the Federal\nTrade Commission Act (15 U.S.C. 57a(a)(1)(B)).\n(b) Powers of the Commission.--\n(1) In general.--The Commission shall enforce this Act in\nthe same manner, by the same means, and with the same\njurisdiction, powers, and duties as though all applicable terms\nand provisions of the Federal Trade Commission Act (15 U.S.C.\n41 et seq.) were incorporated into and made a part of this Act.\n(2) Privileges and immunities.--Any person who violates\nthis Act shall be subject to the penalties and entitled to the\nprivileges and immunities provided in the Federal Trade\nCommission Act (15 U.S.C. 41 et seq.).\n(3) Authority preserved.--Nothing in this Act shall be\nconstrued to limit the authority of the Commission under any\nother provision of law.\n\nSEC. 6. DISCLOSURE OF CONFIDENTIAL BUSINESS INFORMATION.\n\nExcept as provided in section 4, nothing in this Act shall require\na manufacturer of a covered vehicle to divulge confidential business\ninformation (as that term is defined in section 512.3(c) of title 49,\nCode of Federal Regulations).\n\nSEC. 7. EFFECTIVE DATE.\n\nThis Act shall take effect on the date that is 3 months after the\ndate of enactment of this Act.\n\nSEC. 8. NO NEW APPROPRIATIONS.\n\nNo additional funds are authorized to be appropriated to carry out\nthis Act.
