SHORT TITLE.\n\nThis Act may be cited as the ``Governing Underage Access and\nRequiring Data Consent In All Networks Act'' or the ``GUARDIAN Act''.\n\nSEC. 2. DEFINITIONS.\n\nIn this Act:\n(1) Commission.--The term ``Commission'' means the Federal\nTrade Commission.\n(2) Covered platform.--The term ``covered platform'' means\na platform that is a website, software, application, or\nelectronic service connected to the internet that meets the\nfollowing requirements:\n(A) Is publicly available for use by consumers.\n(B) Enables the creation of a username or user\nidentifier--\n(i) that is searchable on the platform by\nother users through a function made available\nby the platform; and\n(ii) that can be followed by or is\nsimilarly accessible to other users of the\nplatform.\n(C) As the primary purpose of the platform,\nfacilitates the sharing and access to user-generated\ncontent through text, images, video, audio, or any\nother interactive medium.\n(D) Uses a design feature to promote user\nengagement on the platform.\n(E) Uses the personal information of the user to\nadvertise, market, or make content recommendations.\n(3) Covered minor.--\n(A) The term ``covered minor'' means a user who the\nprovider of a covered online platform knows or should\nhave known is under the age of 16.\n(B) Notwithstanding subparagraph (A), an individual\nwho is under the age of 16 and is emancipated from a\nparent is not a covered minor.\n(4) Design feature.--The term ``design feature''--\n(A) means any feature or component of a covered\nplatform that encourages an increase in or increases\nthe frequency of use or time spent by a user who is a\ncovered minor with respect to such covered platform;\nand\n(B) includes--\n(i) infinite scrolling or auto play;\n(ii) rewards or incentives based on\nfrequency of use or time spent;\n(iii) notifications and push alerts;\n(iv) badges or other visual award symbols\nbased on frequency of use or time spent;\n(v) appearance altering filters; and\n(vi) personalized recommendation systems.\n(5) Fully automated system.--The term ``fully automated\nsystem'' means an algorithm the final outputs of which are,\nonce computed, displayed directly to a covered minor without\nreview or alteration by a covered platform.\n(6) Parent.--The term ``parent'', with respect to a minor,\nmeans an adult with the legal right to make decisions on behalf\nof the minor, including any of the following:\n(A) A natural parent.\n(B) An adoptive parent.\n(C) A legal guardian.\n(D) An individual with legal custody over the\nminor.\n(7) Personal data.--The term ``personal data'' has the\nmeaning given the term ``personal information'' in section 1302\nof the Children's Online Privacy Protection Act of 1998 (15\nU.S.C. 6501).\n(8) Personalized recommendation system.--The term\n``personalized recommendation system''--\n(A) means a fully automated system used to suggest,\npromote, or rank content, including other users,\nhashtags, and posts, based on the personal data of a\nuser; and\n(B) does not include a fully automated system that\nsuggests, promotes, or ranks content based solely on\nthe language, city or town, or age of a user.\n(9) Process.--The term ``process'' means any operation or\nset of operations performed, whether by manual or automated\nmeans, on personal data or on sets of personal data, such as\nthe collection, use, storage, disclosure, analysis, deletion,\nor modification of personal data.\n(10) User.--The term ``user'' means, with respect to a\ncovered platform, an individual who creates or maintains an\naccount or profile on the covered platform.\n(11) Verifiable consent.--The term ``verifiable consent''\nmeans any reasonable effort (taking into consideration\navailable technology) by the provider of a covered platform,\nincluding a request for authorization for future collection,\nuse, and disclosure described in the notice, to ensure that a\nparent of a covered minor--\n(A) receives direct notice of the collection, use,\nmaintenance, disclosure, and other relevant processing\npractices of the provider of a covered platform with\nrespect to personal data; and\n(B) before the personal data of the covered minor\nis collected, freely and unambiguously authorizes--\n(i) the collection, use, maintenance,\ndisclosure, and other relevant processing\npractices, as applicable, of the personal data;\nand\n(ii) any subsequent use of the personal\ndata.\n\nSEC. 3. PARENTAL CONSENT REQUIREMENT.\n\n(a) Prohibition.--A provider of a covered platform may not process\nthe personal data of a covered minor without obtaining the verifiable\nconsent of a parent of the covered minor.\n(b) Age Determination.--Notwithstanding subsection (a), a provider\nof a covered platform may process the personal data of a covered minor\nif--\n(1) the provider of the covered platform processes such\npersonal data for the sole purpose of determining the age of a\nuser;\n(2) the provider of the covered platform does not retain\nsuch personal data any longer than the period strictly\nnecessary to determine the age of the user and deletes such\npersonal data promptly upon determining the age of the user;\n(3) prior to processing any personal data for the purpose\nof determining the age of the user, the provider of the covered\nplatform provides the user with clear and conspicuous notice\nthat such personal data is processed for determining the age of\nthe user;\n(4) the provider of the covered platform employs reasonable\nadministrative, technical, and physical data security practices\nto protect the confidentiality, integrity, and accessibility of\npersonal data processed for determining the age of the user and\nsuch security practices are appropriate to the volume,\nsensitivity, and nature of such personal data;\n(5) the provider of the covered platform reasonably\ndetermines that any product, service, method, or third party\nused for determining the age of the user is likely to provide\nreasonably accurate results as to the age of the user; and\n(6) in the case that the provider of the covered platform\ndiscloses such personal data to a third party to determine the\nage of the user, the provider of the covered platform takes\nreasonable steps to determine the third party is capable of\nmaintaining the confidentiality, integrity, and accessibility\nof such personal data, including by obtaining written\nassurances that such third party will employ reasonable\nadministrative, technical, and physical data security practices\nto do so, will not process such personal data for any purpose\nother than determining the age of the user, and will delete the\npersonal data promptly after determining the age of the user.\n(c) Written Confirmation.--Upon obtaining verifiable consent from a\nparent of a covered minor, the provider of a covered platform shall\nprovide the parent of such covered minor with written or electronic\nconfirmation of the consent and a description of the account and data\npractices to which it applies.\n(d) Withdrawal of Parental Consent.--\n(1) In general.--A parent may withdraw consent for a\ncovered minor at any time through a method that is at least as\neasy to use as the method by which consent was granted.\n(2) Termination required.--Not later than 10 days after\nwithdrawal, the provider of a covered platform shall terminate\nthe covered minor's account and comply with the deletion\nobligations of section 5.\n(e) Re-Consent.--A provider of a covered platform shall obtain\nrenewed verifiable parental consent upon a material change to the\ncovered platform's design features or data practices the covered\nminor's transition across an age band, if a tiered structure is adopted\nevery 24 months.\n\nSEC. 4. RIGHT TO CURE.\n\nA provider of a covered platform may not be held liable for a\nviolation of section 3(a) if, within five days of identifying or being\nnotified that a user is a covered minor, the provider--\n(1) promptly deletes all personal data about the covered\nminor that is processed in connection with the account of the\nuser; or\n(2) the provider obtains the verifiable consent of a parent\nof the covered minor.\n\nSEC. 5. DATA DELETION AND PORTABILITY.\n\n(a) In General.--Upon termination of a covered minor's account\nunder this Act, the provider of a covered platform shall delete the\npersonal data of the covered minor, except data the provider of a\ncovered platform is required by law to retain.\n(b) Graduation.--\n(1) In general.--Except as provided in paragraph (2), the\nprovider of a covered platform may not retain the personal data\nassociated with an account of a covered minor after the date on\nwhich the covered minor attains the age of 16.\n(2) Parental consent.--Paragraph (1) shall not apply if a\nparent of a covered minor submits to the provider of a covered\nplatform a request to retain the personal data associated with\nthe account of the covered minor after the covered minor\nattains the age of 16.\n(c) Availability.--The operator shall, for a period of not fewer\nthan 90 days before deletion pursuant to subsection (a) or subsection\n(b), make available to the parent a means to download the covered\nminor's personal data in a portable, machine-readable format.\n\nSEC. 6. RULE OF CONSTRUCTION.\n\n(a) In General.--Nothing in this Act shall be construed to impose\nliability on a provider of a covered platform on the basis of--\n(1) the viewpoint, subject matter, or content of any user-\ngenerated content or of the covered platform; or\n(2) a covered minor's or provider of a covered platform's\naccess to, or dissemination of, any particular category of\nspeech.\n(b) Coverage.--Coverage under this Act is determined solely by\nreference to the structural and design characteristics enumerated in\nparagraph (4) of section 2.\n\nSEC. 7. ENFORCEMENT.\n\n(a) Enforcement by Federal Trade Commission.--\n(1) Unfair or deceptive acts or practices.--A violation of\nthis Act or a regulation promulgated under this Act shall be\ntreated as a violation of a regulation under section\n18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C.\n57a(a)(1)(B)) regarding unfair or deceptive acts or practices.\n(2) Powers of commission.--The Federal Trade Commission\nshall enforce this Act and the regulations promulgated under\nthis Act in the same manner, by the same means, and with the\nsame jurisdiction, powers, and duties as though all applicable\nterms and provisions of the Federal Trade Commission Act (15\nU.S.C. 41 et seq.) were incorporated into and made a part of\nthis Act. Any person who violates this Act or a regulation\npromulgated under this Act shall be subject to the penalties\nand entitled to the privileges and immunities provided in the\nFederal Trade Commission Act.\n(b) Actions by States.--\n(1) In general.--In any case in which the attorney general\nof a State, or an official or agency of a State, has reason to\nbelieve that an interest of the residents of such State has\nbeen or is threatened or adversely affected by an act or\npractice in violation of this Act or a regulation promulgated\nunder this Act, the State, as parens patriae, may bring a civil\naction on behalf of the residents of the State in an\nappropriate State court or an appropriate district court of the\nUnited States to--\n(A) enjoin such act or practice;\n(B) enforce compliance with this Act or such\nregulation;\n(C) obtain damages, restitution, or other\ncompensation on behalf of residents of the State; or\n(D) obtain such other legal and equitable relief as\nthe court may consider to be appropriate.\n(2) Notice.--Before filing an action under this subsection,\nthe attorney general of the State involved shall provide to the\nFederal Trade Commission a written notice of such action and a\ncopy of the complaint for such action. If the attorney general\ndetermines that it is not feasible to provide the notice\ndescribed in this paragraph before the filing of the action,\nthe attorney general shall provide written notice of the action\nand a copy of the complaint to the Federal Trade Commission\nimmediately upon the filing of the action.\n(3) Authority of federal trade commission.--\n(A) In general.--On receiving notice under\nparagraph (2) of an action under this subsection, the\nFederal Trade Commission shall have the right--\n(i) to intervene in the action;\n(ii) upon so intervening, to be heard on\nall matters arising therein; and\n(iii) to file petitions for appeal.\n(B) Limitation on state action while federal action\nis pending.--If the Federal Trade Commission or the\nAttorney General of the United States has instituted a\ncivil action for violation of this Act or a regulation\npromulgated under this Act (referred to in this\nsubparagraph as the ``Federal action''), no State\nattorney general may bring an action under this\nsubsection during the pendency of the Federal action\nagainst any defendant named in the complaint in the\nFederal action for any violation of this Act or\nregulation alleged in such complaint.\n(4) Rule of construction.--For purposes of bringing a civil\naction under this subsection, nothing in this Act shall be\nconstrued to prevent an attorney general of a State from\nexercising the powers conferred on the attorney general by the\nlaws of such State to conduct investigations, administer oaths\nand affirmations, or compel the attendance of witnesses or the\nproduction of documentary and other evidence.\n\nSEC. 8. RELATIONSHIP TO STATE LAWS.\n\n(a) In General.--The provisions of this Act shall preempt any law,\nrule, requirement, or regulation of a State, or a political subdivision\nof a State, only to the extent that such law, rule, requirement, or\nregulation conflicts with a provision of this Act.\n(b) Exception.--Notwithstanding subsection (a), nothing in this Act\nmay be construed--\n(1) to preempt any law, rule, requirement, or regulation of\na State, or political subdivision of a State, with respect to\ncontract, tort, or product liability; or\n(2) to prohibit a State, or a political subdivision of a\nState, from enacting or enforcing any law, rule, requirement,\nor regulation that provides greater protection to minors than\nthe protection provided by the provisions of this Act.\n\nSEC. 9. EFFECTIVE DATE.\n\nThis Act shall take effect on the date that is 18 months after the\ndate of the enactment of this
