SHORT TITLE.\n\nThis Act may be cited as the ``Eliminating Bias in Algorithmic\nSystems Act of 2026''.\n\nSEC. 2. DEFINITIONS.\n\nIn this Act:\n(1) Agency.--The term ``agency'' has the meaning given the\nterm in section 3502 of title 44, United States Code.\n(2) Covered agency.--The term ``covered agency'' means an\nagency that--\n(A) uses, funds, or procures a covered algorithm,\nor funds or otherwise participates in the development\nof a covered algorithm; or\n(B) oversees, regulates, or advises on the\ndevelopment or use of a covered algorithm.\n(3) Covered algorithm.--The term ``covered algorithm''\nmeans a process that--\n(A) is--\n(i) a computational process that uses\nmachine learning, natural language processing,\nartificial intelligence techniques, or other\ncomputational processing techniques of similar\nor greater complexity; or\n(ii) a computational process derived from a\nprocess described in clause (i); and\n(B) has the potential to have a material effect on\nthe impact of, access to, availability of, eligibility\nfor, cost of, terms of, or conditions of--\n(i) a program operated or funded by an\nagency;\n(ii) an economic opportunity regulated by\nan agency; or\n(iii) rights protected by an agency.\n(4) Protected characteristic.--The term ``protected\ncharacteristic'' means any of the following actual or perceived\ntraits of an individual or group of individuals:\n(A) Race.\n(B) Color.\n(C) Ethnicity.\n(D) National origin, nationality, or immigration\nstatus.\n(E) Religion.\n(F) Sex (including a sex stereotype, pregnancy,\nchildbirth, or a related medical condition, sexual\norientation or gender identity, and sex\ncharacteristics, including intersex traits).\n(G) Disability.\n(H) Limited English proficiency.\n(I) Biometric information.\n(J) Familial or marital status.\n(K) Source of income.\n(L) Income level (not including the ability to pay\nfor a specific good or service being offered).\n(M) Age.\n(N) Veteran status.\n(O) Genetic information or medical conditions.\n(P) Any other classification protected by Federal\nlaw.\n\nSEC. 3. CIVIL RIGHTS OFFICES AND REPORTING ON AI BIAS, DISCRIMINATION,\nAND OTHER HARMS.\n\n(a) Offices of Civil Rights.--The head of each covered agency shall\nensure that the covered agency has an office of civil rights that\nemploys experts and technologists focused on bias, discrimination, and\nother harms, including the effect or tendency to subject communities,\ngroups, or individuals to bias based on, discrimination based on, or\nother harms attributable to possessing or being perceived as possessing\na protected characteristic.\n(b) Bias, Discrimination, and Other Harms Reports.--Not later than\n1 year after the date of enactment of this Act, and every 2 years\nthereafter, each office of civil rights of a covered agency established\nunder subsection (a) shall submit to each congressional committee with\njurisdiction over the covered agency a report that details--\n(1) the state of the field and technology of covered\nalgorithms with respect to jurisdiction of the covered agency,\nincluding risks relating to bias based on, discrimination based\non, and other harms attributable to possessing or being\nperceived as possessing a protected characteristic;\n(2) any relevant steps the covered agency has taken to\nmitigate harms from covered algorithms relating to bias based\non, discrimination based on, and other harms attributable to\npossessing or being perceived as possessing a protected\ncharacteristic;\n(3) actions the covered agency has taken to engage with\nrelevant stakeholders, including industry representatives,\nbusinesses, civil rights advocates, consumer protection\norganizations, other relevant civil society organizations,\nacademic experts, individuals with technical expertise,\norganizations representing workers, and affected populations,\nregarding bias, discrimination, and other harms including the\neffect or tendency to subject communities, groups, or\nindividuals to bias based on, discrimination based on, and\nother harms attributable to possessing or being perceived as\npossessing a protected characteristic;
