NAIRR may accept and use donated resources from the private sector and federal agencies.\nThose eligible to use NAIRR resources are (1) researchers, educators, and students based in the United States and affiliated with a U.S. institution of higher education, nonprofit, executive agency, or other specified entity; and (2) employees of U.S. executive agencies or federally funded research and development centers with a demonstrable mission need.\nNSF must select a nongovernmental organization to operate NAIRR (i.e., an operating entity ) through a competitive and transparent process. SHORT TITLE.\n\nThis Act may be cited as the ``Creating Resources for Every\nAmerican To Experiment with Artificial Intelligence Act of 2025'' or\nthe ``CREATE AI Act of 2025''.\n\nSEC. 2. FINDINGS.\n\nCongress finds the following:\n(1) Cutting-edge artificial intelligence research relies on\naccess to computational resources and large datasets.\n(2) Access to the computational resources and datasets\nnecessary for artificial intelligence research and development\nis often limited to very large technology companies.\n(3) The lack of access to computational and data resources\nhas resulted in insufficient diversity in the artificial\nintelligence research and development community.\n(4) Engaging the full and diverse talent of the United\nStates is critical for maintaining United States leadership in\nartificial intelligence and ensuring that artificial\nintelligence is developed in a manner that benefits all people\nof the United States.\n(5) The National Artificial Intelligence Research Resource\nTask Force, authorized under section 5106 of the National\nArtificial Intelligence Initiative Act of 2020 (15 U.S.C. 9401\net seq.), recommended the establishment of a National\nArtificial Intelligence Research Resource in a report entitled\n``Strengthening and Democratizing the U.S. Artificial\nIntelligence Innovation Ecosystem: An Implementation Plan for a\nNational Artificial Intelligence Research Resource'', issued on\nJanuary 24, 2023.\n\nSEC. 3. NATIONAL ARTIFICIAL INTELLIGENCE RESEARCH RESOURCE.\n\n(a) NAIRR Steering Subcommittee.--Section 5103 of the William M.\n(Mac) Thornberry National Defense Authorization Act for Fiscal Year\n2021 (15 U.S.C. 9413) is amended--\n(1) by redesignating subsection (e) as subsection (f); and\n(2) by inserting after subsection (d) the following:\n``(e) NAIRR Steering Subcommittee.--\n``(1) Definition.--In this subsection, the terms `NAIRR',\n`National Artificial Intelligence Research Resource',\n`Operating Entity', `Program Management Office', and `resources\nof the NAIRR' have the meanings given the terms in section\n5601.\n``(2) Establishment.--There is established within the\nInteragency Committee a Steering Subcommittee for the National\nArtificial Intelligence Research Resource (referred to in this\nsection as the `NAIRR Steering Subcommittee').\n``(3) Chair and assistant chairs.--The NAIRR Steering\nSubcommittee shall be chaired by the Director of the Office of\nScience and Technology Policy. The Director of the Office of\nScience and Technology Policy may establish assistant chairs of\nthe NAIRR Steering Subcommittee based on members of the NAIRR\nSteering Subcommittee rotating into the assistant chair\npositions on a predetermined schedule.\n``(4) Membership.--The Director of the Office of Science\nand Technology Policy shall select members of the Interagency\nCommittee to serve on the NAIRR Steering Subcommittee that the\nDirector determines--\n``(A) have substantial expertise;\n``(B) have substantially funded or conducted\nartificial intelligence research and development; or\n``(C) have some other significant relationship with\nthe NAIRR.\n``(5) Changes to nairr steering subcommittee composition.--\nNot less frequently than once a year, the Director of the\nOffice of Science and Technology Policy shall review the\ncomposition of the NAIRR Steering Subcommittee and update such\ncomposition, which may include adding or removing members from\nthe NAIRR Steering Subcommittee, if necessary.\n``(6) Subcommittees and working groups.--The NAIRR Steering\nSubcommittee may establish subcommittees, working groups, or\nother permanent or temporary bodies of certain members of the\nNAIRR Steering Subcommittee.\n``(7) Duties.--The NAIRR Steering Subcommittee shall--\n``(A) coordinate with the National Science\nFoundation and the Program Management Office to--\n``(i) oversee and approve the operating\nplan for the NAIRR;\n``(ii) review the budget for the NAIRR;\n``(iii) develop and release a request for\nproposals to solicit bids for the Operating\nEntity, including establishing the terms and\nconditions and functions of the Operating\nEntity; and\n``(iv) develop and release funding\nopportunities for resources of the NAIRR;\n``(B) work with the Program Management Office to\nestablish criteria for the Operating Entity, review\ncandidates, and select an entity to act as the\nOperating Entity;\n``(C) identify resources that could be federated,\nparticipate in resource provider selection and funding,\nand provide direction to the Operating Entity about\nresource allocation and how those resources should be\nmade accessible via the NAIRR;\n``(D) define key performance indicators for the\nNAIRR, in conjunction with the Program Management\nOffice and any relevant Advisory Committees established\nunder section 5602(c);\n``(E) evaluate NAIRR performance against the key\nperformance indicators defined under subparagraph (D)\non a periodic basis and not less frequently than once\nevery year;\n``(F) develop an annual report, transmitted to the\nDirector of the Office of Science and Technology Policy\nand publicly released, on the progress of the National\nArtificial Intelligence Research Resource that\nincludes--\n``(i) a summary of the results of the\nevaluation conducted under subparagraph (E);\nand\n``(ii) any recommendations for changes to\nthe NAIRR; and\n``(G) oversee a periodic independent assessment of\nthe NAIRR.\n``(8) Provision of resources of the nairr.--Each agency\ncomprising the NAIRR Steering Subcommittee is authorized to\nprovide the Operating Entity with resources of the NAIRR or\nfunding for resources of the NAIRR.''.\n(b) In General.--The National Artificial Intelligence Initiative\nAct of 2020 (15 U.S.C. 9401 et seq.) is amended by adding at the end\nthe following:\n\n``TITLE LVI--NATIONAL ARTIFICIAL INTELLIGENCE RESEARCH RESOURCE\n\n``Sec. 5601. Definitions.\n``Sec. 5602. Establishment; governance.\n``Sec. 5603. Resources of the NAIRR.\n``Sec. 5604. NAIRR processes and procedures.\n``Sec. 5605. NAIRR funding.\n\n``SEC. 5601. DEFINITIONS.\n\n``In this title:\n``(1) Advisory committee.--The term `Advisory Committee'\nmeans any Advisory Committee established under section 5602(c).\n``(2) AI testbed.--The term `AI testbed' means a testbed\ndescribed in section 22A(g) of the National Institute of\nStandards and Technology Act (15 U.S.C. 278h-1(g)).\n``(3) Executive agency.--The term `Executive agency' has\nthe meaning given such term in section 105 of title 5, United\nStates Code.\n``(4) National artificial intelligence research resource;\nnairr.--The terms `National Artificial Intelligence Research\nResource' and `NAIRR' have the meaning given the term `National\nArtificial Intelligence Research Resource' in section 5601(g).\n``(5) Operating entity.--The term `Operating Entity' means\nthe Operating Entity selected by the Program Management Office\nas described in section 5602(b)(3)(A).\n``(6) Program management office.--The term `Program\nManagement Office' means the Program Management Office\nestablished under section 5602(b).\n``(7) Resource of the nairr.--The term `resource of the\nNAIRR' means a resource described in section 5603(b).\n``(8) NAIRR steering subcommittee.--The term `NAIRR\nSteering Subcommittee' means the NAIRR Steering Subcommittee\nestablished under section 5103(e).\n``(9) STEM.--The term `STEM' means science, technology,\nengineering, and mathematics, including computer science.\n\n``SEC. 5602. ESTABLISHMENT; GOVERNANCE.\n\n``(a) Establishment.--Not later than one year after the date of the\nenactment of the Creating Resources for Every American To Experiment\nwith Artificial Intelligence Act of 2025, the Director of the National\nScience Foundation, in coordination with the NAIRR Steering\nSubcommittee, shall establish the National Artificial Intelligence\nResearch Resource to--\n``(1) spur innovation and advance the development of\nartificial intelligence to stimulate cutting-edge research and\npropel the strategic development of artificial intelligence\ncapabilities;\n``(2) improve access to artificial intelligence resources\nfor researchers and students of artificial intelligence;\n``(3) improve capacity for artificial intelligence research\nin the United States; and\n``(4) support the testing, benchmarking, and evaluation of\nartificial intelligence systems developed and deployed in the\nUnited States.\n``(b) Program Management Office.--\n``(1) Establishment.--The Director of the National Science\nFoundation shall establish within the National Science\nFoundation a Program Management Office to oversee the day-to-\nday functions of the NAIRR and shall appoint an individual to\nhead the Program Management Office.\n``(2) Staff.--\n``(A) In general.--The head of the Program\nManagement Office may identify staff and direct all\nemployees of the Program Management Office, in\naccordance with the applicable provisions of title 5,\nUnited States Code.\n``(B) Representation and requirements.--The staff\nof the Program Management Office--\n``(i) may include representation from other\nFederal agencies providing support for NAIRR\nresources; and\n``(ii) shall include not fewer than three\nfull-time employees.\n``(3) Duties.--The duties of the Program Management Office\nshall include--\n``(A) in coordination with the NAIRR Steering\nSubcommittee and any relevant Advisory Committee as\nappropriate--\n``(i) developing the funding opportunity\nand soliciting bids for the Operating Entity,\nwhich will be responsible for operation of the\nNational Artificial Intelligence Research\nResource;\n``(ii) selecting, through a competitive and\ntransparent process, a nongovernmental\norganization, which may be an independent legal\nentity or a consortium of 1 or more partners\n(which may include federally funded research\nand development centers), to be designated the\nOperating Entity;\n``(iii) overseeing compliance with the\ncontractual obligations of the Operating\nEntity;\n``(iv) establishing evaluation criteria for\nthe NAIRR;\n``(v) overseeing asset allocation and\nutilization;\n``(vi) identifying an external independent\nevaluation entity;\n``(vii) assessing the performance of the\nOperating Entity on not less than an annual\nbasis and, if such performance is\nunsatisfactory, ending the agreement with such\nOperating Entity and selecting a new Operating\nEntity in accordance with clause (ii);\n``(viii) developing multi-agency funding\nopportunities for the selection of NAIRR\nresources; and\n``(ix) coordinating resource contributions\nfrom participating Federal agencies; and\n``(B) delegating, with appropriate oversight,\noperational tasks to the Operating Entity, including--\n``(i) coordinating the provisioning of\nresources of the NAIRR;\n``(ii) maintaining a portal and associated\nservices for users to access resources of the\nNAIRR;\n``(iii) developing policies and procedures\nfor the NAIRR;\n``(iv) hiring and managing a staff\n(including experts in cyber infrastructure\nmanagement, data science, research design,\nprivacy, ethics, and legal and policy matters)\nto support the operations of the NAIRR;\n``(v) continually modernizing NAIRR\ninfrastructure;\n``(vi) recommending key performance\nindicators for the NAIRR, in coordination with\nthe NAIRR Steering Subcommittee and any\nrelevant Advisory Committee;\n``(vii) publishing publicly available\nannual reports reviewing the performance of the\nNAIRR, the resources of the NAIRR, and the\nNAIRR governance structures;\n``(viii) establishing and administering\ntraining to new users on accessing a resource\nof the NAIRR, research design, and issues\nrelated to privacy, ethics, safety, and\ntrustworthiness of artificial intelligence\nsystems;\n``(ix) facilitating connections to AI\ntestbeds; and\n``(x) making educational resources of the\nNAIRR available to other Federal agencies, and\nto Congress, for the purpose of educating\nFederal Government officials and employees\nabout artificial intelligence.\n``(c) Advisory Committees.--The head of the Program Management\nOffice, acting through the Director of the Operating Entity, shall\nestablish Advisory Committees to provide advice to the Operating Entity\nand the Program Management Office. Any such Advisory Committees shall\nbe comprised of members from government agencies, the private sector,\nacademia, and public interest groups. Chapter 10 of title 5, United\nStates Code, shall not apply to any such Advisory Committee.\n\n``SEC. 5603. RESOURCES OF THE NAIRR.\n\n``(a) In General.--The head of the Program Management Office,\nacting through the Director of the Operating Entity and in coordination\nwith the NAIRR Steering Subcommittee and any relevant Advisory\nCommittee, shall--\n``(1) coordinate and provision resources of the NAIRR;\n``(2) establish processes to manage the procurement of new\nresources of the NAIRR, and intake of in-kind contribution of\nresources of the NAIRR, from Federal agencies or other\nentities;\n``(3) establish policies on and review resources of the\nNAIRR for concerns related to ethics and privacy;\n``(4) retire resources of the NAIRR no longer available or\nneeded; and\n``(5) publicly report a summary of categories of available\nresources of the NAIRR, categories of sources of such resources\nof the NAIRR, and issues related to resources of the NAIRR.\n``(b) Resources of the NAIRR.--The NAIRR shall offer resources that\ninclude, at a minimum, all of the following, subject to the\navailability of appropriations:\n``(1) A mix of computational resources, including--\n``(A) on-premises, cloud-based, hybrid, and\nemergent resources;\n``(B) public cloud providers providing access to\npopular computational and storage services for NAIRR\nusers;\n``(C) an open source software environment for the\nNAIRR;\n``(D) an application programming interface\nproviding structured access to artificial intelligence\nmodels; and\n``(E) other types of computational resources.\n``(2) Data, including by--\n``(A)(i) in coordination with the National\nInstitute of Standards and Technology and consistent\nwith the guidance of the National Science and\nTechnology Council titled `Desirable Characteristics of\nData Repositories for Federally Funded Data,' dated May\n2022, or any successor document, publishing\ninteroperability standards for data repositories based\non the data sharing and documentation standards and\nguidelines produced under section 22A of the National\nInstitute of Standards and Technology Act (15 U.S.C.\n278h-1); and\n``(ii) selecting and developing, through a\ncompetitive bidding process, data repositories to be\navailable to NAIRR users;\n``(B) establishing acceptable criteria for datasets\nused as resources of the NAIRR;\n``(C) identifying and providing access to existing\ncurated datasets of value and interest to the NAIRR\nuser community;\n``(D) establishing an artificial intelligence open\ndata commons to facilitate community sharing and\ncuration of data, code, and models;\n``(E) coordinating with the Interagency Council on\nStatistical Policy to explore options to make Federal\nstatistical data available to NAIRR users, including\nthrough the standard application process established\nunder section 3583(a) of title 44, United States Code;\nand\n``(F) other types of computational resources.\n``(3) Educational tools and services, including by--\n``(A) facilitating and curating educational and\ntraining materials;\n``(B) providing technical training and user\nsupport; and\n``(C) providing targeted outreach and programming\nstrategies to increase participation in STEM fields.\n``(4) AI testbeds, including by--\n``(A) in coordination with the National Institute\nof Standards and Technology, facilitating access to\nartificial intelligence testbeds through which\nresearchers can measure, benchmark, test, or evaluate\nengineering or algorithmic developments; and\n``(B) developing a comprehensive catalog of open AI\ntestbeds.\n\n``SEC. 5604. NAIRR PROCESSES AND PROCEDURES.\n\n``(a) User Eligibility.--\n``(1) Eligible users.--Subject to paragraph (3), the\nfollowing users shall be eligible for access to the NAIRR:\n``(A) A researcher, educator, or student based in\nthe United States that is affiliated with an entity\ndescribed in paragraph (2).\n``(B) An employee of an entity described in clause\n(iii) or (iv) of paragraph (2)(B) with a demonstrable\nmission-need.\n``(2) Entities described.--An entity described in this\nparagraph is an entity that satisfies the following:\n``(A) Is based in the United States.\n``(B) Is one of the following:\n``(i) An institution of higher education.\n``(ii) A nonprofit institution (as such\nterm is defined in section 4 of the Stevenson-\nWydler Technology Innovation Act of 1980 (15\nU.S.C. 3703)).\n``(iii) An Executive agency.\n``(iv) A federally funded research and\ndevelopment center.\n``(v) A small business concern (as such\nterm is defined in section 3 of the Small\nBusiness Act (15 U.S.C. 632), notwithstanding\nsection 121.103 of title 13, Code of Federal\nRegulations) that has received funding from an\nExecutive agency, including through the Small\nBusiness Innovation Research Program or the\nSmall Business Technology Transfer Program (as\ndescribed in section 9 of the Small Business\nAct (15 U.S.C. 638)).\n``(vi) A category of entity that the\nDirector of the National Science Foundation and\nthe Director of the Office of Science and\nTechnology Policy, after consultation with the\nNAIRR Steering Subcommittee and any relevant\nAdvisory Committee, determine shall be\neligible.\n``(vii) A consortium composed of entities\ndescribed in clauses (i) through (vi).\n``(3) Excluded entities.--\n``(A) In general.--No individual is authorized to\nbe an eligible user under paragraph (1) if the\nindividual is employed by a foreign country that is\nlisted in section 4872(d)(2) of title 10, United States\nCode, or is otherwise authorized by such country to act\nfor or on its behalf.\n``(B) Enforcement.--The Director of the National\nScience Foundation shall ensure that individuals\nauthorized as eligible users meet the requirements of\nsubparagraph (A).\n``(b) Privacy, Ethics, Civil Rights and Civil Liberties, Safety,\nand Trustworthiness.--\n``(1) In general.--\n``(A) Requirements.--The head of the Program\nManagement Office, acting through the Director of the\nOperating Entity and in consultation with any relevant\nAdvisory Committee, shall establish requirements, a\nreview process for applications, and a process for\nauditing resources of the NAIRR and research conducted\nusing resources of the NAIRR on matters related to\nprivacy, ethics, safety, security, and trustworthiness\nof artificial intelligence systems developed using\nresources of the NAIRR.\n``(B) Federal statistical data.--Any auditing\nprocess required under subparagraph (A) for Federal\nstatistical data included in a resource of the NAIRR\nshall be completed by the head of a designated\nstatistical agency (as defined in section 3576(e) of\ntitle 44, United States Code), in coordination with the\nChief Statistician of the United States, consistent\nwith relevant law.\n``(2) Consistency.--The head of the Program Management\nOffice shall ensure the requirements and processes described in\nparagraph (1) are consistent with the policies of the Office of\nManagement and Budget policy and relevant policies of other\nExecutive agencies. The head of the Program Management Office\nshall coordinate with the Senior Agency Official for Privacy\nand the General Counsel of the National Science Foundation in\nensuring compliance with applicable privacy law and policy and\nFederal laws and regulations.\n``(3) Availability.--The head of the Program Management\nOffice, acting through the Director of the Operating Entity,\nshall--\n``(A) when determining access to computational\nresources of the NAIRR, take into consideration the\nextent to which the access relates to privacy, ethics,\nsafety, security, risk mitigation, and trustworthiness\nof artificial intelligence systems, or other topics\nthat demonstrate that a project is in the public\ninterest;\n``(B) ensure that a significant percentage of the\nannual allotment of computational resources of the\nNAIRR is provided to projects the primary focus of\nwhich is related to any of the topics described in\nsubparagraph (A); and\n``(C) to the extent that demand for access to\ncomputational resources of the NAIRR exceeds\navailability, consider, on a priority basis, projects\nfocusing on any of the topics described in subparagraph\n(A) when ranking applications for such access.\n``(c) Scientific Integrity.--\n``(1) In general.--The head of the Program Management\nOffice, acting through the Director of the Operating Entity and\nin consultation with any relevant Advisory Committee, shall\ndevelop guidance for--\n``(A) addressing concerns related to matters of\nscientific integrity, including matters related to the\neffects or impacts of research and potential research\nenabled by the NAIRR; and\n``(B) mechanisms for an employee of the Operating\nEntity, an employee of the Program Management Office, a\nmember of the NAIRR Steering Subcommittee or an\nAdvisory Committee, a researcher or student affiliated\nwith a NAIRR user described in subsection (a)(1), an\nemployee of a provider of a resource of the NAIRR, an\nemployee of a NAIRR funding agency, or a member of the\npublic to report violations of the guidance developed\nunder this paragraph, including by confidential and\nanonymous means.\n``(2) Consistency with government policies on scientific\nintegrity.--The guidance developed under paragraph (1)(A) shall\nbe published in a publicly accessible location on the website\nof the NAIRR. Such policies shall, to the degree practicable,\nbe consistent with--\n``(A) the Presidential memorandum entitled\n`Restoring Trust in Government Through Scientific\nIntegrity and Evidence-Based Policymaking', dated\nJanuary 27, 2021, or successor document; and\n``(B) reports produced pursuant to such\nPresidential memorandum (including the reports entitled\n`Protecting the Integrity of Government Science', dated\nJanuary 2022, and `A Framework for Federal Scientific\nIntegrity Policy and Practice', dated January 2023,\npublished by the National Science and Technology\nCouncil, or successor documents).\n``(d) System Security and User Access Controls.--The head of the\nProgram Management Office, acting through the Director of the Operating\nEntity and in consultation with the NAIRR Steering Subcommittee, the\nDirector of the Office of Management and Budget, the Director of the\nNational Institute of Standards and Technology, and the Director of the\nCybersecurity and Infrastructure Security Agency--\n``(1) shall establish minimum security requirements for all\npersons interacting with the NAIRR, consistent with the most\nrecent version of the Cybersecurity Framework, or successor\ndocument, maintained by the National Institute of Standards and\nTechnology; and\n``(2) may establish tiers of security requirements and user\naccess controls beyond the minimum requirements relative to\nsecurity risks.\n``(e) Fee Schedule.--The head of the Program Management Office,\nacting through the Director of the Operating Entity, may establish a\nfee schedule for access to the NAIRR. Fees charged under this\nsubsection may be retained and used for the purposes of this title. The\nOperating Entity may only charge fees in such fee schedule. Such fee\nschedule--\n``(1) may differ by type of eligible user and type of\naffiliated entity described in subsection (a);\n``(2) shall include a free tier of access based on\nappropriated funds and anticipated costs and demand;\n``(3) may include cost-based charges for eligible users to\npurchase resources of the NAIRR beyond the resources included\nin a free or subsidized tier; and\n``(4) shall ensure that the primary purpose of the NAIRR is\nto support research.\n``(f) Research Security.--The head of the Program Management\nOffice, acting through the Director of the Operating Entity and in\nconsultation with the NAIRR Steering Subcommittee and the Director of\nthe Office of Science and Technology Policy, shall--\n``(1) ensure conformance with the requirements of National\nSecurity Presidential Memorandum-33 (relating to supported\nresearch and development national policy), issued January 2021,\nand its implementation guidance on research security and\nresearch integrity, or any successor policy document or\nguidance, by establishing NAIRR operating principles that\nemphasize the research integrity principles of openness,\nreciprocity, and transparency; and\n``(2) designate a member of the leadership team for the\nOperating Entity as a research security point of contact with\nresponsibility for overseeing conformance with the National\nSecurity Presidential Memorandum-33 and its implementation\nguidance, or any successor policy document or guidance.\n\n``SEC. 5605. NAIRR FUNDING.\n\n``To carry out this title, to the maximum extent practicable, the\nNAIRR is authorized to accept and use donations of cash, services, and\npersonal property from the private sector.''.\n(c) Conforming Amendments.--The table of contents in section 2(b)\nof the William M. (Mac) Thornberry National Defense Authorization Act\nfor Fiscal Year 2021 (Public Law 116-283; 134 Stat. 3388) is amended by\ninserting after the items relating to title LV the following:\n\n``TITLE LVI--NATIONAL ARTIFICIAL INTELLIGENCE RESEARCH RESOURCE\n\n``Sec. 5601.
