SHORT TITLE.\n\nThis Act may be cited as the ``Tools to Address Known Exploitation\nby Immobilizing Technological Deepfakes On Websites and Networks Act''\nor the ``TAKE IT DOWN Act''.\n\nSEC. 2. CRIMINAL PROHIBITION ON INTENTIONAL DISCLOSURE OF NONCONSENSUAL\nINTIMATE VISUAL DEPICTIONS.\n\n(a) In General.--Section 223 of the Communications Act of 1934 (47\nU.S.C. 223) is amended--\n(1) by redesignating subsection (h) as subsection (i); and\n(2) by inserting after subsection (g) the following:\n``(h) Intentional Disclosure of Nonconsensual Intimate Visual\nDepictions.--\n``(1) Definitions.--In this subsection:\n``(A) Consent.--The term `consent' means an\naffirmative, conscious, and voluntary authorization\nmade by an individual free from force, fraud, duress,\nmisrepresentation, or coercion.\n``(B) Digital forgery.--The term `digital forgery'\nmeans any intimate visual depiction of an identifiable\nindividual created through the use of software, machine\nlearning, artificial intelligence, or any other\ncomputer-generated or technological means, including by\nadapting, modifying, manipulating, or altering an\nauthentic visual depiction, that, when viewed as a\nwhole by a reasonable person, is indistinguishable from\nan authentic visual depiction of the individual.\n``(C) Identifiable individual.--The term\n`identifiable individual' means an individual--\n``(i) who appears in whole or in part in an\nintimate visual depiction; and\n``(ii) whose face, likeness, or other\ndistinguishing characteristic (including a\nunique birthmark or other recognizable feature)\nis displayed in connection with such intimate\nvisual depiction.\n``(D) Interactive computer service.--The term\n`interactive computer service' has the meaning given\nthe term in section 230.\n``(E) Intimate visual depiction.--The term\n`intimate visual depiction' has the meaning given such\nterm in section 1309 of the Consolidated Appropriations\nAct, 2022 (15 U.S.C. 6851).\n``(F) Minor.--The term `minor' means any individual\nunder the age of 18 years.\n``(2) Offense involving authentic intimate visual\ndepictions.--\n``(A) Involving adults.--Except as provided in\nsubparagraph (C), it shall be unlawful for any person,\nin interstate or foreign commerce, to use an\ninteractive computer service to knowingly publish an\nintimate visual depiction of an identifiable individual\nwho is not a minor if--\n``(i) the intimate visual depiction was\nobtained or created under circumstances in\nwhich the person knew or reasonably should have\nknown the identifiable individual had a\nreasonable expectation of privacy;\n``(ii) what is depicted was not voluntarily\nexposed by the identifiable individual in a\npublic or commercial setting;\n``(iii) what is depicted is not a matter of\npublic concern; and\n``(iv) publication of the intimate visual\ndepiction--\n``(I) is intended to cause harm; or\n``(II) causes harm, including\npsychological, financial, or\nreputational harm, to the identifiable\nindividual.\n``(B) Involving minors.--Except as provided in\nsubparagraph (C), it shall be unlawful for any person,\nin interstate or foreign commerce, to use an\ninteractive computer service to knowingly publish an\nintimate visual depiction of an identifiable individual\nwho is a minor with intent to--\n``(i) abuse, humiliate, harass, or degrade\nthe minor; or\n``(ii) arouse or gratify the sexual desire\nof any person.\n``(C) Exceptions.--Subparagraphs (A) and (B) shall\nnot apply to--\n``(i) a lawfully authorized investigative,\nprotective, or intelligence activity of--\n``(I) a law enforcement agency of\nthe United States, a State, or a\npolitical subdivision of a State; or\n``(II) an intelligence agency of\nthe United States;\n``(ii) a disclosure made reasonably and in\ngood faith--\n``(I) to a law enforcement officer\nor agency;\n``(II) as part of a document\nproduction or filing associated with a\nlegal proceeding;\n``(III) as part of medical\neducation, diagnosis, or treatment or\nfor a legitimate medical, scientific,\nor education purpose;\n``(IV) in the reporting of unlawful\ncontent or unsolicited or unwelcome\nconduct or in pursuance of a legal,\nprofessional, or other lawful\nobligation; or\n``(V) to seek support or help with\nrespect to the receipt of an\nunsolicited intimate visual depiction;\n``(iii) a disclosure reasonably intended to\nassist the identifiable individual;\n``(iv) a person who possesses or publishes\nan intimate visual depiction of himself or\nherself engaged in nudity or sexually explicit\nconduct (as that term is defined in section\n2256(2)(A) of title 18, United States Code); or\n``(v) the publication of an intimate visual\ndepiction that constitutes--\n``(I) child pornography (as that\nterm is defined in section 2256 of\ntitle 18, United States Code); or\n``(II) a visual depiction described\nin subsection (a) or (b) of section\n1466A of title 18, United States Code\n(relating to obscene visual\nrepresentations of the sexual abuse of\nchildren).\n``(3) Offense involving digital forgeries.--\n``(A) Involving adults.--Except as provided in\nsubparagraph (C), it shall be unlawful for any person,\nin interstate or foreign commerce, to use an\ninteractive computer service to knowingly publish a\ndigital forgery of an identifiable individual who is\nnot a minor if--\n``(i) the digital forgery was published\nwithout the consent of the identifiable\nindividual;\n``(ii) what is depicted was not voluntarily\nexposed by the identifiable individual in a\npublic or commercial setting;\n``(iii) what is depicted is not a matter of\npublic concern; and\n``(iv) publication of the digital forgery--\n``(I) is intended to cause harm; or\n``(II) causes harm, including\npsychological, financial, or\nreputational harm, to the identifiable\nindividual.\n``(B) Involving minors.--Except as provided in\nsubparagraph (C), it shall be unlawful for any person,\nin interstate or foreign commerce, to use an\ninteractive computer service to knowingly publish a\ndigital forgery of an identifiable individual who is a\nminor with intent to--\n``(i) abuse, humiliate, harass, or degrade\nthe minor; or\n``(ii) arouse or gratify the sexual desire\nof any person.\n``(C) Exceptions.--Subparagraphs (A) and (B) shall\nnot apply to--\n``(i) a lawfully authorized investigative,\nprotective, or intelligence activity of--\n``(I) a law enforcement agency of\nthe United States, a State, or a\npolitical subdivision of a State; or\n``(II) an intelligence agency of\nthe United States;\n``(ii) a disclosure made reasonably and in\ngood faith--\n``(I) to a law enforcement officer\nor agency;\n``(II) as part of a document\nproduction or filing associated with a\nlegal proceeding;\n``(III) as part of medical\neducation, diagnosis, or treatment or\nfor a legitimate medical, scientific,\nor education purpose;\n``(IV) in the reporting of unlawful\ncontent or unsolicited or unwelcome\nconduct or in pursuance of a legal,\nprofessional, or other lawful\nobligation; or\n``(V) to seek support or help with\nrespect to the receipt of an\nunsolicited intimate visual depiction;\n``(iii) a disclosure reasonably intended to\nassist the identifiable individual;\n``(iv) a person who possesses or publishes\na digital forgery of himself or herself engaged\nin nudity or sexually explicit conduct (as that\nterm is defined in section 2256(2)(A) of title\n18, United States Code); or\n``(v) the publication of an intimate visual\ndepiction that constitutes--\n``(I) child pornography (as that\nterm is defined in section 2256 of\ntitle 18, United States Code); or\n``(II) a visual depiction described\nin subsection (a) or (b) of section\n1466A of title 18, United States Code\n(relating to obscene visual\nrepresentations of the sexual abuse of\nchildren).\n``(4) Penalties.--\n``(A) Offenses involving adults.--Any person who\nviolates paragraph (2)(A) or (3)(A) shall be fined\nunder title 18, United States Code, imprisoned not more\nthan 2 years, or both.\n``(B) Offenses involving minors.--Any person who\nviolates paragraph (2)(B) or (3)(B) shall be fined\nunder title 18, United States Code, imprisoned not more\nthan 3 years, or both.\n``(5) Rules of construction.--For purposes of paragraphs\n(2) and (3)--\n``(A) the fact that the identifiable individual\nprovided consent for the creation of the intimate\nvisual depiction shall not establish that the\nindividual provided consent for the publication of the\nintimate visual depiction; and\n``(B) the fact that the identifiable individual\ndisclosed the intimate visual depiction to another\nindividual shall not establish that the identifiable\nindividual provided consent for the publication of the\nintimate visual depiction by the person alleged to have\nviolated paragraph (2) or (3), respectively.\n``(6) Threats.--\n``(A) Threats involving authentic intimate visual\ndepictions.--Any person who intentionally threatens to\ncommit an offense under paragraph (2) for the purpose\nof intimidation, coercion, extortion, or to create\nmental distress shall be punished as provided in\nparagraph (4).\n``(B) Threats involving digital forgeries.--\n``(i) Threats involving adults.--Any person\nwho intentionally threatens to commit an\noffense under paragraph (3)(A) for the purpose\nof intimidation, coercion, extortion, or to\ncreate mental distress shall be fined under\ntitle 18, United States Code, imprisoned not\nmore than 18 months, or both.\n``(ii) Threats involving minors.--Any\nperson who intentionally threatens to commit an\noffense under paragraph (3)(B) for the purpose\nof intimidation, coercion, extortion, or to\ncreate mental distress shall be fined under\ntitle 18, United States Code, imprisoned not\nmore than 30 months, or both.\n``(7) Forfeiture.--\n``(A) In general.--The court, in imposing a\nsentence on any person convicted of a violation of\nparagraph (2) or (3), shall order, in addition to any\nother sentence imposed and irrespective of any\nprovision of State law, that the person forfeit to the\nUnited States--\n``(i) any material distributed in violation\nof that paragraph;\n``(ii) the person's interest in property,\nreal or personal, constituting or derived from\nany gross proceeds of the violation, or any\nproperty traceable to such property, obtained\nor retained directly or indirectly as a result\nof the violation; and\n``(iii) any personal property of the person\nused, or intended to be used, in any manner or\npart, to commit or to facilitate the commission\nof the violation.\n``(B) Procedures.--Section 413 of the Controlled\nSubstances Act (21 U.S.C. 853), with the exception of\nsubsections (a) and (d), shall apply to the criminal\nforfeiture of property under subparagraph (A).\n``(8) Restitution.--The court shall order restitution for\nan offense under paragraph (2) or (3) in the same manner as\nunder section 2264 of title 18, United States Code.\n``(9) Rule of construction.--Nothing in this subsection\nshall be construed to limit the application of any other\nrelevant law, including section 2252 of title 18, United States\nCode.''.\n(b) Defenses.--Section 223(e)(1) of the Communications Act of 1934\n(47 U.S.C. 223(e)(1)) is amended by striking ``or (d)'' and inserting\n``, (d), or (h)''.\n(c) Technical and Conforming Amendment.--Subsection (i) of section\n223 of the Communications Act of 1934 (47 U.S.C. 223), as so\nredesignated by subsection (a), is amended by inserting\n``Definitions.--'' before ``For purposes of this section''.\n\nSEC. 3. NOTICE AND REMOVAL OF NONCONSENSUAL INTIMATE VISUAL DEPICTIONS.\n\n(a) In General.--\n(1) Notice and removal process.--\n(A) Establishment.--Not later than 1 year after the\ndate of enactment of this Act, a covered platform shall\nestablish a process whereby an identifiable individual\n(or an authorized person acting on behalf of such\nindividual) may--\n(i) notify the covered platform of an\nintimate visual depiction published on the\ncovered platform that--\n(I) includes a depiction of the\nidentifiable individual; and\n(II) was published without the\nconsent of the identifiable individual;\nand\n(ii) submit a request for the covered\nplatform to remove such intimate visual\ndepiction.\n(B) Requirements.--A notification and request for\nremoval of an intimate visual depiction submitted under\nthe process established under subparagraph (A) shall\ninclude, in writing--\n(i) a physical or electronic signature of\nthe identifiable individual (or an authorized\nperson acting on behalf of such individual);\n(ii) an identification of, and information\nreasonably sufficient for the covered platform\nto locate, the intimate visual depiction of the\nidentifiable individual;\n(iii) a brief statement that the\nidentifiable individual has a good faith belief\nthat any intimate visual depiction identified\nunder clause (ii) is not consensual, including\nany relevant information for the covered\nplatform to determine the intimate visual\ndepiction was published without the consent of\nthe identifiable individual; and\n(iv) information sufficient to enable the\ncovered platform to contact the identifiable\nindividual (or an authorized person acting on\nbehalf of such individual).\n(2) Notice of process.--A covered platform shall provide on\nthe platform a clear and conspicuous notice, which may be\nprovided through a clear and conspicuous link to another web\npage or disclosure, of the notice and removal process\nestablished under paragraph (1)(A) that--\n(A) is easy to read and in plain language; and\n(B) provides information regarding the\nresponsibilities of the covered platform under this\nsection, including a description of how an individual\ncan submit a notification and request for removal.\n(3) Removal of nonconsensual intimate visual depictions.--\nUpon receiving a valid removal request from an identifiable\nindividual (or an authorized person acting on behalf of such\nindividual) using the process described in paragraph\n(1)(A)(ii), a covered platform shall, as soon as possible, but\nnot later than 48 hours after receiving such request--\n(A) remove the intimate visual depiction; and\n(B) make reasonable efforts to identify and remove\nany known identical copies of such depiction.\n(4) Limitation on liability.--A covered platform shall not\nbe liable for any claim based on the covered platform's good\nfaith disabling of access to, or removal of, material claimed\nto be a nonconsensual intimate visual depiction based on facts\nor circumstances from which the unlawful publishing of an\nintimate visual depiction is apparent, regardless of whether\nthe intimate visual depiction is ultimately determined to be\nunlawful or not.\n(b) Enforcement by the Commission.--\n(1) Unfair or deceptive acts or practices.--A failure to\nreasonably comply with the notice and takedown obligations\nunder subsection (a) shall be treated as a violation of a rule\ndefining an unfair or a deceptive act or practice under section\n18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C.\n57a(a)(1)(B)).\n(2) Powers of the commission.--\n(A) In general.--Except as provided in subparagraph\n(D), the Commission shall enforce this section in the\nsame manner, by the same means, and with the same\njurisdiction, powers, and duties as though all\napplicable terms and provisions of the Federal Trade\nCommission Act (15 U.S.C. 41 et seq.) were incorporated\ninto and made a part of this section.\n(B) Privileges and immunities.--Any person who\nviolates this section shall be subject to the penalties\nand entitled to the privileges and immunities provided\nin the Federal Trade Commission Act (15 U.S.C. 41 et\nseq.).\n(C) Authority preserved.--Nothing in this Act shall\nbe construed to limit the authority of the Federal\nTrade Commission under any other provision of law.\n(D) Scope of jurisdiction.--Notwithstanding section\n4, 5(a)(2), or 6 of the Federal Trade Commission Act\n(15 U.S.C. 44, 45(a)(2), 46), or any jurisdictional\nlimitation of the Commission, the Commission shall also\nenforce this section in the same manner provided in\nsubparagraph (A), with respect to organizations that\nare not organized to carry on business for their own\nprofit or that of their members.\n\nSEC. 4. DEFINITIONS.\n\nIn this Act:\n(1) Commission.--The term ``Commission'' means the Federal\nTrade Commission.\n(2) Consent; digital forgery; identifiable individual;\nintimate visual depiction.--The terms ``consent'', ``digital\nforgery'', ``identifiable individual'', ``intimate visual\ndepiction'', and ``minor'' have the meaning given such terms in\nsection 223(h) of the Communications Act of 1934 (47 U.S.C.\n223), as added by section 2.\n(3) Covered platform.--\n(A) In general.--The term ``covered platform''\nmeans a website, online service, online application, or\nmobile application--\n(i) that serves the public; and\n(ii)(I) that primarily provides a forum for\nuser-generated content, including messages,\nvideos, images, games, and audio files; or\n(II) for which it is in the regular course\nof trade or business of the website, online\nservice, online application, or mobile\napplication to publish, curate, host, or make\navailable content of nonconsensual intimate\nvisual depictions.\n(B) Exclusions.--The term ``covered platform''\nshall not include the following:\n(i) A provider of broadband internet access\nservice (as described in section 8.1(b) of\ntitle 47, Code of Federal Regulations, or\nsuccessor regulation).\n(ii) Electronic mail.\n(iii) Except as provided in subparagraph\n(A)(ii)(II), an online service, application, or\nwebsite--\n(I) that consists primarily of\ncontent that is not user generated but\nis preselected by the provider of such\nonline service, application, or\nwebsite; and\n(II) for which any chat, comment,\nor interactive functionality is\nincidental to, directly related to, or\ndependent on the provision of the\ncontent described in subclause (I).\n\nSEC. 5.
