SHORT TITLE.\n\nThis Act may be cited as the ``Protect Elections from Deceptive AI\nAct''.\n\nSEC. 2. PROHIBITION ON DISTRIBUTION OF MATERIALLY DECEPTIVE AI-\nGENERATED AUDIO OR VISUAL MEDIA PRIOR TO ELECTION.\n\n(a) In General.--Title III of the Federal Election Campaign Act of\n1971 (52 U.S.C. 30101 et seq.) is amended by adding at the end the\nfollowing new section:\n\n``SEC. 325. PROHIBITION ON DISTRIBUTION OF MATERIALLY DECEPTIVE AI-\nGENERATED AUDIO OR VISUAL MEDIA.\n\n``(a) Definitions.--In this section:\n``(1) Covered individual.--The term `covered individual'\nmeans a candidate for Federal office.\n``(2) Deceptive ai-generated audio or visual media.--The\nterm `deceptive AI-generated audio or visual media' means an\nimage, audio, or video that--\n``(A) is the product of artificial intelligence or\nmachine learning, including deep learning techniques,\nthat--\n``(i) merges, combines, replaces, or\nsuperimposes content onto an image, audio, or\nvideo, creating an image, audio, or video that\nappears authentic; or\n``(ii) generates an inauthentic image,\naudio, or video that appears authentic; and\n``(B) a reasonable person, having considered the\nqualities of the image, audio, or video and the nature\nof the distribution channel in which the image, audio,\nor video appears--\n``(i) would have a fundamentally different\nunderstanding or impression of the appearance,\nspeech, or expressive conduct exhibited in the\nimage, audio, or video than that person would\nhave if that person were hearing or seeing the\nunaltered, original version of the image,\naudio, or video; or\n``(ii) would believe that the image, audio,\nor video accurately exhibits any appearance,\nspeech, or expressive conduct of a person who\ndid not actually exhibit such appearance,\nspeech, or expressive conduct.\n``(3) Federal election activity.--The term `Federal\nelection activity' has the meaning given the term in section\n301(20)(A)(iii).\n``(b) Prohibition.--Except as provided in subsection (c), a person,\npolitical committee, or other entity may not knowingly distribute\nmaterially deceptive AI-generated audio or visual media of a covered\nindividual, or in carrying out a Federal election activity, with the\nintent to--\n``(1) influence an election; or\n``(2) solicit funds.\n``(c) Inapplicability to Certain Entities.--This section shall not\napply to the following:\n``(1) A radio or television broadcasting station, including\na cable or satellite television operator, programmer, or\nproducer, or a streaming service that broadcasts materially\ndeceptive AI-generated audio or visual media prohibited by this\nsection as part of a bona fide newscast, news interview, news\ndocumentary, or on-the-spot coverage of bona fide news events,\nif the broadcast clearly acknowledges through content or a\ndisclosure, in a manner that can be easily heard or read by the\naverage listener or viewer, that there are questions about the\nauthenticity of the materially deceptive AI-generated audio or\nvisual media.\n``(2) A regularly published newspaper, magazine, or other\nperiodical of general circulation, including an internet or\nelectronic publication, that routinely carries news and\ncommentary of general interest, and that publishes materially\ndeceptive AI-generated audio or visual media prohibited under\nthis section, if the publication clearly states that the\nmaterially deceptive AI-generated audio or visual media does\nnot accurately represent the speech or conduct of the covered\nindividual.\n``(3) Materially deceptive AI-generated audio or visual\nmedia that constitutes satire or parody.\n``(d) Civil Action.--\n``(1) Injunctive or other equitable relief.--\n``(A) In general.--A covered individual whose voice\nor likeness appears in, or who is the subject of, a\nmaterially deceptive AI-generated audio or visual\nmedia, including content distributed as part of a\nFederal election activity, distributed in violation of\nthis section may seek injunctive or other equitable\nrelief prohibiting the distribution of materially\ndeceptive AI-generated audio or visual media in\nviolation of this section.\n``(B) Precedence.--An action under this paragraph\nshall be entitled to precedence in accordance with the\nFederal Rules of Civil Procedure.\n``(2) Damages.--\n``(A) In general.--A covered individual whose voice\nor likeness appears in, or who is the subject of, a\nmaterially deceptive AI-generated audio or visual\nmedia, including content distributed as part of a\nFederal election activity, distributed in violation of\nthis section may bring an action for general or special\ndamages against the person, committee, or other entity\nthat distributed the materially deceptive AI-generated\naudio or visual media.\n``(B) Attorney's fees and costs.--In addition to\nany damages awarded under subparagraph (A), the court\nmay also award a prevailing party reasonable attorney's\nfees and costs.\n``(C) Rule of construction.--Nothing in this\nparagraph shall be construed to limit or preclude a\nplaintiff from securing or recovering any other\navailable remedy.\n``(3) Burden of proof.--In any civil action alleging a\nviolation of this section, the plaintiff shall bear the burden\nof establishing the violation through clear and convincing\nevidence.''.\n(b) Effect on Defamation Action.--For purposes of an action for\ndefamation, a violation of section 325 of the Federal Election Campaign\nAct of 1971, as added by subsection (a), shall constitute defamation\nper se.\n(c) Severability.--If any provision of this Act, or an amendment\nmade by this Act, or the application of such provision to any person or\ncircumstance, is held to be invalid, the remainder of this Act, or an\namendment made by this Act, or the application of such provision to\nother persons or circumstances, shall not be affected.\n<all>","changes":[],"passport":{"data":{"act":{"jurisdiction":"США","title_official":"Protect Elections from Deceptive AI Act","title_short":"Закон о защите выборов от вводящего в заблуждение искусственного интеллекта","level":"законопроект","date_adopted":"2025-09-10","date_in_force":"","date_version":"","phased":"","status":"законопроект: на рассмотрении","sunset":"","regulator":"Конгресс США","related":"Федеральный закон о кампании по выборам 1971 года (Federal Election Campaign Act)"},"goal":{"problem":"распространение дезинформации через искусственный интеллект во время федеральных выборов","goal":"запретить распространение существенно вводящих в заблуждение аудиовизуальных материалов, созданных искусственным интеллектом, связанных с кандидатами на федеральные должности","targets":"","scope":"кандидаты на федеральные выборы, лица, политические комитеты и другие организации, распространяющие материалы","exclusions":"новостные каналы, газеты, интернет-издания, сатира и пародия"},"subjects_note":{"protected":"кандидаты на федеральные выборные должности"},"subjects":[{"role":"поставщик","who":"лицо, политический комитет или другая организация, распространяющая материалы","criteria":"намерение повлиять на выборы или собрать средства","count":"нет данных"}],"norms":[{"address":"SEC. 2.
