and</DELETED>\n<DELETED> ``(B) prominently displayed on the front, or the\nprincipal display, of the container, using not less than 5\npercent of the area of the front, or the principal display, of\nthe container, and, as applicable, on 2 sides of any multi-pack\npackaging.</DELETED>\n<DELETED> ``(4) If it is a food, including a beverage, intended for\nhuman consumption and is offered for sale, and such food contains a\nnutrient of concern, such as added sugar, saturated fat, or sodium, or\nany other nutrient of concern, as the Secretary determines appropriate,\nat a level that increases, for individuals in the general population,\nthe risk of disease or a health-related condition, as defined by the\nSecretary, unless its label includes the following statement for each\nnutrient of concern: `High in', followed by the specific nutrient of\nconcern, and such statement is--</DELETED>\n<DELETED> ``(A) enclosed by an octagon border in bold type\nand readily legible under ordinary conditions; and</DELETED>\n<DELETED> ``(B) prominently displayed on the front, or the\nprincipal display, of the container, using not less than 5\npercent of the area of the front, or the principal display, of\nthe container, and, as applicable, on 2 sides of any multi-pack\npackaging.</DELETED>\n<DELETED> ``(5) The Secretary shall promulgate regulations to apply\nthe labeling requirements under subparagraphs (1), (2), (3), and (4)\nwith respect to food offered for sale by online retailers.</DELETED>\n<DELETED> ``(6) For purposes of this paragraph--</DELETED>\n<DELETED> ``(A) the term `high-intensity sweetener'--\n</DELETED>\n<DELETED> ``(i) means any synthetic, naturally\noccurring, or modified non-nutritive sweetener that is\nnot classified as sugar and is used as an ingredient in\nmanufactured food, or sold on its own to be added to\nfood; and</DELETED>\n<DELETED> ``(ii) includes acesulfame K, aspartame,\nadvantame, cyclamates, monk fruit, neotame, saccharin,\nsucralose, stevia, and stevia derivatives;</DELETED>\n<DELETED> ``(B) the term `sugar-sweetened beverage'--\n</DELETED>\n<DELETED> ``(i) means any beverage intended for\nhuman consumption to which one or more caloric\nsweeteners has been added and that contains 25 or more\ncalories per 12 fluid ounces of beverage; and</DELETED>\n<DELETED> ``(ii) includes drinks and beverages\ncommonly referred to as `soda', `pop', `cola', `soft\ndrinks', `sports drinks', `energy drinks', `slushies',\n`sweetened ice tea', `fruit juice', or any other drinks\nand beverage, as determined by the Secretary;\nand</DELETED>\n<DELETED> ``(iii) does not include--</DELETED>\n<DELETED> ``(I) infant formula;</DELETED>\n<DELETED> ``(II) any beverage for medical\nuse;</DELETED>\n<DELETED> ``(III) any beverage designed as\nsupplemental, meal replacement, or sole-source\nnutrition that includes proteins,\ncarbohydrates, and multiple vitamins and\nminerals;</DELETED>\n<DELETED> ``(IV) any milk product;</DELETED>\n<DELETED> ``(V) 100 percent natural fruit or\nvegetable juice; or</DELETED>\n<DELETED> ``(VI) any alcoholic beverage;\nand</DELETED>\n<DELETED> ``(C) the term `ultra-processed food'--</DELETED>\n<DELETED> ``(i) means a food, including a beverage,\ncontaining one or more industrial ingredients,\nincluding surface-active agents, stabilizers and\nthickeners, propellants, aerating agents and gases,\ncolor and coloring adjuncts, emulsifiers and emulsifier\nsalts, flavoring agents and adjuvants, flavor\nenhancers, surface-finishing, high-intensity\nsweeteners, and other ingredients, as the Secretary\ndetermines appropriate; and</DELETED>\n<DELETED> ``(ii) does not include--</DELETED>\n<DELETED> ``(I) any product that meets the\ndefinition of `healthy' set forth in current\nregulations promulgated by the Food and Drug\nAdministration; or</DELETED>\n<DELETED> ``(II) infant formula.'';\nand</DELETED>\n<DELETED> (2) in paragraph (r)--</DELETED>\n<DELETED> (A) in subparagraph (2)(A)(vi), by\ninserting ``, including if the Secretary determines\nthat the food is high in added sugar, saturated fat,\nsodium, or any other nutrient of concern (as determined\nby the Secretary pursuant to paragraph (z)(4)), or if\nthe food contains high-intensity sweetener or is an\nultra-processed food (as defined in paragraph\n(z)(6)(C))'' before the period at the end;\nand</DELETED>\n<DELETED> (B) in subparagraph (3)(A)--</DELETED>\n<DELETED> (i) in subclause (i), by striking\n``, and'' and inserting a semicolon;</DELETED>\n<DELETED> (ii) in subclause (ii), by\nstriking the period and inserting ``; RESEARCH AND COLLABORATION ON NUTRITION\nSCIENCE.</DELETED>\n\n<DELETED> ``(a) In General.--The Director of NIH shall expand,\nintensify, and coordinate programs, such as the Nutrition Regulatory\nScience Program, for the conduct and support of research with respect\nto nutrition science, including research on--</DELETED>\n<DELETED> ``(1) the health effects of ultra-processed foods\non consumers;</DELETED>\n<DELETED> ``(2) the specific food and beverage ingredients,\nadditives, sweeteners, and chemicals within ultra-processed\nfoods that may be harmful to health;</DELETED>\n<DELETED> ``(3) the safety profile of food and beverage\ningredients, additives, sweeteners, and chemicals that have\nbeen self-affirmed by food and beverage manufacturers as\ngenerally recognized as safe without review of such status by\nthe Food and Drug Administration; and</DELETED>\n<DELETED> ``(4) the formulation of ultra-processed foods to\nhave hyper-palatable qualities and association with\naddiction.</DELETED>\n<DELETED> ``(b) Meetings on Nutrition.--</DELETED>\n<DELETED> ``(1) In general.--Not later than 1 year after the\ndate of enactment of the Childhood Diabetes Reduction Act of\n2026, and every 5 years thereafter, the Director of NIH, in\ncoordination with the Commissioner of Food and Drugs and the\nheads of other agencies, as appropriate, shall convene a public\nmeeting for the purpose of discussing research efforts aimed at\nimproving nutrition and reducing the incidence of diet-related\nchronic disease, with the goal of informing Federal\npolicy.</DELETED>\n<DELETED> ``(2) Participants.--</DELETED>\n<DELETED> ``(A) In general.--Each meeting under\nparagraph (1) shall involve a diverse group of\nstakeholders, including food scientists and\nresearchers, registered dietitians and nutritionists,\nclinicians specializing in nutrition-related diseases,\nFederal stakeholders, and nongovernmental organizations\nfocused on nutrition and health.</DELETED>\n<DELETED> ``(B) Consideration.--In selecting\nstakeholders described in subparagraph (A) for\nparticipation in each meeting under paragraph (1), the\nDirector of NIH shall ensure that stakeholders who are\nspeaking at the meeting have no financial affiliation\nwith manufacturers of ultra-processed food.</DELETED>\n<DELETED> ``(3) Topics.--Each meeting under paragraph (1)\nshall include discussion of--</DELETED>\n<DELETED> ``(A) current research findings related to\nnutrition and chronic disease, including the impact of\nfood labeling requirements under section 403(z) of the\nFederal Food, Drug, and Cosmetic Act;</DELETED>\n<DELETED> ``(B) any gaps in such research and\npriorities for future research;</DELETED>\n<DELETED> ``(C) evidence-based practices for\nimproving nutrition and innovative approaches to\nprevent and manage chronic conditions through dietary\ninnovations; and</DELETED>\n<DELETED> ``(D) such other topics as the Director of\nNIH determines appropriate.</DELETED>\n<DELETED> ``(4) Report to congress.--The Director NIH, in\ncoordination with the Commissioner of Food and Drugs, shall\nsubmit a report on each meeting under paragraph (1) to the\nCommittee on Health, Education, Labor, and Pensions of the\nSenate and the Committee on Energy and Commerce of the House of\nRepresentatives, and shall make each such report publicly\navailable on the website of the National Institutes of\nHealth.</DELETED>\n<DELETED> ``(c) Definition.--In this section, the term `ultra-\nprocessed food' has the meaning given such term in section 403(z)(6) of\nthe Federal Food, Drug, and Cosmetic Act.</DELETED>\n<DELETED> ``(d) Authorization of Appropriations.--For the purpose of\ncarrying out this section, there are authorized to be appropriated\n$60,000,000 for each fiscal years 2027 through 2031.''.</DELETED>\n\n<DELETED>SEC. 103. NUTRITION AND PHYSICAL ACTIVITY PUBLIC EDUCATION\nCAMPAIGN.</DELETED>\n\n<DELETED> Title III of the Public Health Service Act (42 U.S.C. 241\net seq.) is amended by striking section 399Y and inserting the\nfollowing:</DELETED>\n\n<DELETED>``SEC. 399Y. NUTRITION AND PHYSICAL ACTIVITY PUBLIC EDUCATION\nCAMPAIGN.</DELETED>\n\n<DELETED> ``(a) In General.--The Secretary, acting through the\nDirector of the Centers for Disease Control and Prevention, and in\ncollaboration with national, State, Tribal, and local partners,\nphysical activity organizations, nutrition experts, physical activity\nexperts, health professional organizations, and other organizations, as\nappropriate, shall develop a national public campaign to educate the\npublic, including adults, children, and caregivers, concerning--\n</DELETED>\n<DELETED> ``(1) how to read and understand the nutrient\nwarning labels required under subparagraphs (1) through (4) of\nsection 403(z) of the Federal Food, Drug, and Cosmetic\nAct;</DELETED>\n<DELETED> ``(2) the health risks associated with obesity,\ninactivity, and poor nutrition, including consumption of foods\ndescribed in subparagraphs (1) through (4) of section 403(z) of\nthe Federal Food, Drug, and Cosmetic Act;</DELETED>\n<DELETED> ``(3) ways to incorporate physical activity into\ndaily living;</DELETED>\n<DELETED> ``(4) ways to support a healthy lifestyle and\nreduce the risk of chronic illness, including\nobesity;</DELETED>\n<DELETED> ``(5) the benefits of good nutrition;\nand</DELETED>\n<DELETED> ``(6) strategies to improve eating and drinking\nhabits, such as identifying and selecting healthier food\nchoices and reducing consumption of added sugars, saturated\nfat, and sodium.</DELETED>\n<DELETED> ``(b) Authorization of Appropriations.--There are\nauthorized to be appropriated to carry out this section $10,000,000 for\neach of the fiscal years 2027 through 2031.''.</DELETED>\n\n<DELETED>TITLE II--FEDERAL TRADE COMMISSION</DELETED>\n\n<DELETED>SEC. 201. DEFINITIONS.</DELETED>\n\n<DELETED> In this title:</DELETED>\n<DELETED> (1) Child.--The term ``child'' means an individual\nwho is under the age of 13.</DELETED>\n<DELETED> (2) Child-directed advertising.--The term ``child-\ndirected advertising'' means any advertisement--</DELETED>\n<DELETED> (A) that uses themes or promotional\nstrategies that appeal to children, which may include\nthe use of--</DELETED>\n<DELETED> (i) fun or fantasy themes, cartoon\ncharacters, social media influencers,\nanimation, endorsements by celebrities and\nathletes, cross-promotions using fictional\ncharacters, children's music, actors, or\nsituations representing children's daily life;\nor</DELETED>\n<DELETED> (ii) free gifts or toys, contests,\ninteractive games, or mobile or computer\napplications; or</DELETED>\n<DELETED> (B) in media for which children comprise\nat least 30 percent of the audience, as determined by\nthe Commission, that is displayed using--</DELETED>\n<DELETED> (i) traditional measured media,\nsuch as television, radio, and printed media;\nor</DELETED>\n<DELETED> (ii) electronic media, content\ncreated by influencers, online videos, company-\nsponsored websites, social media, movies, and\nvideo games.</DELETED>\n<DELETED> (3) Commission.--The term ``Commission'' means the\nFederal Trade Commission.</DELETED>\n<DELETED> (4) Junk food.--The term ``junk food'' means\nproducts with labeling requirements described in subparagraph\n(1), (2), (3), or (4) of paragraph (z) of section 403 of the\nFederal Food, Drug, and Cosmetic Act (21 U.S.C. 343), as added\nby section 101(a) of this Act.</DELETED>\n\n<DELETED>SEC. 202. RESTRICTIONS ON ADVERTISEMENTS FOR JUNK FOOD\nDIRECTED AT CHILDREN; REQUIRED DISCLOSURE OF ANY HEALTH\nAND NUTRIENT WARNING LABEL IN ADVERTISEMENTS.</DELETED>\n\n<DELETED> (a) Marketing or Advertising Junk Food to Children.--\n</DELETED>\n<DELETED> (1) In general.--It shall be unlawful for any\nperson to market or advertise, or produce or distribute any\nadvertisement or marketing material for, junk food by using\nchild-directed advertising.</DELETED>\n<DELETED> (2) Considerations.--In determining whether any\nmarketing or advertising uses child-directed advertising for\npurposes of subparagraph (A), the Commission shall consider the\ntotality of the circumstances.</DELETED>\n<DELETED> (b) Required Disclosure.--It shall be unlawful for any\nperson to market or advertise, or produce or distribute any\nadvertisement or marketing material for, junk food without including in\nsuch advertisement or marketing material the relevant mandatory health\nor nutrient warning label or notice described in section 403(z) of the\nFederal Food, Drug, and Cosmetic Act (21 U.S.C. 343(z)).</DELETED>\n<DELETED> (c) Effective Date.--The prohibitions established in this\nsection shall take effect on the date that is 1 year after the date of\nenactment of this Act.</DELETED>\n<DELETED> (d) Enforcement by the Commission.--</DELETED>\n<DELETED> (1) Unfair or deceptive act or practice.--A\nviolation of this section or a regulation promulgated under\nthis section shall be treated as a violation of a rule defining\nan unfair or deceptive act or practice under section\n18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C.\n57a(a)(1)(B)).</DELETED>\n<DELETED> (2) Powers of the commission.--</DELETED>\n<DELETED> (A) In general.--Except as provided in\nsubparagraph (C), the Commission shall enforce this\nsection in the same manner, by the same means, and with\nthe same jurisdiction, powers, and duties as though all\napplicable terms and provisions of the Federal Trade\nCommission Act (15 U.S.C. 41 et seq.) were incorporated\ninto and made a part of this section.</DELETED>\n<DELETED> (B) Privileges and immunities.--Except as\nprovided in subparagraph (C), any person who violates\nthis section or a regulation promulgated under this\nsection shall be subject to the penalties and entitled\nto the privileges and immunities provided in the\nFederal Trade Commission Act (15 U.S.C. 41 et\nseq.).</DELETED>\n<DELETED> (C) Common carriers.--Notwithstanding\nsection 4, 5(a)(2), or 6 of the Federal Trade\nCommission Act (15 U.S.C. 44, 45(a)(2), 46) or any\njurisdictional limitation of the Commission, the\nCommission shall also enforce this Act, in the same\nmanner provided in subparagraphs (A) and (B), with\nrespect to common carriers subject to the\nCommunications Act of 1934 (47 U.S.C. 151 et seq.) and\nActs amendatory thereof and supplementary\nthereto.</DELETED>\n<DELETED> (D) Authority preserved.--Nothing in this\nsection shall be construed to limit the authority of\nthe Commission under any other provision of\nlaw.</DELETED>\n<DELETED> (E) Rulemaking.--The Commission shall\npromulgate in accordance with section 553 of title 5,\nUnited States Code, such rules as may be necessary to\ncarry out this section.</DELETED>\n\n<DELETED>SEC. 203. RESTORING THE FEDERAL TRADE COMMISSION'S ABILITY TO\nPROMULGATE RULES ON CHILDREN'S ADVERTISING.</DELETED>\n\n<DELETED> (a) In General.--Section 18(h) of the Federal Trade\nCommission Act (15 U.S.C. 57a(h)) is repealed.</DELETED>\n<DELETED> (b) Conforming Amendment.--Section 18(a)(1) of such Act is\namended in the matter preceding subparagraph (A), by striking ``Except\nas provided in subsection (h), the Commission'' and inserting ``The\nCommission''.</DELETED>\n\nSECTION 1. SHORT TITLE; TABLE OF CONTENTS.\n\n(a) Short Title.--This Act may be cited as the ``Childhood Diabetes\nReduction Act of 2026''.\n(b) Table of Contents.--The table of contents for this Act is as\nfollows:\n\nSec. 1. Short title; table of contents.\n\nTITLE I--DEPARTMENT OF HEALTH AND HUMAN SERVICES\n\nSec. 101. Restrictions on advertisements for junk food directed at\nchildren; required disclosure of any health\nand nutrient warning label in\nadvertisements.\nSec. 203. Restoring the Federal Trade Commission's ability to\npromulgate rules on children's advertising.\n\nTITLE I--DEPARTMENT OF HEALTH AND HUMAN SERVICES\n\nSEC. 101. FRONT OF PACKAGE NUTRITION LABELING OF FOODS; RESTRICTION ON\nCERTAIN ADVERTISEMENTS DIRECTED AT CHILDREN.\n\n(a) Front of Package Nutrition Labeling.--Section 403 of the\nFederal Food, Drug, and Cosmetic Act (21 U.S.C. 343) is amended--\n(1) by adding at the end the following:\n``(z)(1) If it is a sugar-sweetened beverage intended for human\nconsumption and is offered for sale, unless its label includes the\nfollowing statement: `Food and Drug Administration Warning: Drinking\nbeverages with added sugar can contribute to obesity, type 2 diabetes,\nand tooth decay. Not recommended for children.', and such statement\nis--\n``(A) enclosed by a rectangular border in bold type and\nreadily legible under ordinary conditions alongside an icon\ncomprised of an exclamation point contained within a triangle;\nand\n``(B) prominently displayed on the front, or the principal\ndisplay, of the container, using not less than 5 percent of the\narea of the front, or the principal display, of the container,\nand, as applicable, on 2 sides of any multi-pack packaging.\n``(2) If it is a food, including a beverage, containing any high-\nintensity sweetener intended for human consumption and is offered for\nsale, unless its label includes the following statement: `Food and Drug\nAdministration Warning: Contains high-intensity sweetener. Not\nrecommended for children.', and such statement is--\n``(A) enclosed by a rectangular border in bold type and\nreadily legible under ordinary conditions alongside an icon\ncomprised of an exclamation point contained within a triangle;\nand\n``(B) prominently displayed on the front, or the principal\ndisplay, of the container, using not less than 5 percent of the\narea of the front, or the principal display, of the container,\nand, as applicable, on 2 sides of any multi-pack packaging.\n``(3) If it is an ultra-processed food, including a beverage,\nintended for human consumption and is offered for sale, unless its\nlabel includes the following statement: `Food and Drug Administration\nWarning: Consuming ultra-processed foods and drinks can cause weight\ngain, which increases the risk of obesity and type 2 diabetes.', and\nsuch statement is--\n``(A) enclosed by a rectangular border in bold type and\nreadily legible under ordinary conditions alongside an icon\ncomprised of an exclamation point contained within a triangle;\nand\n``(B) prominently displayed on the front, or the principal\ndisplay, of the container, using not less than 5 percent of the\narea of the front, or the principal display, of the container,\nand, as applicable, on 2 sides of any multi-pack packaging.\n``(4) If it is a food, including a beverage, intended for human\nconsumption and is offered for sale, and such food contains a nutrient\nof concern, such as added sugar, saturated fat, or sodium, or any other\nnutrient of concern, as the Secretary determines appropriate, at a\nlevel that increases, for individuals in the general population, the\nrisk of disease or a health-related condition, as defined by the\nSecretary, unless its label includes the following statement for each\nnutrient of concern: `High in', followed by the specific nutrient of\nconcern, and such statement is--\n``(A) enclosed by an octagonal border in bold type and\nreadily legible under ordinary conditions; and\n``(B) prominently displayed on the front, or the principal\ndisplay, of the container, using not less than 5 percent of the\narea of the front, or the principal display, of the container,\nand, as applicable, on 2 sides of any multi-pack packaging.\n``(5) For purposes of this paragraph--\n``(A) the term `high-intensity sweetener'--\n``(i) means any synthetic, naturally occurring, or\nmodified non-nutritive sweetener that is not classified\nas sugar and is used as an ingredient in manufactured\nfood, or sold on its own to be added to food; and\n``(ii) includes acesulfame K, aspartame, advantame,\ncyclamates, monk fruit, neotame, saccharin, sucralose,\nstevia, and stevia derivatives;\n``(B) the term `sugar-sweetened beverage'--\n``(i) means any beverage intended for human\nconsumption to which one or more caloric sweeteners has\nbeen added and that contains 25 or more calories per 12\nfluid ounces of beverage; and\n``(ii) includes drinks and beverages commonly\nreferred to as `soda', `pop', `cola', `soft drinks',\n`sports drinks', `energy drinks', `slushies',\n`sweetened ice tea', `fruit juice', or any other drinks\nand beverage, as determined by the Secretary; and\n``(iii) does not include--\n``(I) any critical food, as defined in\nsection 201(ss);\n``(II) any beverage designed as\nsupplemental, meal replacement, or sole-source\nnutrition that includes proteins,\ncarbohydrates, and multiple vitamins and\nminerals;\n``(III) 100 percent natural fruit or\nvegetable juice;\n``(IV) any alcoholic beverage; or\n``(V) any other product that the Secretary\ndetermines appropriate; and\n``(C) the term `ultra-processed food'--\n``(i) means a food, including a beverage,\ncontaining one or more industrial ingredients,\nincluding surface-active agents, stabilizers and\nthickeners, propellants, aerating agents and gases,\ncolor and coloring adjuncts, emulsifiers and emulsifier\nsalts, flavoring agents and adjuvants, flavor\nenhancers, surface-finishing, high-intensity\nsweeteners, and other ingredients, as the Secretary\ndetermines appropriate; and\n``(ii) does not include--\n``(I) any product that meets the definition\nof `healthy' set forth in current regulations\npromulgated by the Food and Drug\nAdministration;\n``(II) any critical food, as defined in\nsection 201(ss); or\n``(III) any other product that the\nSecretary determines appropriate.\n``(6) The Secretary shall promulgate regulations, as appropriate,\nwith respect to the labeling requirements under subparagraphs (1), (2),\n(3), and (4), which may include--\n``(A) information on minimum font size, spacing in\ncomparison to other required statements, and steps to comply\nfor products with small packaging;\n``(B) information on how the labeling requirements may be\napplied to online retailers; and\n``(C) additional information the Secretary determines to be\nnecessary to assist with compliance with the labeling\nrequirements.''; and\n(2) in paragraph (r)(2)(A)(vi), by inserting ``, including\nif the Secretary determines that the food is high in added\nsugar, saturated fat, sodium, or any other nutrient of concern\n(as determined by the Secretary pursuant to paragraph (z)(4)),\nor if the food contains high-intensity sweetener or is an\nultra-processed food (as defined in paragraph (z)(5)(C))''\nbefore the period at the end.\n(b) Advertising.--Section 301 of the Federal Food, Drug, and\nCosmetic Act (21 U.S.C. 331) is amended by adding at the end the\nfollowing:\n``(jjj)(1) Marketing or advertising a food for which labeling is\nrequired under section 403(z), in a manner that reasonably appears to\nbe directed at children.\n``(2) In determining whether any marketing or advertising\nreasonably appears to be directed to children for purposes of\nsubparagraph (1), the Secretary shall consider the totality of the\ncircumstances, including whether such marketing or advertising uses\nthemes or promotional strategies for food described in section 403(z)\nthat appeal to children, such as the use of fun or fantasy themes,\nathletes and celebrities, cross-promotions using fictional characters,\ncartoon characters, social media influencers, animation, children's\nmusic, actors, or situations representing children's daily life, or\nfree gifts or toys, contests, interactive games, or mobile or computer\napplications.''.\n(c) Authorization of Appropriations.--There is authorized to be\nappropriated to the Secretary of Health and Human Services such sums as\nmay be necessary for each of fiscal years 2027 through 2031 for\npurposes of promulgating regulations and carrying out enforcement\nactivities with respect to the labeling requirements under the\namendments made by subsections (a) and (b).\n(d) Effective Date.--The amendments made by this section shall take\neffect 1 year after the date of enactment of this Act.\n\nSEC. 102. NATIONAL INSTITUTES OF HEALTH RESEARCH ON NUTRITION SCIENCE.\n\nPart A of title IV of the Public Health Service Act (42 U.S.C. 281\net seq.) is amended by adding at the end the following:\n\n``SEC. 404P. RESEARCH AND COLLABORATION ON NUTRITION SCIENCE.\n\n``(a) In General.--The Director of NIH shall, as appropriate,\nexpand, intensify, and coordinate the activities of the National\nInstitutes of Health with respect to nutrition science, including basic\nand clinical research on--\n``(1) the effects of food and dietary patterns, including\nultra-processed foods, on health;\n``(2) the effects of food processing, formulation,\ningredients, and additives on health and food consumption;\n``(3) the biological and health effects of food ingredients\nand additives, including research to address gaps in available\nevidence;\n``(4) the effects of food formulation and processing on\neating behavior, energy intake, and patterns of consumption,\nincluding relevant biological and behavioral mechanisms; and\n``(5) evidence-based approaches to improve nutrition and\nprevent or manage chronic disease related to diet.\n``(b) Coordination and Stakeholder Input.--In carrying out this\nsection, the Director of NIH shall coordinate, as appropriate, with the\nCommissioner of Food and Drugs and the heads of other relevant Federal\nagencies, and may consult with researchers, clinicians, patients, and\nother relevant stakeholders.\n``(c) Definition.--In this section, the term `ultra-processed food'\nhas the meaning given such term in section 403(z)(5) of the Federal\nFood, Drug, and Cosmetic Act.''.\n\nSEC. 103. NUTRITION AND PHYSICAL ACTIVITY PUBLIC EDUCATION CAMPAIGN.\n\nSection 399Y of the Public Health Service Act (42 U.S.C. 280h-2) is\namended--\n(1) in the section heading, by inserting ``nutrition and\nphysical activity public'' before ``education campaign'';\n(2) in subsection (a), by striking ``, and in collaboration\nwith'' and all that follows through the period at the end and\ninserting ``and in coordination with the Office of the\nAssistant Secretary of Health, shall, as appropriate, conduct\nor support public education activities concerning nutrition,\nphysical activity, and the prevention of chronic disease\nrelated to diet.'';\n(3) by redesignating subsection (b) as subsection (d);\n(4) by inserting after subsection (a) the following:\n``(b) Activities.--Activities conducted or supported under\nsubsection (a) may include the dissemination of evidence-based\ninformation concerning--\n``(1) the health risks associated with obesity, inactivity,\nand poor nutrition;\n``(2) the relationship between nutrition, physical\nactivity, and chronic disease;\n``(3) the use of nutrition information, including\ninformation provided on food labels, to inform dietary choices;\nand\n``(4) strategies to support healthy eating and physical\nactivity.\n``(c) Coordination.--In carrying out this section, the Secretary\nmay coordinate with other relevant Federal agencies and consult with\nState, local, and Tribal public health agencies, health professionals,\nand other relevant stakeholders, as appropriate.''; and\n(5) in subsection (d), as so redesignated, by striking\n``2001 through 2005'' and inserting ``2027 through 2031''.\n\nTITLE II--FEDERAL TRADE COMMISSION\n\nSEC. 201. RESTRICTIONS ON ADVERTISEMENTS FOR JUNK FOOD DIRECTED AT\nCHILDREN; REQUIRED DISCLOSURE OF ANY HEALTH AND NUTRIENT\nWARNING LABEL IN ADVERTISEMENTS.\n\n(a) Marketing or Advertising Junk Food to Children.--\n(1) In general.--It shall be unlawful for any person to\nmarket or advertise, or produce or distribute any advertisement\nor marketing material for, junk food by using child-directed\nadvertising.\n(2) Considerations.--In determining whether any marketing\nor advertising uses child-directed advertising for purposes of\nsubparagraph (A), the Commission shall consider the totality of\nthe circumstances.\n(b) Required Disclosure.--It shall be unlawful for any person to\nmarket or advertise, or produce or distribute any advertisement or\nmarketing material for, junk food without including in such\nadvertisement or marketing material the relevant mandatory health or\nnutrient warning label or notice described in section 403(z) of the\nFederal Food, Drug, and Cosmetic Act (21 U.S.C. 343(z)).\n(c) Effective Date.--The prohibitions established in this section\nshall take effect on the date that is 1 year after the date of\nenactment of this Act.\n(d) Enforcement by the Commission.--\n(1) Unfair or deceptive act or practice.--A violation of\nthis section or a regulation promulgated under this section\nshall be treated as a violation of a rule defining an unfair or\ndeceptive act or practice under section 18(a)(1)(B) of the\nFederal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)).\n(2) Powers of the commission.--\n(A) In general.--Except as provided in subparagraph\n(C), the Commission shall enforce this section in the\nsame manner, by the same means, and with the same\njurisdiction, powers, and duties as though all\napplicable terms and provisions of the Federal Trade\nCommission Act (15 U.S.C. 41 et seq.) were incorporated\ninto and made a part of this section.\n(B) Privileges and immunities.--Except as provided\nin subparagraph (C), any person who violates this\nsection or a regulation promulgated under this section\nshall be subject to the penalties and entitled to the\nprivileges and immunities provided in the Federal Trade\nCommission Act (15 U.S.C. 41 et seq.).\n(C) Common carriers.--Notwithstanding section 4,\n5(a)(2), or 6 of the Federal Trade Commission Act (15\nU.S.C. 44, 45(a)(2), 46) or any jurisdictional\nlimitation of the Commission, the Commission shall also\nenforce this Act, in the same manner provided in\nsubparagraphs (A) and (B), with respect to common\ncarriers subject to the Communications Act of 1934 (47\nU.S.C. 151 et seq.) and Acts amendatory thereof and\nsupplementary thereto.\n(D) Authority preserved.--Nothing in this section\nshall be construed to limit the authority of the\nCommission under any other provision of law.\n(E) Rulemaking.--The Commission shall promulgate in\naccordance with section 553 of title 5, United States\nCode, such rules as may be necessary to carry out this\nsection.\n\nSEC. 203.
