CIVIL LIBERTIES REVIEW OF FBI QUERIES.\n\n(a) Requirement.--Subsection (f)(3) of section 702 of the Foreign\nIntelligence Surveillance Act of 1978 (50 U.S.C. 1881a) is amended--\n(1) in subparagraph (D)--\n(A) by redesignating clauses (iv) through (vi) as\nclauses (v) through (vii), respectively;\n(B) by inserting after clause (iii) the following\nnew clause:\n``(iv) Monthly civil liberties review.--A\nrequirement that the Federal Bureau of\nInvestigation, on a monthly basis, provides to\nthe Civil Liberties Protection Officer within\nthe Office of the Director of National\nIntelligence the written statements regarding\neach United States person query submitted in\nthe previous month under clause (iii).'';\n(C) in clause (vi), as so redesignated, by striking\n``(iv)'' and inserting ``(v)''; and\n(D) by conforming the margin of clause (vii), as so\nredesignated, to the margin of the other clauses; and\n(2) by adding at the end the following new subparagraph:\n``(E) Civil liberties reviews and investigations.--\n``(i) Civil liberties protection officer.--\nThe Civil Liberties Protection Officer within\nthe Office of the Director of National\nIntelligence shall review each written\nstatement regarding a United States person\nquery submitted under subparagraph (D)(iv) to\ndetermine whether the query meets the standards\nrequired by the procedures adopted under\nparagraph (1). If the Civil Liberties\nProtection Officer determines that the query\ndid not meet such standards or there exists\npossible abuses of civil liberties and privacy,\nthe Civil Liberties Protection Officer shall\nrefer the query to the Inspector General of the\nIntelligence Community.\n``(ii) Inspector general of the\nintelligence community.--The Inspector General\nof the Intelligence Community shall determine\nwhether each query referred under clause (i)\nconstitutes a violation of laws, rules, or\nregulations or an abuse of authority.''.\n(b) Conforming Amendments.--The National Security Act of 1947 (50\nU.S.C. 3001 et seq.) is amended--\n(1) in section 103D (50 U.S.C. 3029)--\n(A) in subsection (b)--\n(i) in paragraph (6), by striking ``; and''\nand inserting a semicolon;\n(ii) by redesignating paragraph (7) as\nparagraph (8); and\n(iii) by inserting after paragraph (6) the\nfollowing new paragraph (7):\n``(7) review each written statement submitted to the Civil\nLiberties Protection Officer under section 702(f)(3) of the\nForeign Intelligence Surveillance Act of 1978 (50 U.S.C.\n1881a(f)(3)); and''; and\n(B) in subsection (c), by inserting before the\nperiod at the end the following: ``, and, based on the\nreviews specified in paragraph (7) of such subsection,\nshall make referrals to the Inspector General of the\nIntelligence Community under section 702(f)(3) of the\nForeign Intelligence Surveillance Act of 1978 (50\nU.S.C. 1881a(f)(3))''; and\n(2) in section 103H(g)(3)(A) (50 U.S.C. 3033(g)(3)(A)), by\ninserting after ``and safety'' the following: ``(including with\nrespect to referrals from the Civil Liberties Protection\nOfficer pursuant to section 702(f)(3) of the Foreign\nIntelligence Surveillance Act of 1978 (50 U.S.C.\n1881a(f)(3))''.\n\nSEC. 102. CRIMINAL PENALTIES FOR VIOLATION OF PROHIBITION ON QUERIES.\n\n(a) In General.--Section 709 of the Foreign Intelligence\nSurveillance Act of 1978 (50 U.S.C. 1881h) is amended--\n(1) in the heading, by striking ``unauthorized disclosure''\nand inserting ``unauthorized disclosure and other actions'';\n(2) in subsection (a)--\n(A) by striking ``if that person knowingly'' and\ninserting the following: ``if that person--''\n``(1) knowingly'';\n(B) by striking ``party.'' and inserting\n``party;''; and\n(C) by adding at the end the following new\nparagraphs:\n``(2) while serving as an employee or officer of the\nFederal Bureau of Investigation, knowingly and willfully\nviolates the querying procedures adopted under section\n702(f)(1)(A) relating to United States person queries; or\n``(3) knowingly and willfully falsifies or materially\nmisrepresents complying with the procedures or requirements for\nquerying information acquired under section 702(a).''; and\n(3) in subsection (b)--\n(A) by striking ``offense in this section'' and\ninserting the following: ``offense--\n``(1) in paragraph (1) of subsection (a)'';\n(B) by striking ``title 18'' and inserting ``title\n18, United States Code'';\n(C) by striking ``both.'' and inserting ``both;\nand''; and\n(D) by adding at the end the following new\nparagraph:\n``(2) in paragraph (2) or (3) of subsection (a), shall be\nfined under title 18, United States Code, imprisoned for not\nmore than 5 years, or both.''.\n(b) Table of Contents Amendment.--The table of contents at the\nbeginning of such Act is amended by striking the item relating to\nsection 709 and inserting the following new item:\n\n``Sec. 709. Penalties for unauthorized disclosure and other actions.''.\n\nSEC. 103. REQUIREMENT FOR TARGETING UNITED STATES PERSONS UNDER THE\nFOREIGN INTELLIGENCE SURVEILLANCE ACT OF 1978.\n\nSection 702 of the Foreign Intelligence Surveillance Act of 1978\n(50 U.S.C. 1881a) is amended by adding at the end the following new\nsubsection:\n``(o) Fourth Amendment Requirement for Targeting United States\nPersons.--\n``(1) Prohibition on targeting united states persons.--In\naccordance with subsection (b), no officer or employee of the\nUnited States Government may intentionally target a United\nStates person for an acquisition under section 702.\n``(2) Order requirements for targeting united states\npersons.--In accordance with the other provisions of this Act\nand the Federal Rules of Criminal Procedure, with respect to a\nUnited States person, the United States Government may seek--\n``(A) an order authorizing electronic surveillance\nin accordance with title I;\n``(B) an order authorizing a physical search in\naccordance with title III;\n``(C) an order authorizing an acquisition in\naccordance with section 703, 704, or 705; or\n``(D) a warrant issued pursuant to the Federal\nRules of Criminal Procedure by a court of competent\njurisdiction.''.\n\nSEC. 104. ATTENDANCE PROCEDURES FOR MEMBER ACCESS TO THE FOREIGN\nINTELLIGENCE SURVEILLANCE COURT AND FOREIGN INTELLIGENCE\nSURVEILLANCE COURT OF REVIEW.\n\nNot later than 60 days after the date of the enactment of this Act,\nthe Attorney General shall--\n(1) revoke the procedures issued by the Attorney General on\nor before December 31, 2025, pursuant to section 5(d) of the\nReforming Intelligence and Securing America Act (Public Law\n118-49; 50 U.S.C. 1803 note); and\n(2) issue new procedures that comply with such section and\nensure the access of the Members of Congress and staff\nspecified in such section to any proceeding of the Foreign\nIntelligence Surveillance Court or any proceeding of the\nForeign Intelligence Surveillance Court of Review.\n\nSEC. 105. REQUIREMENT FOR ATTORNEY APPROVAL OF FBI QUERIES USING UNITED\nSTATES PERSON QUERY TERM.\n\nSection 702(f)(3)(A)(i) of the Foreign Intelligence Surveillance\nAct of 1978 (50 U.S.C. 1881a(f)(3)(A)(i)) is amended by striking\n``supervisor (or employee of equivalent or greater rank) or''.\n\nSEC. 106. GOVERNMENT ACCOUNTABILITY OFFICE AUDIT OF TARGETING\nPROCEDURES UNDER SECTION 702 OF THE FOREIGN INTELLIGENCE\nSURVEILLANCE ACT OF 1978.\n\n(a) Audit.--The Comptroller General of the United States shall\nconduct an audit of the targeting procedures used for acquisitions\nunder section 702 of the Foreign Intelligence Surveillance Act of 1978\n(50 U.S.C. 1881a), including the technical mechanisms, implementation,\nand operations used by the Federal Government for targeting\ncapabilities.\n(b) Report.--Not later than one year after the date of the\nenactment of this Act, the Comptroller General shall submit to the\nPermanent Select Committee on Intelligence and the Committee on the\nJudiciary of the House of Representatives and the Select Committee on\nIntelligence and the Committee on the Judiciary of the Senate a report\ncontaining the results of the audit required by subsection (a),\nincluding an analysis of whether the targeting procedures as\nimplemented are appropriately limiting targeting under section 702 of\nthe Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1881a) to\nnon-United States persons located outside of the United States.\n\nSEC. 107. EXTENSION OF AUTHORITIES OF TITLE VII OF THE FOREIGN\nINTELLIGENCE SURVEILLANCE ACT OF 1978.\n\n(a) Extension of Repeal Date of Title VII.--Section 403(b) of the\nFISA Amendments Act of 2008 (Public Law 110-261), as most recently\namended by Public Law 119-84, is further amended--\n(1) in paragraph (1) (50 U.S.C. 1881 note) by striking\n``April 30, 2026'' and inserting ``April 30, 2029''; and\n(2) in paragraph (2) (18 U.S.C. 2511 note), in the matter\npreceding subparagraph (A), by striking ``April 30, 2026'' and\ninserting ``April 30, 2029''.\n(b) Effective Date.--The amendments made by this section shall take\neffect on the earlier of the date of the enactment of this Act or April\n29, 2026.\n\nTITLE II--ANTI-CBDC SURVEILLANCE STATE ACT\n\nSEC. 201. SHORT TITLE.\n\nThis title may be cited as the ``Anti-CBDC Surveillance State\nAct''.\n\nSEC. 202. PROHIBITION ON FEDERAL RESERVE BANKS RELATING TO CERTAIN\nPRODUCTS OR SERVICES FOR INDIVIDUALS AND PROHIBITION ON\nDIRECTLY ISSUING A CENTRAL BANK DIGITAL CURRENCY.\n\nSection 16 of the Federal Reserve Act (12 U.S.C. 411 et seq.) is\namended by adding at the end the following new paragraph:\n``(18)(A) A Federal reserve bank may not--\n``(i) offer financial products or services directly to an\nindividual;\n``(ii) maintain an account on behalf of an individual; or\n``(iii) issue a central bank digital currency, or any digital asset\nthat is substantially similar under any other name or label.\n``(B) In this paragraph, the term `central bank digital currency'\nhas the meaning given that term under section 10(11)(D).''.\n\nSEC. 203. PROHIBITION ON FEDERAL RESERVE BANKS INDIRECTLY ISSUING A\nCENTRAL BANK DIGITAL CURRENCY.\n\nSection 16 of the Federal Reserve Act (12 U.S.C. 411 et seq.), as\namended by section 2, is further amended by adding at the end the\nfollowing paragraph:\n``(19)(A) A Federal reserve bank may not offer a central bank\ndigital currency, or any digital asset that is substantially similar\nunder any other name or label, indirectly to an individual through a\nfinancial institution or other intermediary.\n``(B) In this paragraph, the term `central bank digital currency'\nhas the meaning given that term under section 10(11)(D).''.\n\nSEC. 204. PROHIBITION WITH RESPECT TO CENTRAL BANK DIGITAL CURRENCY.\n\nSection 10 of the Federal Reserve Act (12 U.S.C. 241 et seq.) is\namended by inserting before paragraph (12) the following:\n``(11) Prohibition with respect to central bank digital\ncurrency.--\n``(A) In general.--The Board of Governors of the\nFederal Reserve System may not test, study, develop,\ncreate, or implement a central bank digital currency,\nor any digital asset that is substantially similar\nunder any other name or label.\n``(B) Monetary policy.--The Board of Governors of\nthe Federal Reserve System and the Federal Open Market\nCommittee may not use a central bank digital currency\nto implement monetary policy, or any digital asset that\nis substantially similar under any other name or label.\n``(C) Exception.--Subparagraph (A) and sections\n16(18)(A)(iii) and 16(19)(A) may not be construed to\nprohibit any dollar-denominated currency that is open,\npermissionless, and private, and fully preserves the\nprivacy protections of United States coins and physical\ncurrency.\n``(D) Central bank digital currency defined.--In\nthis paragraph, the term `central bank digital\ncurrency' means a form of digital money or monetary\nvalue that is--\n``(i) denominated in the national unit of\naccount;\n``(ii) a direct liability of the Federal\nReserve System; and\n``(iii) widely available to the general\npublic.''.\n\nSEC. 205.
