SHORT TITLE.\n\nThis Act may be cited as the ``Artificial Intelligence Practices,\nLogistics, Actions, and Necessities Act'' or the ``AI PLAN Act''.\n\nSEC. 2. STRATEGY TO DEFEND AGAINST RISKS POSED BY THE USE OF ARTIFICIAL\nINTELLIGENCE BY ADVERSARIAL ACTORS.\n\n(a) Sense of Congress.--It is the sense of Congress that the\ndevelopment and use of artificial intelligence in the commission of\nfinancial crimes by adversarial actors poses a significant risk to the\nnational and economic security of the United States.\n(b) Strategy to Defend Against Risks Posed by Financial Crime\nConducted With Artificial Intelligence.--\n(1) In general.--Not later than 180 days after the date of\nthe enactment of this Act and annually thereafter, the\nSecretary of the Treasury, the Secretary of Homeland Security,\nand the Secretary of Commerce, in consultation with the\nofficials specified in paragraph (3), shall jointly submit to\nCongress a report, which shall include a classified annex and\nmay include an unclassified summary, provided that no sensitive\ninformation is disclosed publicly, that includes the following:\n(A) A description of interagency and applicable\nintergovernmental policies, procedures, and working\ngroups to defend United States financial markets,\nUnited States persons, United States businesses, and\nglobal supply chains from the national and economic\nsecurity risks posed by the use of artificial\nintelligence by adversarial actors in the commission of\nfinancial crimes.\n(B) A description of public-private partnerships,\ncollaborative arrangements, and other coordinated\nactivities of Federal departments and agencies in\ncooperation with the private-sector to defend United\nStates financial markets, United States persons, United\nStates businesses, and global supply chains from the\nnational and economic security risks posed by the use\nof artificial intelligence by adversarial actors in the\ncommission of financial crimes.\n(C) An itemized list of, and accompanying analysis\nof, readily available resources, including hardware,\nsoftware, technologies, and people that can be\nimmediately deployed by Federal departments and\nagencies to combat the use of artificial intelligence\nin the commission of financial crimes, with an\nassessment of their capabilities, limitations, and\ntradeoffs.\n(D) An itemized list of, and accompanying analysis\nof, resources, including hardware, software,\ntechnologies, and people, and budgetary estimates\nneeded to help Federal departments and agencies to\ncombat the use of artificial intelligence in the\ncommission of financial crimes, with an assessment of\ntheir capabilities, limitations, and tradeoffs.\n(2) Considerations.--Reports required pursuant to paragraph\n(1) shall take the following risks into consideration:\n(A) Deepfakes.\n(B) Voice cloning.\n(C) Foreign election interference.\n(D) Synthetic Identities.\n(E) Artificial Intelligence-Driven Market Response.\n(F) False flags and false signals that disrupt\nmarket operations.\n(G) Attacks involving AI-supported social\nengineering.\n(H) Cyber breaches.\n(I) Number Spoofing.\n(J) Overall digital fraud and scams.\n(3) Officials specified.--The officials specified in this\nparagraph are the following:\n(A) The Attorney General.\n(B) The Chairman of the Board of Governors of the\nFederal Reserve System.\n(C) The Comptroller of the Currency.\n(D) The Chairperson of the Federal Deposit\nInsurance Corporation.\n(E) The Chairman of the National Credit Union\nAdministration.\n(F) The Director of the National Institute of\nStandards and Technology.\n(G) The Chairman of the Securities and Exchange\nCommission.\n(H) The Chairman of the Federal Communications\nCommission.\n(I) The Chairman of the Federal Trade Commission.\n(c) Recommendations.--Not later than 90 days after each report\nunder subsection (b) is submitted, the Secretary of the Treasury, the\nSecretary of Homeland Security, and the Secretary of Commerce shall\njointly submit to Congress a set of recommendations relating to each\nsuch respective report that contains the following:\n(1) Legislative recommendations to address the risks posed\nby the use of artificial intelligence by adversarial actors in\nthe commission of financial crimes.\n(2) Best practices to assist American businesses and\ngovernment entities with risk mitigation and incident response\nto address the risks posed by the use of artificial\nintelligence by adversarial actors in the commission of\nfinancial crimes.\nUnion Calendar No. 615\n\n119th CONGRESS\n\n2d Session\n\nH.
